AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING ORDINANCE # 9877-08 TO APPROPRIATE AN ADDITIONAL
$130,000.00 AND TO READJUST AND REDUCE CERTAIN DISTRIBUTIONS FOR
CALENDAR YEAR 2009 WITHIN COMMUNITY DEVELOPMENT FUND (#212)
STATEMENT OF PURPOSE AND INTENT
On November 10, 2008, the South Bend Common Council passed Ordinance #9877-08
which appropriated a total of $2,261,981.00 in Community Development Block Grant (CDBG)
monies receivable from the United States Department of Housing and Urban Development
(HUD). This Ordinance #9877-08 provided for distribution to various City agencies and non-
profit private enterprises which perform housing rehabilitation and other services beneficial to
the South Bend Community in furtherance of the HUD grant purposes.
Since passage of Ordinance #9877-08, certain operational changes have occurred which
require the increase of certain designated appropriations and the decrease of others.
Additionally, an increase of the total appropriation by $130,000.00 is required due to receipt of
additional HUD funds awarded to the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA as follows:
SECTION I. The additional sum of $130,000.00 is appropriated within Community
Development Fund (#212) constituting an increase in the 2009 Community Development Block
Grand (CDBG) award received from the U.S. Department of Housing and Urban Development
(HUD) over what the City of South Bend expected when Ordinance #9877-08 was passed on
November 10, 2008. Therefore, the total appropriation shall be $2,391,981.00 rather than
$2,261,981.00 to be used for all the purposes expressed in Section I of Ordinance #9877-08.
SECTION II. The following distributions set forth in Ordinance #9877-08 shall be
increased and decreased as follows:

Dear President Deiter:
The attached bill for Council consideration and approval will amend the CDBG
appropriation ordinance #9877-OS which the Council passed on November 10, 2008. The overall
appropriation is being increased by $130,000, and certain project allocations are being adjusted
and reduced. This is a companion bill to the CDBG-R ordinance also being submitted at this
same time. This bill revises the November 2008 CDBG ordinance by:
1) Adding the increased award amount of $130,000
2) Reducing the allocation to Code Enforcement for the Demolition of Vacant
and Abandoned properties
3) Deleting funding for the Dunbar Corner Rehab (which is covered under the
CDBG-R ordinance)
4) Adding the rehab of (1) Hansel Center for the Notre Dame Center for Arts
and Culture, and (2) former Engman Natatorium. As the Civil Rights
Heritage Center
As was indicated in my email to the Council on June 23, 2009 and in my meetings with
some Council members, these changes are recommended after consultation with HUD based on
the funding best suited for each project. Additionally, these changes were the subject of a
Tribune notice on June 24"', a 30 day public comment period that ran from June 25`~ to July 24`x,
and a public hearing held on July 7, 2009.
