HomeMy WebLinkAbout01/18/06 Board of Public Safety Special Meeting Minutes SPECIAL MEETING JANUARY 6, 2006 EXECUTIVE SESSION JANUARY 6, 2006 The Board of Public Safety met in the Executive Session at 8:15 a.m. on Friday, January 6, 2006, with Board President Jesusa Rodriguez with Board Members Juanita Dempsey, Patrick Cottrell and Donald L. Alford present. Also present were Police Chief Thomas H. Fautz and Board Attorney Thomas Bodnar. The meeting was held in the Mayor's Conference Room, 14~' Floor, County City Building, South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (B) and adjourned at 3:25 p.m. A special meeting of the Board of Public Safety was convened at 8:38 a.m. on Friday, January 6, 2006 by Board President Jesusa Rodriguez. Board Members Donald L. Alfori:, Juanita Dempsey and Patrick Cottrell were present. Also present was Board Attorney Thomas Bodnar and Police Chief Thomas Fautz. POLICE DEPARTMENT FILING OF CHARGES -SERGEANT RONALD NOWICKI Police Chief Thomas Fautz, in a letter to the Board presented the Board with a Filing of Charges in the matter of Sergeant Ronald Nowicki, Charge 06-01. It is the recommendation of Chief Thomas Fautz, that Sergeant Nowicki be suspended from duty for twenty-one (21) calendar days. COUNT I On December 30, 2005, Sergeant Ronald Nowicki was found guilty of operating a vehicle with a blood alcohol content 0.08 or above in violation of I.C. 35-50-3-4, a Class D misdemeanor in the St. Joseph Superior Court, Cause Number 71D01-0512-CM- 10107. Such conduct violates I.C. 36-8-3-4(b)(1). COUNT II On December 240, 2005 Sergeant Ronald Nowicki, a member of the South Bend Police Department, while off duty on State Road 2 in St. Joseph County, Indiana operated a motor vehicle with a blood alcohol content of 0.08 or above. Said conduct violates I.C. 35-50-3-4, Rules 302.00(A)(1), (2) and (3) of the South Bend Police Department Duty Manual and LC. 36-8-3-4(b)(B) and (H). The Board instructed the Clerk to prepare the appropriate paperwork and deliver to Sergeant Nowicki. There being no further discussion, the Board accepted and filed Charge 06-01, in the matter of Sergeant Ronald Nowicki. ACCEPT AND APPROVE LETTER OF UNDERSTANDING -DESIGNATION OF SHIFTS Chief Thomas Fautz submitted a Letter of Understanding for the designation of shifts at the South Bend Police Department, effective January 6, 2006. Midnight Shift is now designation at "Third Detail"; Day Shift is designated at "First Detail"; and Afternoon Shift is designated as "Second Detail". Upon a motion made by Ms. Dempsey, seconded by Mr. Alford and carried, the Letter of Understanding was accepted and approved. PRIVILEGE OF THE FLOOR Ms. Nancy Sulok, South Bend Tribune, asked the Police Chief to clarify the various "shifts".
