Sl_L_L-1L A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF A SCRAP DEALER'S LICENSE FOR WEAVER TRUCK AND EQUIPMENT COMPANY. WHEREAS, the Common Council of the City of South Bend recognizes the contributions that recycling operations such as junk and scrap yards make to the community; and the Council further realizes that such operations must be reasonably regulated in order to minimize any environmental or.aesthetic nuisances which may be created by the operations of scrap and junk yards within the city; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operations of the scrap and junk dealers; and WHEREAS, although Weaver Truck and Equipment is not considered a junk dealer under the definition of same in Ordinance No. 6621 -79, the requirement for licensing the premises as a scrap yard is based upon the nature of the articles stored on the property rather than the specific nature of the business being conducted; and WHEREAS, in accordance with the requirements of Ordinance No. 6621 -79, inspections of the premises are required to be completed by the Neighborhood Code Enforcement Office and the Fire Prevention Bureau; and it has been determined that no code violations exist on the property of Weaver Truck and Equipment Company, 3700 Gertrude Street; and WHEREAS, the Board of Public Works, at its meeting held on July 20, 1981, approved the issuance of a scrap dealer's license for Weaver Truck and Equipment Company, 3700 Gertrude Street, subject to approval of the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the license application for Weaver Truck and Equipment Company, 3700 Gertrude Street, be approved based upon the favorable review . of the property by the Neighborhood Code Enforcement Office and the Fire Prevention Bureau in accordance with the inspection reports attached hereto and made a part hereof as. required by Ordinance No. 6894 -81. SECTION II.
