Quarter of Section 13, Towns`hi~~ 37 North, Range 2 East, City of South Bend, Portage Township; St. Joseph County, Indiana and being more particularly described as follows: Beginning at a corner of Lot 2 as the same is shown and designated on the plat of Riley High School Minor Subdivision, the same being recorded as instn.iment number 9638147 in the office of the Recorder of St. Joseph County,: Indiana and being the . intersection of the Southerly right-of way line of now. vacated Caivert.Street with the-East right-of--way line of now vacated Rush Street; thence North 89°53' 15" East, along a Southerly line of said Lot 2 and said Southerly right-of--way line, a distance of 8.89 feet to a point of curvature; thence Southeasterly along a curee to the right delineating said Southerly line of Lot 2 ,said curve having a radius of 379.26 feet, a central angle of 17°26'59" and limited in length by a chord of 115.06 feet that bears South 81°23'13" East; thence South 54°30'00" West, a distance of 26.92 feet; thence South 37°00'00" 'Jest, a distance of 50.93 feet; thence South 19°00'00" West, a distance of 36.71 feet; thence South 19°00'00" West, a distance of 36.71 feet; thence South 08°40'00" West, a distance of 41.39 feet; thence South 03°30'00" East, a distance of 33.68 feet; thence South 19°35'00" East, a distance of 80.53 feet; thence South 13°20'00" East, a distance of 11.03 feet to a point on the Easterly projection of the North right-of--way line of now vacated Bowman Street; thence South 89°52'51" West, along said Easterly projection, a distance of 90.45 feet to its intersection with the East right-of--way line of now vacated Rush Street; thence North O1°28'39" East, along said East right-of--way line and an East line of said Lot 2, a distance of 269.65 feet to the place of beginning containing 0.457 acres (19,892 square feet) more or less. Subject to the legal rights of public highways, of any, and subject also to any easements, covenants or restrictions of record. (hereinafter, the "Real Property"). Pursuant to I.C. 36-10-4-9(a), said lands are under the exclusive control of the Board of Park Commissioners of the Park District of the City (hereinafter, the "Park Board"). The Real Property is located adjacent to the site of the new Riley High School being constructed by the South Bend Community School Corporation (the "School Corporation") but is no longer needed for park purposes. At its meeting of March 17, 1997, the Park Board determined that the Real Property is not required for park purposes and authorized the sale of the Real Property upon the conditions that the Real Property be transferred to the School Corporation for the sum of One Hundred Thirty-six Thousand and 00/100 Dollars ($136,000.00) for use in its Riley High Project. Pursuant to I.C. 36-10-4-18, Common Council approval of the sale of the Real Property is required. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The disposal of the Real Property is approved, subject to the condition that the Real Property be transferred to the School Corporation for the sum of One Hundred Thirty-six Thousand and 00/100 Dollars ($136,000.00) for use in its Riley High Project. Section II. Re: Ordinance Approving of Sale of Real Estate by the Park Department to the South Bend Community School Corporation Dear Mr. Kelly: The Park Department and the School Corporation have been discussing the sale of real estate by the Park Department to the School Corporation for use by the School Corporation in its Riley High School project. The real estate in question is part of the Studebaker Golf Course and is located near the former intersection of the vacated Calvert and Rush Streets. Located on the real estate is a golf maintenance building. The purchase price for the real estate is $136,000. At least a portion (if not all) of the funds received from the sale of the real estate would be applied to the construction of a new golf course maintenance building. The Park Board will consider a resolution regarding the sale of the real estate at its meeting on March 17th. The Board of School Trustees will also consider a resolution on March 17th. The School Corporation would like to acquire the property as quickly as possible for the Riley High School Project. The ordinance is submitted with the request that it be heard on first reading on March 10th with final reading and adoption on March 24th.
