PUBLIC AGENDr~ SESSION MAY 3, 2006
she (3oard of Public Safety met in the Public Agenda Session at 8:00 a.m. on Wednesday, May 3,
2006 with President Jesusa Rodriguez. Board Members Jti~nita Dempsey, Donald Alford and
Pa[rf ck D. Cottrell were present. Mr. Bruce J. Bondurant was welcomed as the new Board member.
_llso present were Uniform Division Chief Darryl Boykins, Chief Luther Taylor and Board Attorney
Thomas Bodnar. Police Chief Thomas H. Fau1z was not present.
The meeting was held in the Board of Public Works Meeting Room, 13`" Floor, County City
Building, South Bend, Indiana.
Board members discussed the following item(s) from that list:

Mr. Bodnar stated two (2) items are being added to the agenda: 1) Special Police
Commissions; and 2 j Proposal for Police Department Training Class. Chief Taylor stated no
agenda items for the Fire Department were being added at this time.

Mr. Cottrell noted u~ en-or on page 34 of the minutes, in the "Regular Meeting" section of
the April 12, ?006 meeting. The minutes indicated President Jesusa Rodriguez was present
at this meeting. The minutes should be corrected to read `President Rodriguez was not
present°'.
- Charge 06-05 -Fire Department
Mr. Bodnar stated this is a new Filing of Charges and recommended the Board accept the
Charges. The Board when then instnict the Cleric of the Board to serve the appropriate
paperwork. Mr. Bodnar stated Chief Taylor would serve the paperwork to the firefighter.
Charge 06-04 and Charge 06-03-James Gadacz and John Szucs -Fire Department
Mr. Bodnar stated Mr. Gadacz and Mr. Szucs did not notify the Clerk of the Board of their
intent to request •a hearing. These matters will be discussed further in the Executive Session.
The Board may accept the Charges filed by Chief Taylor or implement other discipline.
- Comn~endalions - Pire Department
Mr. Bodnar stated three (3) lirefighters receiving the commendation will be present at the
meeting. Mr. Bondurant noted that he is a relative of one of the individuals and will abstain
from voting.
- l~~lonthly Statistical Analysis - Firc [~cpartment
Chief Taylor noted there is a slight increase in EMS nms.
- Charge 06-02 -Joseph Muszer -Police Department
Mr. Michael Tuszynski, Attorney for Joseph Muszer, submitted a letter to the Board of
Safety indicating he would like a continuance in the matter of Charge 06-02, due to previous
conunitmcnts. The date of the hearing was previously set for Friday, May 5, 2006 at 1:30
p.m. The Board discussed the matter and rescheduled the hearing date for May 17, 2006 at
8:30 a.m. in the _Vleeting Room of the 13`x' floor, County City Building. An Executive
Session is scheduled for 8:00 a.m. on the same date. The Clerk will notify the appropriate
par-ties_
- Resignarion -Police Department
Mr. Bodnar stated the resignation is not due to a disciplinary action. Chief Boykins stated
this individual did not show progressive improvement during his training period and decided
~o resign for personal reasons.
- Monthly Statistical Analysis -Police Department
{~i~icf B~~j~kins stated seti°eral larceny and aggravated assault suspects have been arrested.
Btiu~glaries have risen slibhtly in the southeast area.
- Special Policc Commissions
IVIr. Bodnar stated the two (2) Special Police Commissions are for Parking Properties.
- Proposal -Policc Department Training
Chief Boykins stated the uaining proposal is acost-savings to the Police Department, as it
brh7gs the trainers to the facility to "train the trainers". Vlore police officers are trained using
this method. Police officers from other cities attend this training at their cost.
- F.O.P. Memorial Day Service Invitation
Nh~. Bodnar stated the F.O.P. has invited the Board of Safety to the Memorial Service.

The Board of Public Safely met in the regular meeting at 9:07 a.m. on Wednesday, May 3, ?006,
with President Jesusa Rodrigues and Board Members Juanita Dempsey, Donald Alford, Bruce J.
Bondrrrant and Patrick D. Cottrell present. Also present were I;niform Police Chief Darryl Boykins,
Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. Police Chief Thomas H. Fautz was
not present In addition, Attorney Joseph Simeri was present.

1~4r. Cottrell noted an enror on page 34 of the minutes, in the "Regular Meeting" section of the April
1?. ?006 meeting. The minutes indicated President Jesusa Rodriguez was present at this meeting.
the minutes should be corrected to read "President Rodriguez was not present". President
Rodriguez advised that if there were no objections by members of the Board, the minutes of the
Public Agenda Session, Exeeuti~"~e Session, and Regular and Special meetings of the Boardheld on
April 1? and April 20, 2006 would be accepted and approved, with the correction. There being no
further discussion. the mimrtes were accepted.

President .lestrsa Rodriguez stated Chief Luther Taylor submitted Charges against Captain James
Burlars as follows:
FACTUAL ALLEGATIONS
On March. 15, 2006, Captain James Burlars, a sworn firefighter in the South Bend Fire Department,
whi . e off duty, drove his private vehicle southbound on Michigan Road north of 6°i Road in Marshall
County.h~dianawhilcintoxicated. AsaresultofhisactionsCaptainBurkuswaschargedwith,pled
guilty to and was fomzd guilty of operating a vehicle while intoxicated, a Class A Misdemeanor in
Cuusc; No. SOD02-0603-CM-00375 in the Marshall Superior Court on Apri127, 2006_

I'he conduct of Captain James Burkus violates LC. 36-8-3-~(b)(2)(B) and (H) because his conduct
was unbecoming a sworn firefighter and he violated Rule 300.00(1) and 300.00(1 1)(A) of the South
fiend Fire Department Duty Manual.

I~!.c co,wiction of Captain James Burkus in Cause No. SOD02-0603-CM-00375 in the Marshall
`superior Court on .April 27, 2006 is a violation of LC. 36-8-3-4(b)(l ).
11 is the recommendation of Chief Taylor that 1) Captant Burkus be suspended from duty without pay
far twenty (70) consecutive cale~udar days; and 2) a reduction in rank from Captain to Engineer for a
period of six (6) months effectively immediately. There being no fiirther discussion, the Board
~rccepted the Charges for filing, and instructed the Clerk to serve the appropriate paperwork.

President Rodriguez stated the Board reviewed Chief Luther Taylor's recommendation for Charge
06-03 against Jarues Gadacz. The Board of Public Safety moved to amend Chief Luther Taylor's
recommended disciplinary action as follows:
I. .lames Gadacz be suspended from duty without pay for twenty (20) consecutive
calendar days;
2. James Gadacz shall be reduced in rank from Captain to Engineer effective
immediately: and
3. James Gadacz shall complete an EAP program.

Michael and Steve Cox were instrumental in quickly obtaining the appropriate medical care for the
palienr. and they made a significant conlribtdion to saving the-life of Rreon Swan.
Bert further resolved that Todd Skwarcan, John Michael and Steve Cox be commended for
their quick thinking and actions by the City of South Bend.

President Rodriguez advised tJiat the Board is in receipt of a letter of resignation from Patrolman
nndre~~~ I~~~.~. in ~f~hich he tenders his resignation from the South Bend, effective April 1S, 2006.
Chief Thomas Fautz stated that Patrolman Fry was appointed to Che South Bend Police Department
on August 3. 2005. The Board wished him much success in his future endeavors. Upon a motion
made by Mr. Alford, seconded by Mr. Cottrell and carried, the resignation was accepted and
