Agenda: Bill No. 16 -38 — Special Exception for property at
2926 -3302 West Sample
Committee Vice Chair Voorde called the meeting of the Zoning and Annexation Committee to
order at 3:31 p.m. with one (1) item on the agenda. Committee Chair Davis is not present yet,
but because Committeemember Gavin Ferlic and Committeemember Jo Broden are present,
there is a quorum.
Bill No. 16 -38 — Special Exception for property at 2926 -3302 West Sample
Ayoka Paek, Building Department at 125 S. Lafayette, explained the special exception
application for temporary storage of vehicles, over fifty (50) percent coverage of outdoor storage
of the property, and also wrecker service for the property at Sample Street. It comes with a
favorable recommendation from the Board of Zoning Appeals. They also had variances that
were all approved for landscaping and set back requirements.
Brian McMorrow with Abonmarche Consultants, on behalf of the petitioners, Insurance Auto
Auctions and Sample Street Associates, the tenant and owner respectively.
After meeting with the Area Plan staff, we set the fence back sixty -five (65) feet from the right
of way line, then we are going to restore what is now broken asphalt on the street side of the
fence with landscaping. The valance of the property will be more or less as is, to temporarily
store motor vehicles for their auction business, which is over on Route Two (2).
Committeemember Broden asked what is the utilization of wrecker service.
Mr. McMorrow explained that sometimes vehicles are brought in on a tow truck or a flat bed,
and the Code requires a special exception for that kind of use in this zone, so we have sought the
approval for that as well.

Council President Tim Scott asked Mr. McMorrow to talk about the screening and landscaping a
tittle more.
Mr. McMorrow explained that the property is presently a vacant industrial property. There is a
white single -framed structure in front, which is going to be utilized from time to time by staff,
but the front green lawn area is going to be maintained, and we're creating lawn where the fence
is, closer to the property line. Right now, the fence sits right behind the right of way line, we're
going to take it and move it sixty -five (65) feet back, and create a new lawn that doesn't exist
today. It will be a lawn with nothing parked on it.
The fence with the slats are all going to be provided, so no motor vehicles or pedestrians passing
by will see what is behind it.
There were no comments from the public either for or against this during the Board of Zoning
Appeals Meeting.
Committeemember Ferlic made a motion to send Bill No. 16 -38 to the full Council with a
favorable recommendation, and it was seconded by Committeemember Broden and carried by a
voice vote of four (4) ayes.
Committee Vice Chair Voorde noted that Chairman Oliver Davis was present for the vote and
voted in the affirmative.
With no other business, Committee Vice Chair Voorde adjourned the meeting at 3:37 p.m.
