(1) Public Hearing on Resolution No. 2595
amending the Development Plan for the
South Bend Central Development Area
and adding one or more parcels to the List
of Parcels to be Acquired.
Mr. Relos gave the staff report on the project.
On July 14, 2009 the Commission approved
declaratory Resolution No. 2551 amending
the South Bend Central Development Area
Development Plan. The Area Plan
Commission and South Bend Common
Council have approved the changes to the
plan. The public hearing today and approval
of the Commission’s confirming resolution
completes the process. Resolution No. 2595
adds the following five property clusters to
the List of Properties to be Acquired:

Mr. Inks noted that the Public Hearing file is

Smith, Advertising Director of the South
Bend Tribune, that the Notice of Hearing was
published in that newspaper on July 31,
2009; (3) An affidavit from Richard
Andrysiak, Classified Manager of the Tri-
County News, that the Notice of Hearing was
published in that newspaper on July 31,
2009; (4) A statement from Bill Schalliol
that on July 31, 2009 affected property
owners and registered neighborhood

Mr. Meteiver noted that the Public Hearing
was originally scheduled for July 24, but the
Commission could not seat a quorum for the
meeting. The meeting was rescheduled to
this time. All those who appeared for the
July 21 meeting and all who were originally
notified of the July 21 Public Hearing were
given notice of the new time.

Mr. Varner asked if these were the final
properties intended to be acquired in
connection with the Coveleski area planning.
He said the public needs to see that there is
an end in sight, not just continual, expensive
acquisition. Mr. Gibney responded that they
are the final acquisitions for the
neighborhood plan. The Manor, owned by
Madison Center, has been added outside of
the planning area because of its deteriorated
condition. It is vacant and will be
demolished with no immediate use other than
temporary surface parking.
Mr. Inks noted that only one of these five
properties is in the strategy to be
implemented over the next several years.
The other four are on the list because they
represent a site that may have future
development potential. If we get a proposal
for that site, we want to be able to move
quickly to acquire those properties. We are
not planning to acquire them at this time,
without imminent development opportunity.
Ms. Jones noted that the Commission does
not like to acquire and hold property. But it
is important to plan ahead and be ready for a
development opportunity when it presents
itself. Acquisition and land clearance takes a
lot of time. We try to maintain a reasonable

amount of land to respond to opportunity, not
more land than the market can respond to.

On July 14, 2009 the Commission approved

of the Commission’s confirming resolution
completes the process. Resolution No. 2596
adds thirty-seven properties to the List of
Properties to be Acquired. Acquisition will
occur only as the properties become
available. There is no eminent domain
available to the Airport Economic
Development Area.
Mr. Relos noted that some of the properties
are being acquired for the expansion of Ivy

Tech. Others are at the edges of Ignition
Park and will ensure those areas are cleaned

Mr. Inks noted that the Public Hearing file is

REPRESENTATIVE FROM AIRGAS: We
have a property on Lafayette St. Are you
intending to acquire it? Mr. Relos responded
that he has had discussions with Leigh Purdy
about acquiring the property. Staff is putting
it on the acquisition list so we could move
forward if we come to mutual agreement on a
price. The representative asked if the
company should hold off on listing it with a
realtor. Mr. Relos responded that that is
entirely up to the owners of Airgas. The
company might want to wait until the
appraisals come in.
SPEAKER NO. 2: Does the property owner
have the right to decide if and when to sell.
Mr. Relos responded that the property owner
does.
SPEAKER NO. 3: My house is in the 1500
block of Indiana Avenue, south side. Is my
house part of this plan? Mr. Relos responded
that this plan does not affect any one on the
south side of Indiana Avenue.
Mr. Gibney noted that staff has met with the
Rum Village Neighborhood Association
several times. They looked at the physical
condition of parts of the neighborhood. They
felt that the north side of the street was most
troubled, with its vacant storefronts and
residential lots. The north side of the street
seemed a natural boundary for Ignition Park.
Staff and the neighborhood association felt
that expansion of Ignition Park to Indiana
Avenue would then strengthen the south side

of Indiana Avenue.
BARBARA DUNCANSON: I am here from
Ivy Tech, along with my colleague, Bob
Placek. We would simply like to thank the
Redevelopment Commission, on behalf of
the Chancellor and our Ivy Tech South Bend
community, to thank everyone who has
worked with us, including Jeff and Dave.
We feel that the expansion of Ivy Tech
Community College is extraordinarily
necessary. We anticipate that our enrollment
this fall, when the dust settles and we figure
out what our final count is, we’ll probably be
up around 25%. We have really reached the
limit of students we can serve under current
circumstances. As may of you know, we
have moved our administration, and also
have some classrooms, in a building along
Sample Street. We have moved our
Chancellor over to Sample Street. We have
literally done what we can with existing
space. This is part of a long term vision for
the expansion of your community college in
downtown South Bend, to continue to work
with other partners such as the University of
Notre Dame on the technology projects, and
to serve the community with educational
services.
BOB PLACEK: I want to add that we are
prepared to invest $150,000,000 over the
next two years. We are ready to start
investing, because the pressure of the
students is driving us.

B. Tax Abatements
(1) Resolution No. 2597 approving an
application for personal property tax
deduction for property located at 4701
Nimtz Parkway in the Airport Economic
Development Area (Schafer Gear Works)
Mr. Mathia gave the staff report on the
project. Schafer Gear Works manufactures
gears and machined components to customer
specifications. The company has received
new business from three customers that
require the purchase of new equipment. The
equipment consists of three CNC lathes, one
CNC hobbing machine, one CNC gear
grinding machine, one CNC machining
center, two deburring machines and one
internal gear grinding attachment. The total
estimated cost of the equipment is
$2,800,000.

B. Tax Abatement

Total taxes to be abated during the (5) five-
year abatement period are estimated at
$44,531. Total additional taxes to be paid as
a result of the project during the five-year
abatement period are estimated at $216,721.
It is estimated that the project will create
eight new, permanent full-time positions with
an annual payroll $249,600. The project will
also maintain sixty-seven existing permanent
full-time positions with a total annual payroll
of $2,852,281.
Schafer Gear Works has had nine previous
tax abatements, both real property and
personal property. They are in compliance
with all reporting requirements for those
abatements.
The property is properly zoned for the
proposed project. The property is located in
the Airport Economic Development Area,
which is a Tax Incremental Allocation Area;
therefore, the petition for personal property
tax deduction must first be approved by the
South Bend Redevelopment Commission.
The property meets the qualifications for a
five-year personal property tax abatement tax
abatement ordinance.
Mr. Blenke noted that the purchase of this
equipment is the result of a new contract
recently secured with three customers. This
new business is a welcome change from the
business climate over the last eighteen
months. The equipment is state of the art
equipment.

Mr. Blenke noted that Schafer Gear Works
currently pays approximately $170,000 a
year on equipment taxes and another
$130,000 in real estate taxes. They
appreciate the assistance on this request. The
new projects will start in early 2010.
Mr. Jones noted that tax abatement does not
abate existing taxes, but taxes on new
equipment or new construction. She said it is
a misnomer that we call these tax
abatements. They should be called tax
phase-ins.
Mr. Downes said he has known Mr. Doshi
and Mr. Blenke for many years. He thanked
them for continuing to make top notch
investment in our community with the
resulting high paying jobs.

Redevelopment and Fire Arts, Inc. (305 E.
Colfax)
Mr. Inks noted that this is a purchase
agreement selling the property at 305 E.
Colfax to Fire Arts, Inc. for $10. Fire Arts is
a group of local artists. They have been
leasing the building from the Commission
since 2004. They have made a number of
improvements over that time. The agreement
will allow them to own the property. There
will be a restriction that for twenty-five years
its use must remain a non-profit, fine arts
studio and gallery. If it does not, the
property will revert to the Redevelopment
Commission.
Mr. Inks noted that the Commission
originally purchased the site for parking in
the East Bank. But with completion of the
East Bank Plan, that site is now part of an
“arts corridor” and Fire Arts is an appropriate
use for that. Staff recommendation is to sell
the property to Fire Arts.

the East Bank Village Master Plan). He
noted that the East Bank Village Master Plan
Phase I was completed in 2008.
The potential relocation of the Transpo
maintenance facility to Ignition Park will
open up about 25 acres for development.
Staff realized that the river front was under
utilized and we did not have a strategic plan
for the area. The Commission hired the same
consultant that worked on the East Bank
Village Master Plan, JJR, to develop the
Howard Park Neighborhood Master Plan.
JJR used a series of charrettes to solicit
suggestions from stake holders. The
resulting plan includes primarily residential
development on the Transpo site. It includes
reworking of the river front, an update of
Howard Park, bike paths and walkways along
the river. It also suggests the conversion of
commercial property back to residential
along Jefferson Blvd. The plan also suggests
the removal of the cloverleaf off of Eddy
Street. Holladay Properties is currently
applying for a federal grant to help move the
cloverleaf.
Staff intends to present a declaratory
resolution at the next Commission meeting to
expand the boundaries of the South Bend
Central Development Area to include all the
area covered by the Howard Park
Neighborhood Master Plan. That would have
to be approved by the Area Plan Commission
and South Bend Common Council, followed

by a confirming resolution by the
Redevelopment Commission. A parallel
process would involve approval by the
Indiana Economic Development Commission
to expand the TIF allocation area.

(4) Letter of Intent to lease space at 121 S.
Michigan Street.
Ms. Jennings noted that Spark Fine
Stationary is a retail business selling
stationary gifts and related items. They are
currently located on Hill Street. The lease
will run three years commencing
September 1, 2009 with the option to renew
for two additional three year terms. The rent
in the first year will be $11.26 per square
foot, increasing in years two and three to
$12.26/sft and $13.26/sft respectively. The
total square footage of the space is 1,423.
Rent will commence 90 days after Tenant is
granted possession. The maximum increase
on rent for the two three-year options will be
$1.00/sft. Spark Fine Stationary is
responsible for the tenant build-out and will
pay a common area maintenance fee in
addition to the rent.
Ms. Jones asked if these rents are consistent
with the rent charged to other tenants in the
Michigan Street Shops. Mr. Inks responded

that they are not. These rents reflect the
economy we are in today. This space has
been on the market for a year. This lease will
fill the Michigan Street Shops.

Commission approved the Letter of Intent to
lease space at 121 S. Michigan St.
D. Airport Economic Development Area
(1) Agreement Regarding Real Estate
(Transpo Operations/Administration
Maintenance Facility)
Ms. Kolata noted that this is an amendment
to the Commission’s agreement with Transpo
related to the sale of land in the Airporrt
Economic Development Area. It is a
clarification of responsibilities that we
already have. It restates that the Commission
will be responsible for any environmental
conditions that are present at the site. In the
review of some of Transpo’s documents with
the Federal Transportation Administration,
they wanted this clarified. We believe the
language in this document satisfies the FTA.
The Commission’s original purchase
agreement with Transpo contained our taking
responsibility for environmental problems.
This document adds specific indemnification
language.
Mr. Hardy noted that this document pulls out
the indemnification language from the

Bend Zoning Code to incorporate some of
the guidelines as zoning code.
Mr. Downes asked what impact these
guidelines will have on a home owner in the
neighborhood. Mr. Vitton responded that it
should not have much impact on a home
owner. Most of the guidelines, especially the
ones that would be incorporated into the
code, will be multi-family, commercial and
mixed-use restrictions.
Mr. Gibney noted that in response to some
four-plex units that went up along South
Bend Avenue, that met building code, the
neighborhood decided to raise the standard
with these guidelines and changes to the
building code.
Mr. Varner asked how those four-plexes
would look if they were built under the new
guidelines. What would be different? Mr.
Gibney responded that they would not have
exposed basements. Mr. Vitton responded
that they would be turned on their lots so the
narrow end was toward the street.

$750,000 equipment grant the city received

equipment to outfit the wet lab space at
