HomeMy WebLinkAbout01/18/06 Board of Public Safety MinutesPUBLIC AGENDA SESSION JANUARY 18. 2006 The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Wednesday, January 18, 2006 with President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford and Patrick D. Cottrell present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13~` Floor, County City Building, South Bend, Indiana. Board members discussed the following item(s) from that list. Mr. Bodnar stated the attorney for Jeremy Downs wants to accept the disciplinary action recommended by Police Chief Luther Taylor. The Board stated they would like to further discuss the matter with Attorney Joseph Simeri. - Minutes The Clerk submitted an updated page to the minutes. - Swearing in of Firefighter -Fire Department Chief Taylor stated this firefighter is transferring from the City of Mishawaka, Indiana and is still required to be sworn in. This individual will still attend schooling. - Firefighter Recruit Training -Fire Department Chief Taylor stated five (5) applications will be hired as civilians, and would be sworn in around June of 2006. - Monthly and Annual Statistics -Fire Department It was noted that inspections doubled compared to 2004. Chief Taylor will check on the statistics and report back. - Special Police Commissions -Police Department Mr. Bodnar stated Special Police Commissions are done once a year for newly commissioned individuals. - Rescind Leave of Absence Chief Fautz stated the Board previously approved a Leave of Absence for this officer as a result of an injury to his hand. Recently, his doctor stated surgery may improve the injury, thus the officer would like to rescind the Leave of Absence, as he may regain use of his hand. - Donations -Police Department Chief Fautz stated several donations have been made to the Police Department, whichwill be shared with the Fire Department. - Duty Manual Changes -Police Department Chief Fautz mentioned these changes are first in a series to be submitted over the next year in conjunction with the update of the Duty Manual. The Board noted two errors which will be corrected by the Police Department. - Quarterly Training Report -Police Department Chief Fautz stated a Command Staff Committee reviews officers' requests for training based on their job description and budget. Training is balanced throughout the police force. - Monthly Statistical Analysis -Police Department Chief Fautz stated there is a 1% increase in crime for December 2005. - Charge 06-01 Mr. Bodnar stated the Charge would be discussed in Executive Session. ADJOURNMENT There being no further business to come before the Board, President Rodriguez declared the meeting adjourned at 8:35 a.m. BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA s/Jesusa Rodriguez s/Donald Alford s/Juanita Dempsey Attest: s/Angela Jacob, Clerk EXECUTIVE SESSION JANUARY 18, 2006 The Board of Public Safety met in Executive Session on Wednesday, January 18, 2006, at 8:38 a.m. The meeting was held in the Mayor's Conference Room, 14~` Floor, County City Building, South Bend, Indiana, for the purposes specified in LC. 5-14-1.5-6.1 (b) (2) (B) and (b) (6) (A) and adjourned at 9:09 a.m. President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford and Patrick Cottrell were present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA s/Jesusa Rodriguez s/Donald Alford s/Juanita Dempsey Attest: s/Angela Jacob, Clerk REGULAR MEETING JANUARY 18, 2006 The Board of Public Safety met in the regular meeting at 9:12 a.m. on Wednesday, January 18, 2006, with President Jesusa Rodriguez and Board Members Juanita Dempsey, Donald Alford and Patrick D. Cottrell present. Also present were Police Chief Thomas H. Fautz, Fire Chief Luther Taylor and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13~` Floor, County City Building, South Bend, Indiana. REGULAR MEETING JANUARY 18, 2006 APPROVE MINUTES OF PREVIOUS MEETINGS President Rodriguez advised that if there were no objections by members of the Board, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held onDecember 28, 2005 and the Special Meeting of January 6, 2006 would be accepted and approved. Ms. Dempsey made a motion that the minutes would be accepted with the corrections page. Mr. Alford seconded the motion which carried. APPROVE SWEARING IN OF FIREFIGHTER - BRENT VANBRUAENE Fire Chief Luther Taylor advised that Mr. Brent VanBruaene has applied for sworn status as Firefighter with the South Bend Fire Department. Mr. VanBruaene was a sworn member of the Mishawaka Fire Department for thirteen months and is a member of the Police and Firefighters Pension and Disability Fund. Mr. VanBruaene will be attending the twenty week recruit school and is scheduled to start on January 23, 2006. Mr. VanBruaene has successfully completed allrequirements set forth by the 1977 Pension Fund and his transfer has been approved by PERF. The local Pension Board voted unanimously to approve Mr. VanBruaene for appointment to the South Bend Fire Department. Chief Taylor requested the Board's approval of Mr. VanBruaene's appointment as a probationary Firefighter effective January 18, 2006. Ms. Dempsey made a motion that the appointment be approved. Mr. Alford seconded the motion which carried. Ms. Mary Beth Wisniewski, Assistant City Clerk, was present and administered the Oath of Office to Mr. V anBruaene. The Board wished him well in his endeavors with the South Bend Fire Department. REQUEST FOR FIREFIGHTER RECRUIT TRAINING Chief Luther Taylor submitted to the Board a letter requesting permission to hire five Fire Recruits as civilian City employees. The recruit class is scheduled to begin on January 23, 2006 for a period of approximately twenty weeks with an effective date of hire as Firefighters in June 2006. The names of the applicants are as follows: - Adrian Kaser -Tate Vermeulen - Albert Mroczkiewicz -James Wood - Jeremy Remble Ms. Dempsey made a motion that the request be approved. Mr. Alford seconded the motion which carried. Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of Public Service Officers: - Angela Davis - Maritza Ellis - Diana Gish - Tammi Hohuhn - Barbara Holleman - George Kendall - Elaine Rau - Janice Taberski - Frank Epperson - Kathleen Kiner These commissions do not include the powers of arrest or the carrying of a weapon. These Commissions are renewed for these individuals to be able to be employed as Crossing Guards for schools with police power to enter streets and/or street intersections and to stop or otherwise direct both vehicular and pedestrian traffic upon the street. Police Chief Thomas Fautz recommended that a Special Police Commission be renewed or issued for the following for the purpose of Armorer: - Anthony A. Gish This commission includes the power to carry a weapon in his capacity as Armory Specialist. His duties include the training of all officers in firearms for the South Bend Police Department and qualifying all individuals for Special Police Commissions that require the carrying of a weapon. Mr. Gish handles weapons for the Police Department and the reloading of ammunition. Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of South Bend Park Department: - Gary Hurt - Steve Orlowski - Terry Wheeler These commissions do authorize the individuals to carry a weapon, carry a South Bend Police Department radio and take police reports in South Bend Park and Recreations properties. Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of South Bend Parks Department: - Betsy Harriman - Randy Nowacki - Phil St. Clair - Frank DuPriest These commissions are do not include the powers of arrest nor the carrying of a weapon. The individuals are authorized to carry a South Bend Police Department radio. Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of South Bend Fire Department Arson Investigators: - Russell A. Buysse - Steven Wieger - Robert Brechtl These commissions do not have the powers of arrest but have the power to carry a weapon while acting in the capacity of Arson Investigators. Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of on-street patrol parking enforcement personnel: REGULAR MEETING 2006 - Rita Dalgliesh - Greg Frankhauser - Charles Gannon - James W. Moore - April Stahl JANUARY 18, These commissions do not include the powers of arrest or the carrying of a weapon Police Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued for the following for the purpose of College Football Hall of Fame and Century Center's Director of Safety: - Eugene C. Mikolajewski This Commission includes the carrying of a weapon, full powers of arrest and the occasional wearing of a uniform. Chief Thomas Fautz recommended that Special Police Commissions be renewed or issued to the following security officers of Indiana University South Bend: - John Bright -Curtis Walton - Morris DeGeyter -Eugene Woofter - Thomas F. Faulstich -Roderick Ivory - Edwin Garcia Jr. - Ed Summers - Martin Guersey -Bruce Villwock - Timothy McNeely These Commissions are issued for the purpose of issuing citations for parking violations where such violations have fines set by Ordinance and State Law. All of their officers are sworn and certified through the State of Indiana by the Indiana Law Enforcement Academy Training Board. These Commissions have the same authority of as one of our own sworn police officers in which they have the authority to carry a weapon and the powers of arrest. This will empower the above listed individuals to enforce parking violations on the following streets adjacent to the campus: Mishawaka Ave. from Bellevue Street on the west to 21 ~ Street on the East; Bellevue Street from Mishawaka Avenue on the northto Hildreth Street on the south; Hildreth Street from Bellevue Street on the west to the campus proper on the east; Esther Street from Mishawaka Avenue on the northto Hildreth Street on the south; Ruskin Street from Bellevue Street on the west to the campus proper on the east; 20t'' Street from Mishawaka Avenue on the northto Northside Boulevard on the south; Vine Street from 20t'' Street on the west to 21~ Street on the east; and Northside Boulevard from 21st Street on the east to Memorial Park on the west. It is the recommendation of Chief Fautz that the commissions for the following individuals be renewed or issued for the Department of Code Enforcement: - Tom Anderson -Jeff Katona - Catherine Toppel -Katrina Kester - Karl Hardy -Gary Libbey - Brian Haygood -Stanley J. Molenda - Ed Humphrey -Robert Simmons - Scott Horvath -Jim Wood Animal Control Officers: - Tammie Roberts - Devin Brubaker - Kim Lucas -Rex Pemberton - Carol VanDeWalle REGULAR MEETING JANUARY 18, 2006 These Commissions are issued for the purpose of writing citations for Ordinance violations where such violations have fines set by Superior Court Judges. These Commissions will also empower the above- listed individuals to enforce the Snow Route and Residential Snow Emergencies and to tow vehicles found to be in violation of these Ordinances. These Commissions also include Animal Control officers who issue tickets for nuisance violations. These Commissions do not authorize the powers of arrest nor the carrying or use of a weapon. Police Chief Fautz stated that any previous Special Police Commissions that were issued to anyone not listed in his recommendation letter, are now rescinded. The aforementioned police commissions are in effect until rescinded. All of the aforementioned individuals have met the Commission requirements of the South Bend Police Department. Upon a motion by Mr. Cottrell, seconded by Mr. Alford and carried, the above Special Police Commissions were approved. APPROVAL OF REQUEST TO RESCIND LEAVE OF ABSENCE -PATROLMAN BILLY PELLETIER In a letter dated January 9, 2006, Patrolman Billy Pelletier stated that he will no longer need his previously approved leave of absence and now rescinds his request. Patrolman Pelletier stated that he expects to return to work on January 23, 2006. In a motion by Mr. Cottrell, seconded by Mr. Alford and carried, the request to rescind a leave of absence was approved. ACCEPT DONATIONS TO SOUTH BEND POLICE DEPARTMENT In a letter to the Board, Captain Wanda Shock stated that the Policemen's Credit Union made a donation in the amount of $100.00 to be used for children's safety education purposes. In addition, Family Christian Stores, Mr. Jon Moses and Ms. Rosemary Lahey made donations of teddy bears, dolls, children's gifts and blankets for use by the police and fire departments of the City of South Bend to give to children and adults. There being no further discussion, the donations were accepted. APPROVE DUTY MANUAL CHANGES In a letter to the Board, Chief Thomas Fautz requested approval of changes to the following sections of the South Bend Police Duty Manual, which are made in the form of General Orders. -The General Order for the Indoor Range is an addition and does not replace any section of the Duty Manual. - The General Order on Missing Persons replaces Duty Manual Sections 440.00, 440.10, 440.20, 440.30, 440.40, and 441.00. - The General Order on Stop and Frisk replaces Duty Manual Sections 500.00, 500.02, 500.03, 500.04, 500.05, and 500.06. - The General Order on Public Information replaces Duty Manual Sections 450.00, 450.01, and 450.02 to 450.09. - The General Order on Social Contact replaces Duty Manual Section 500.01. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey, and by and carried, the Duty Manual changes were accepted and approved. FILING OF QUARTERLY REPORT FOR SPECIALIZED TRAINING -OCTOBER THROUGH DECEMBER 2005 Captain Wanda Shock, Director of Training, South Bend Police Department, submitted to the Board a written Quarterly Report for Specialized Training for the period of October Through December 2005. The report indicated the specialized training attended, the names of the officers who attended and the costs involved. There being no questions concerning this report, the Quarterly Report for Specialized Training as submitted was accepted and filed. REGULAR MEETING 2006 JANUARY 18, FILING OF MONTHLY STATISTICAL ANALYSIS REPORT -DECEMBER 2005 President Rodriguez indicated that unless there were questions or objections by members of the Board, the statisticalreport for the month of December 2005 as submitted by the Police Department, would be accepted for filing. Upon a motion made by Mr. Cottrell, seconded by Mr. Alford and carried, the recommendation was approved.
