A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, LC. 6- l . l -12.1-2(1) provides that an application for property tax deduction
may not be approved when the property is located in an allocation area as defined in I.C.
36-7-14-39, unless the Redevelopment Commission which designated that allocation area adopts
a resolution approving that application; and
WHEREAS, the South Bend Common Council has received a petition for (5) five years of
real property tax abatement consideration from Ullery Development for real property located at
1810, 1818, 1826, 1834, 1844, 1852, 1860 and 1868 Overlook Court in the South Side
Development Area, the development area location and legal description of which are attached
hereto, marked Exhibit "A" and incorporated herein; and
WHEREAS, this Commission declared the South Side Development Area by Resolution
No. 1928, adopted December 20, 2002, and in the same resolution declared the South Side
Development Area Allocation Area (South Bend Allocation Area No. 1) and
WHEREAS, the property located at 1810, 1818, 1826, 1834, 1844, 1852, 1860 and 1868
Overlook Court is located within the South Side Development Area Allocation Area;
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
1) The Commission finds that the application from Ullery Development for (5) five years
of real property tax abatement consideration for property located at 1810, 1818, 1826, 1834, 1844,
1852, 1860 and 1868 Overlook Court in the South Side Development Area Allocation Area
should be and is hereby approved.
2) That a copy of this resolution be forwarded to the South Bend Common Council to
indicate the Commission's approval of the petition for real property tax abatement for Ullery
Development.
Approved this 25th day of August at the regular meeting of the South Bend Redevelopment
Commission.

A part of the Northeast Quarter of Section 30, Township 37 North, Range 3 East,
Centre Township, City of South Bend, St. Joseph County, Indiana, and being
more particularly described as follows: commencing at the southeast corner of
the Northeast Quarter of Section 30, thence North 00°04'24" West along the east
line of said Northeast Quarter, a distance of 1 312.53 feet; thence South
89°51'10" West, a distance of 646.22 feet to the point of beginning for this
description; thence South 89°51' 10" West, a distance of 509.05 feet to a corner
on a North line of Lot 68 as the same is shown and designated on the plat of
Ireland Woods Subdivision Section Two, Part One as the same is shown and
designated on the plat thereof recorded in the office of the Recorder of St. Joseph
County, Indiana, as Instrument No. 7916183; thence North 0°04'17" West, along

corner of Lot 67 in said plat of Ireland Woods; thence North 0°09'29" West,
along the East line of said Lot 67 and the East line of the plat of said Ireland
