HomeMy WebLinkAboutNo. 2365 appointing the City of South Bend Board of Public Works as an agent to construct certain improvements to Michgian Street Retail Area No. 2RESOLUTION NO. 2365 • RESOLUTION OF THE SOUTH BEND DREDEVELOPMENT COMMISSION APPOINTING THE CITY OF SOUTH BEND, INDIANA, BOARD OF PUBLIC WORKS AS AN AGENT TO CONSTRUCT CERTAIN IMPROVEMENTS TO MICHIGAN STREET RETAIL AREA NO. 2 (South Bend Central District Development Area) • WHEREAS, the South Bend Redevelopment Commission (the "Commission" is the owner of property located in the South Bend Central District Development Area in the general vicinity of 129 S. Michigan Street in the City of South Bend, Indiana (the "Property"); and WHEREAS, in order to improve the Property to a condition acceptable to lease it to a prospective tenant, the Commission intends to undertake certain improvements to the Property, including the improvements set forth at Exhibit A (the "Improvements"); and WHEREAS, the Commission desires to appoint the Board as its agent for purposes of receiving and awarding bids for Improvements and overseeing their constriction and completion; and WHEREAS, the Board is willing to accept such appointment to facilitate the reuse of the property; NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION as follows: 1. The Commission hereby appoints the Board as its agent for purposes of bidding and awarding a contract for the construction the Improvements, described at Exhibit A, in an amount not to exceed $2,400.00, which process shall occur in accordance with Indiana Code 36-1-12 and other applicable law. The Commission further appoints the Board as its agent for purposes of monitoring and overseeing the construction and completion of the Improvements. 2. Michigan St. Interior Demolition Project No. -107-064 Work shall consist of the following: The Contractor shall do all demolition and repairs to deliver the space in clean condition, with (4) walls and ready for Tenant's finish (including removal of wallpaper and other wall coverings, securely patching all holes in walls and prepping walls for Tenant's paint), the carpet removed, an HVAC, electrical and plumbing in good order, the water line and drain currently in the south wall professionally capped (and related hole in wall repaired), the current sink remaining in the back room and storage area, and the former tenant's adhesive window signs removed. The contract shall have a time limit of ten (10) calendar days. The contract time will start when the Notice to Proceed is delivered and signed. If the contractor fails to complete the work within the contract time, then the contractor will pay to the owner the amount for liquidated damages at a rate of two hundred fifty dollars ($250.00) per calendar day until the completion of the project. The contractor agrees to indemnify, defend and hold harmless the City of South Bend, its agents, officers and employees, from all costs, losses, claims and suits, including court costs, attorney fees, and other expenses, arising from or out of the negligent performance of this Contract by Contractor, or because or arising out of any defect in the goods, materials or equipment supplied by the Bidder. • The following requirements shall also be met by the contractor: 1. Insurance Requirements All Contractors and subcontractors during business with the City of South Bend shall present a Certificate of Insurance showing coverage in the following minimum amount: General Liability-Premises-Completed Operations or Products Bodily Injury and Property Damage Combined Single Limit-$5,000,000. or $700,000 per person. There shall be no exclusion for explosion, collapse or underground hazard. Workmen's Compensation: Statutory State of Indiana Employer's Liability - $100,000. Auto Liability: Bodily Injury and Property Damage Combined Single limit $1,000,000. City of South Bend shall be named as additional insured on the Certificate. •
