<br />REGULAR MEETING APRIL 27, 1971 
<br />REGULAR MEETING 
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council 
<br />Chambers in the County -City Building on Tuesday, April 27, 1971 at 8:05 p. m., with all members 
<br />present. The meeting was called to order by Council President Robert O. Laven. The invocation 
<br />was given by Reverend George Schidel, St. Patricks Church, 309 South Taylor Street, South Bend, 
<br />Indiana. 
<br />ROLL CALL 
<br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, 
<br />Szymkowiak, Palmer and Zielinski 
<br />ABSENT: Councilman Wise 
<br />RESOLVE INTO THE COMMITTEE OF THE WHOLE 
<br />Council President Laven entertained a motion to resolve the Council into the Committee of the 
<br />Whole on the state of the City to consider the items listed on the agenda for the consideration 
<br />of the Committee of the Whole. Councilman Zielinski so moved and Councilman Grounds seconded 
<br />the motion. Motion carried. Time: 8:06 p. m.

<br />ORDINANCE 
<br />AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF 
<br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 
<br />GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE, 
<br />BEING ORDINANCE NO. 4990 -68, AS AMENDED, (FORMERLY 
<br />ORDINANCE NO. 3702), BY ADDING PROVISIONS DEALING WITH 
<br />MOBILE HOME PARKS. 
<br />Council President Laven made a motion that the Ordinance be striken from the records and with- 
<br />drawn and a new Ordinance be received at this meeting tonight and the new ordinance be given 
<br />first and second reading on the agenda. Councilman Szymkowiak seconded the motion. Motion 
<br />carried. 8 ayes, 0 nays, 1 absent (Councilman Wise). 
<br />ORDINANCE 
<br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF 
<br />SOUTH BEND, INDIANA - 1962 SECTION 40 AS AMENDED AND 
<br />GENERAL ORDINANCE NO. 4990 -68, AND THE ACCOMPANYING MAP 
<br />THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING 
<br />ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE 
<br />DISTRICT FOR A CERTAIN PARCEL OF LAND, AS AMENDED.

<br />This being the time heretofore set for public hearing on the above ordinance, proponents and 
<br />opponents were given an opportunity to be;heard thereon. Mr. Glenn Barbe, Redevelopment Depart - 
<br />mbnt answered various questions from the Councilmen. Council President Laven asked why a paper 
<br />legal description and not a field survey legal description was given in the ordinance. Mr. 
<br />Barbe replied that a legal description is not available at this time, however, it will be avail - 
<br />able. when all properties are demolished and a field survey can be made. Councilman Laven in- 
<br />structed the Clerk to send a communication to the Redevelopment Department asking for a letter 
<br />informing the City Clerk and Council of the completion of the field survey description. He 
<br />said this request is not a part of the ordinance but is only for completion of the Ordinance file. 
<br />Mr. Barbe stated that he make sure the request is granted.

<br />Councilman Reinke made a motion, seconded by Councilman Craven, that the ordinance go to the 
<br />Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Wise). 
<br />ORDINANCE 
<br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER 
<br />TREATMENT PLANT OF SOUTH BEND, INDIANA AND E. L. ZIMMERMAN 
<br />CO., INC. OF MISHAWAKA, INDIANA, FOR FURNISHING AND INSTAL- 
<br />LING PIPING, VALVES, ETC., FOR SLUDGE DRAW -OFF DIGESTER 
<br />NOS. 2 AND 4, IN THE AMOUNT OF $35,511.00. 
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and 
<br />opponents were given an opportunity to be heard thereon. Mr. Louis Rague, Superintendent of 
<br />the Wastewater Treatment Plant stated that E. L. Zimmerman was low bidder and was an experienced 
<br />firm in this work because he had done similar work for the City last year. He said the work 
<br />would make improvements in two digesters at the sewage plant. Piping and valves would be instal- 
<br />led to improve the efficiency of the machinery. 
<br />Councilman Zielinski made a motion, seconded by Councilman Craven, that the ordinance go to the 
<br />Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Wise).
