COMMITTEE OF THE WHOLE MEETING MARCH 14, 1960 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in th <br />Council Chambers on Monday, March 14, 1960, at 8:11 P.M., with all members present. The meeting was called to order <br />by T. W. Lehman, Chairman, who presided. <br />ORDINANCE <br />ORDINANCE N0. BEING AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED <br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA !! <br />(Industrial Foundation, Inc. - -- Northeast Section of the City) l <br />This being the time set for Public Hearing on the above Ordinance, proponents and opponents were given an opportunity <br />to be heard thereon. Speaking in favor of the proposed Ordinance were the following: <br />Warren McGill, Attorney, representing the Industrial Foundation, Incorporated, petititoners to rezone.ii <br />Roger DeClercq, 3609 Elwood; Howard Goodhew, President of the South Bend Civic Planning Association; <br />George Mynsberg, 1413 North Wellington. <br />'i <br />Speaking against the proposed Ordinance were the following: <br />i <br />Robert L. Stephan, Attorney for the remonstrators. <br />Mrs. Milton R. Adams, 1620 North Kenmore " <br />i <br />Jim Stephens, 1632 North Kenmore <br />i <br />Gilbert Landon, 1649 North Iowa <br />Richard Grismer, 1620 North Wellington <br />Paul Smelser, 1346 Sussex Drive <br />i <br />Rebuttal by Richard Gagnon, Attorney. Counter - rebuttal by Mr. Robert Stephan, Attorney. <br />Mr. Robert L. Huff, Director- Secretary of the City Planning Commission explained the Comprehensive plan of zoning. <br />He stated that this is called the Master Plan. <br />r. <br />Mr. Henry Sucher, Director of Urban Redevelopment explained that there is no conflict between this proposed plan <br />and the Sample Street Redevelopment project because the characteristics are different. The Sample Street area <br />will not be available for at least two years and this land is available at once. <br />Five minute recess from 9:29 P.M. to 9:39 P.M., granted upon motion of Councilman Coleman, seconded by Councilman <br />Kroll. <br />Councilman Krueper made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded <br />the motion. Motion carried. <br />it <br />ORDINANCE <br />AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION III <br />DOLLARS ($1,000,000.00) TO BE APPLIED TO THE COST OF CONSTRUCTION, RE- CONSTRUCTION AND <br />IMPROVE�4ENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. <br />The pr.eaiding orricer announced that the Committee was ready to hear all taxpayers interested on the question of <br />the necessity for the appropriation provided for in said ordinance. <br />After hearing all taxpayers desiring to be heard on said ordinance Councilman Kroll moved that the ordinance be <br />approved and that it go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried, <br />u <br />AN ORDINANCE PREVENTING AND REGULATING THE USE OF FIREARMS, AND OTHER INSTRUMENTS <br />TENDING TO ENDANGER PERSONS OR PROPERTY WITHIN THE MUNICIPAL CITY OF SOUTH BEND, <br />INDIANA <br />h <br />Proponents and opponents were given an opportunity to be heard on this Ordinance. Councilman Kroll made a motion <br />to amend the Ordinance, as follows: <br />it <br />That Section I of the ordinance shall be amended to read as follows: <br />SECTION I. That it shall hereafter be unlawful within the Municipal City of South Bend, <br />Indiana, for any person to shoot any revolver or pistol of any description, shotgun, <br />or rifle which may be used for the explosion of cartridges, or any air gun, gas operated <br />gun or spring gun, pellet gun or instrument made for the purpose of throwing or projecting <br />missiles of any kind by any means whatsoever, whether such instrument is called by any name <br />set forth above, or by any other name. <br />II <br />That a new Section II shall be added to the ordinance to read as follows: <br />SECTION II: It shall hereafter be unlawful fpr any person, to maliciously injure or cause <br />to be injured, destroyed, or mutilated any property, private or public, by the use of any <br />instrument. <br />That Section II of the ordinance shall become Section III. <br />That Section III of the ordinance shall become Section IV. <br />That a new Section V shall be added to the ordinance to read as follows: <br />SECTION V. That if any portion of this ordinance shall be declared unconstitutional for <br />any reaspn, the remainder of the ordinance shall be and remain in full force and effect. <br />That Section IV of the ordinance shall become Section VI. <br />Councilman A41en seconded the motion. Motion carried. <br />Councilman Coleman made a motion that the Ordinance, as amended, go to the Council as favorable. Councilman Allen <br />seconded the motion. Motion carried. <br />There being no further business to come before the Committee of the Whole, Councilman Coleman made a motion to <br />adjourn, which motion was seconded by Councilman Allen.
