to order at 3:48 p.m.

Zoning and Annexation Chairperson, Al "Buddy" Kirsits began the hearings with all
committee members present. He noted both bills under review were substitutions that
needed to be accepted. That done, he recognized Jim Masters representing the petitioners
for rezoning in Bill No. 49-09. He began by referencing the Area Plan Commissions
unanimous favorable recommendation. The requested change from LB Local Business to
GI General Industrial would allow Huffaker Enterprises to utilize a now vacant building
on 1.1 acres for storage and metal fabricating. Three homes on the property would be
demolished for a fenced storage yard once the residents were relocated. Christa Nayder
noted for the record the APC staff recommendation was unfavorable out of concern for
the houses. Masters reiterated the residents would be given ample time to re-locate once
fairly compensated•forthefr property. On a motion to send to Council favorably by
Council Member Oliver Davis, seconded by David Varner, and supported by all Council
Member Kirsits noted the affirmation.

Bill No. 54-09
This bill also a substitute, as explained by Christa Nayder from the APC staff, would
change the approval process for changes to a (PUD) Planned Unit Development.
Questions from Council Members Varner and Puzzello focused on who would have the
authority to distinguish differences between minor and major changes to a PUD as well
as where the authority to approve changes would reside. Not satisfied with the apparent
diminishment of Council authority Council Member Varner suggested in the form of a
motion seconded by Council Member Oliver J. Davis, the bill be continued until the
meeting on October 12, 2009. Consensus achieved, Chairperson Kirsits adjourned the
meeting at 4:08 p.m.
Footnote: The APC later requested a continuance until 10-26-09 which was accepted by
full Council.
