AMENDMENT TO AGREEMENT
BETWEEN OWNER AND ENGINEER
FOR
PROFESSIONAL SERVICES
The Board of Public Works, City of South Bend, Indiana ("Owner") and MWH Americas, Inc.
("Engineer") entered into an agreement for professional services ("Agreement") effective
February 10, 2015 for services relating to:
South Bend Combined Sewer Overflow (CSO) Long Tenn Control Plan (LTCP) Integrated
Planning Reevaluation ("Project").
The Agreement is hereby amended to include additional services as described below. These
additional services comprise Phase 1 C of the Project as described in this Amendment. This
Amendment is effective as of 1Z , 2v/1, ("Effective Date").
Phase 1C Introduction and Overview
Over the past 15 months, the City's Consultant Team has completed the Phase lA/lB
reevaluation of the 2012 Long Term Control Plan incorporated into the City's current CSO
consent decree. The work done to date has resulted in an update of estimated costs for
construction of the remaining LTCP projects, refinement of the collection system and water
quality models used to analyze potential management strategies, identification of cost saving
conceptual alternatives to the current LTCP, and formulation of an initial strategy for
modifications or wholesale changes to the City's current LTCP that would achieve the goals of
this effort at a reduced cost to South Bend.
The goals of the proposed Phase 1 C Scope of Work are to:
• refine the City's collection system model to further improve its ability to accurately
predict system performance and support optimization analyses;
• investigate the potential for enhancement of the collection system model through
integration of Cognitive Hydraulic Response System features and linkages to the St.
Joseph River water quality model;
• develop cost functions for the construction of various LTCP alternatives that can be
incorporated into the model being used for system optimization;
• formulate and implement an optimization analysis of LTCP alternatives to provide
insight into the potential for further reduction of program costs through refinements to
the LTCP or changes in the target level of service; and

The Consultant Team will continue to coordinate with the CSO Citizens Advisory Committee
and the City's Legal Team during Phase I C to solicit feedback and suggestions from
representatives of the community. It is also possible that a meeting with USEPA will be
conducted during Phase I to update agency representatives on the City's progress and current
efforts to improve the LTCP.
Phase 1 C services will be provided by the existing project team consisting of-
MWH Americas, Inc.
• American Structurepoint
• EmNet, LLC
• LimnoTech
MWH Americas, Inc. is the prime consultant to the Board of Public Works under this agreement.
However, given the specialized nature of elements of the Phase 1 C scope of services, subcontract
firms will have lead responsibility for the performance and completion of certain scope tasks.
Phase 1 C services are expected to begin in July 2016 and be completed by the end of October
2016.
Detailed Scope of Work— Phase 1C
Task 7 Project Administration and Quality Management (Lead Firm: MWH)
MWH will maintain established project administration practices through the 4 month duration of
the Phase 1 C effort. Specific practices include:
1. Project Management -For the projected 4-month Phase 1C project duration, MWH will
provide coordination of its own staff and subconsultants, and track the engineering services
budget. MWH will prepare monthly invoices detailing project progress submitted in an
agreed upon form.
2. Project Coordination - MWH will attend up to four progress and review coordination
meetings during the Phase 1 C South Bend LTCP effort to review project progress and to
obtain direction on matters requiring decisions by the City. These progress meetings will
address the technical aspects of the work and results of the investigations, analyses, and
conceptual design efforts at various phases of completion. Meetings will be conducted over
the phone or scheduled coincidentally with other workshops/meetings.

Quality Control - Quality Control (QC) procedures will be employed in order to maintain
work product quality. These procedures will address the use of quality control reviews,
engineering and calculations checking, conceptual design checking, construction and
operation issues, and other measures necessary to maintain a consistent, complete, high
quality and compatible plan. A formal QC review will be conducted on key technical
memorandum. City staff will be invited to contribute to quality reviews.
Task 8 — Coordination Meeting with Advisory Committee (Lead Firm: MWH with local
support from ASI)
Ongoing communication and coordination with the CSO Advisory Committee established by the
City during Phase lA/113 of the reevaluation effort is important to the development of local
support for ongoing CSO control efforts. During Phase I of the effort, MWH will:
1. Communicate with City staff to develop an agenda for and schedule a progress meeting
with the CSO Advisory Committee
2. Prepare advance materials and conduct a meeting with the CSO Advisory Committee to
discuss updated financial data pertaining to LTCP alternatives or wholesale changes and
solicit input regarding the City's strategy for ongoing refinement and implementation of
the LTCP.
3. Document key discussions from the Advisory Committee meeting in the form of written
meeting notes.
Task 8 Deliverables
• Meeting Agenda, Presentation Materials, and Notes —Phase IC Advisory Committee
Meeting. MWH will be responsible for production of this deliverable.
Task 9 — Collection System Model Refinement (Lead Firm: MWH)
Modifications made to the City's previous collection system model during the Phase IA/1B
Reevaluation effort significantly improved the representation of the existing service area and
infrastructure and resulted in improved agreement between model results and observed
conditions. This task will involve additional model refinement as required to further improve the
model's ability to predict system performance and prepare for use of the model for an
optimization analysis. Specific refinement efforts will include:

1. Refinement of model components with greatest potential to improve calibration against
observed flow data (e.g., CSONet control strategies, combined/separated tributary areas;
CSO configurations and weir elevations; inflows from Bowman Creek, Clyde Creek;
stormwater basin configurations, etc.).
2. Validation of typical year output against results generated using the CHRS node time
series.
3. Use the refined collection system model to perform simulations of the following
scenarios:
a. Existing conditions (2015) model run for typical year rainfall
b. Current (2012) LTCP Phase 1 and Phase 2 model run for typical year rainfall
c. Current (2012) LTCP Phase 1 and Leeper Tank model run for typical year rainfall
4. Prepare a technical memorandum that provides a summary of results from the refined
collection system model simulations listed under Task 10.3.
Task 9 Deliverables
• Technical Memorandum - Updated Collection System Model and Baseline Simulation
Documentation. MHW will be responsible for production of this deliverable.
Task 9 Exclusions
• No field investigations (sewer inspections, surveys, flow monitoring) are included in this
scope. Should such investigations be determined to be necessary, MWH will notify the
City so that a plan for their performance can be developed.
Task 10 Optimization Analysis Planning (Lead Firm: EmNet)
Optimization technology allows for the efficient analysis of the performance of a large number
of potential combinations of improvement options. The improved model of the South Bend
collection system together with enhanced understanding of the limitations and costs of
alternative measures can be used as inputs to identify potential improvement plans that cost
effectively achieve the City's goals. EmNet will lead a collaborative discussion with project
team members to decide upon the framework to be used for the optimization and confirm the
inputs required to support the analysis. Potential scenarios include the optimization of
improvement alternatives to achieve either an established water quality goal or an established
goal for the number of overflows in a typical year. EmNet will prepare a technical memorandum
to document the adopted optimization plan.

Task 10 Deliverables
• Technical Memorandum — Adopted Optimization Plan. EmNet will be responsible for
production of this deliverable.
Task 11 CHRS Integration (Lead Firm: EmNet)
EmNet will build upon the previous work done during Phase lA/1B to further develop and
integrate Cognitive Hydraulic Response System nodes into the updated South Bend collection
system model developed during Task 10. EmNet will use the updated model from Task 9 along
with selected CHRS nodes to generate time series output for the typical year rainfall under
existing conditions, and to facilitate use of the updated model for the optimization analysis.
Task 11 Deliverables
There are no specific deliverables from this task. The updated collection system model
with the CHRS nodes integrated will be used as the basis for the optimization analysis
described under Task 15.
Task 12 Water Quality Analysis Integration (Lead Firms: EmNet, LimnoTech)
Decisions regarding the effectiveness of potential refinements or wholesale changes to the South
Bend LTCP will depend on results from simulations of meeting water quality goals for the St.
Joseph River. Supplemental water quality modeling results are needed to quantify the level
achieved by a range of CSO management options, including different levels of control.
LimnoTech, working with EmNet will perform tasks to update the current water quality model of
the St. Joseph River and provide for the linked analysis of water quality conditions with the
OptiS WMM simulations proposed. Specific activities will include:
1. Obtaining 2015 river water quality sampling data from the Cities of South Bend and
Elkhart, update the water quality database and update the data analysis section of the
water quality model calibration technical memo developed under Phase IA.
2. Performing sensitivity analysis on the duration of the CSO discharge from the South
Bend CSOs and the Elkhart CSOs in the calibration model for the time period of 2012-
2013, and update the sensitivity analysis section of the water quality model calibration
technical memo developed under Phase IA.
3. Following the completion of the Collection System Model Refinement by MWH under
Task 10, take the typical year output from the updated collection system model and

prepare a new Baseline WQ run, and update the Baseline Water Quality Scenario
Technical Memo developed under Phase IA.
4. Develop a water quality model optimization integration tool to support linkage between
the SWMM collection system model and the BLTM Water Quality Model for use in the
OptiS WMM optimization tool developed by EmNet that will allow for an integrated
analysis of improvement alternatives. This will involve developing a software "wrapper"
that allows for the ready transfer of CSO hydrograph data from the S WMM collection
system model into the BLTM water quality model, and exporting water quality results to
OptiS WMM.
5. Prepare a Technical Memorandum to document the water quality model optimization
integration tool.
Task 12 Deliverables
• Updated Technical Memoranda — Water Quality Model Calibration & Water Quality
Model 2015 Baseline Water Quality Scenario
• Technical Memorandum — St. Joseph River Water Quality Model Integration for
optimization analysis of improvement options. LimnoTech will be responsible for
production of this deliverable.
Task 12 Assumptions
• South Bend will provide their St. Joseph River and tributary (if available) monitoring
data from 2015.
• South Bend will assist the consultant with obtaining St. Joseph River and tributary
monitoring data from Elkhart and Mishawaka, if needed.
• The cities of Elkhart and Mishawaka will provide their water quality monitoring data
within four weeks of notice to proceed.
• Hourly volumes from collection system hydraulic model will be provided to the water
quality modeling consultant in a spreadsheet matrix for each of the LTCP scenarios.
• The Elkhart and Mishawaka LTCPs are appropriate representation of future CSO loads
from these communities.
• The year 1992 will continue to serve as the typical year.
• The water quality model optimization integration tool will be developed to run in a
Microsoft Windows Environment using the .Net platform and Access database.
• The water quality model optimization integration tool will allow for variation in the CSO
hydrographs, and the event mean concentration of E. coli in the CSO effluent. All of the
other inputs are expected to remain constant in the optimization runs.

• The output from the water quality model optimization integration tool will be the number
of hours of water quality compliance at up to three (3) locations selected during the
Optimization Planning task (Task 11).
Task 12 Exclusions
• No water quality sampling or testing is included in this scope.
Task 13 Development of Optimization Cost Functions (Lead Firm: American
Structurepoint)
Under this task, cost functions will be developed to provide a reliable basis for the evaluation of
the relative cost and benefits of a range of improvements within the proposed optimization
analysis.
Final decisions regarding the type and size of improvements for which cost functions are to be
developed will be confirmed as part of the optimization planning effort. It is expected that cost
functions will be required for the following type of improvements:
• Sewer separation ($/linear foot and diameter)
• Green stormwater infrastructure ($/square foot of new GSI)
• Trunk Sewer Inflow/Infiltration Removal ($/linear foot of sewer rehabilitation)
• CSONet Monitoring and Control Improvements ($/additional monitoring/control site)
• Consolidation combined sewer construction ($/linear foot and diameter)
• Retention Treatment Basin ($/MG of storage volume plus a base allowance for site
disturbance)
• CSO Storage Tunnel ($/linear foot and diameter plus a base allowance for mobilization)
• CSO Disinfection ($/mgd of peak disinfection capacity plus a base allowance for site
development)
Cost functions will be developed to provide AACE Class 5 level estimates of probable
construction costs for the various type of improvements to be considered in the optimization
analysis. Major cost drivers with the potential to significantly impact the cost of various
improvements will be identified.
Task 13 Deliverables
• Technical Memorandum — CSO Improvement Cost Functions. ASI will be responsible
for production of deliverable.

Task 13 Exclusions
• Cost functions will be based on analyses of hypothetical improvement projects and
available cost data for other types of projects. Cost functions will be limited in their
ability to consider site -specific factors that could impact the cost of improvements at any
specific site.
Task 14 Alternative Concept and Level of Control Optimization Analysis (Lead Firm:
EmNet)
Outputs from Tasks 10-14 will serve as inputs for a comprehensive optimization analysis of the
South Bend combined sewer system. Specific tasks required for the optimization analysis
include:
1. Use of outputs from the model refinement and cost function development tasks as the
basis for evaluating integrated improvement alternatives to achieve the current consent
decree level of control. This optimization will be structured to determine the least cost
option for meeting the current level of control of 4 events per year in a typical year.
2. Use of outputs from the model refinement and cost function development tasks as the
basis for evaluating improvement options and costs with three potential levels of control:
no disinfection, disinfection for the four overflows in a typical year (with 30 minutes
detention), and disinfection following the Michigan Standards (10yr-lhr with 30 minutes
detention). This analysis will be structured to attempt to minimize the cost of the
integrated solution while maintaining each of the three different levels of control.
3. Performance of a level of control analysis using three models that incorporate an
integrated set of solutions and specific level of control requirements. The level of control
tool will scale each element of the integrated solution to find cost effective combinations
of technologies that achieve the specific level of control defined.
4. Prepare technical memorandum documenting the results of the optimization analysis.
Task 14 Deliverables
• Technical Memorandum — Based on the results of this task, EmNet will prepare a
technical report documenting the approach used for the optimization analysis, the sources
of key data used in the analysis, and descriptions of the highest ranking options found to
achieve the target levels of service. EmNet will be responsible for production of this
deliverable.

Compensation for Phase 1C Services
Compensation to the Engineer for the Phase 1 C services defined in this Amendment will be on a
lump sum basis. The lump sum amount for Phase IC services is $430,000.
The portion of the compensation amount billed monthly for Engineer's services will be based
upon Engineer's estimate of the percentage of the total services actually completed during the
billing period. Table 1 provides a breakdown of the basis for the lump sum amount by task.
