INDIANA 46601-1830 <br />CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR <br />BOARD OF PUBLIC WORKS <br />December 13, 2016 <br />Linda DeCicco <br />515 Benton St. <br />Mishawaka, IN 46545 <br />PHONE 574/235-9251 <br />FAx 574/235-9171 <br />RE: Revised Approval - Encroachment into Public Right -of -Way — 828 Park Avenue <br />Dear Ms. DeCicco: <br />The Board of Public Works, at its meeting held on December 13, 2016, reviewed their <br />previous recommendation regarding the installation of a Historical Marker marking the <br />birthplace of poet Kenneth Rexroth in the tree lawn at 828 Park Avenue. The Board's previous <br />recommendation was to work with Jitin Kain, Deputy Director of Public Works on a smaller <br />sign. After review, Mr. Kam submitted a memo to the Board of Public Works stating <br />historical markers are the same standard size across Indiana and there is no precedent for a <br />smaller historical marker. Documentation was also submitted showing examples of historical <br />markers on residential property. Therefore, this encroachment was approved for placement <br />of a standard size historical marker in the tree lawn parallel to the street, subject to the <br />improvements not becoming a safety hazard. Enclosed please find a copy of the approved <br />memo from Mr. Kain. <br />The encroachment will be permitted to remain and continue until such time as the Board of <br />Public Works of the City of South Bend shall determine that such encroachment is in any way <br />impairing or interfering with the highway or with the free and safe flow of traffic thereon. <br />Said encroachment shall not in any way prejudice or preclude the City's rights with respect <br />to the future use of that portion of the right-of-way. <br />If you have any further questions regarding this matter, please call this office at (574) 235- <br />9251. <br />Sincerely, <br />Linda M.
