ORDINANCE NO. _ _U. v ~~___ !._~ AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 130 PARK LANE STREET IN T'I-IE CITY OF SOUTH BEND, INDIANA. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana; SECTiON_L. Ordinance No 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same is hereby amended, in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: ~ A tract of land 1 ] 0 feet in length, East and West, taken off of and from the entire West end of the following described tract of land: A part of Bank Out Lot Numbered One Hundred Twenty-four (124) of the Third Plat of Out Lots ofthe Town, now City of South Bend, platted by the State Bank of Indiana, which part if bounded by a line running as follows: Beginning at the point of intersection of the East line of Main Street in said city with the South line of Foote Street (now Park Lane) in said City, thence running East on the South line of Foote Street (now Park Lane) 165 feet, more or less, to the West line of a public alley; thence South on the West line of said alley 50 feet to the North line of Bartlett's Second Addition to the City of South Bend; thence West on the North line of said Addition 165 feet, more or less, to the East line of Main Street; thence North on the East line of Main Street 50 feet to the place of beginning. be and the same is Hereby established as "PHC" Professional/Health Care District. Newbold, its President and Chief Executive Officer, makes application and petitions the Common Council of the City of South Bend, Indiana to amend the zoning ordinance as herein requested. 1) The property sought to be rezoned is located at: 130 Park Lane Street South Bend, Indiana 46601 2) The name and Address of the Property owner is: Memorial Hospital of South Bend, Inc. 615 North Michigan Street South Bend, IN 46601 3) It is desired and requested that the Property be rezoned from "A" Residential District "C" Height and Area to "PHC ProfessionaUHealth Care District". 1='t1~~ 14'1 ~~~.aae~ ~iil~`.'~-'- .M..- JUP~ 2 C ~~97 i CITY CLG7~, `:O.6 ylSC,1?~, 4) The property is presently owned by Memorial Hospital of South Bend, Inc. and has atwo-story residential building on it which was previously used as a doctor's office. The property will be used as an office for The Junior League of South Bend Incorporated, a philanthropic institution. 5) A petition requesting zoning variances to bring the subject property within the requirements of the ordinance pertaining to this District for setbacks and screening is presently pending and will be heard by the South Bend City Board of Zoning Appeals prior to the hearing scheduled on this Petition before Area Plan Commission. 6) Attached is a copy of (a) legal description of the property on Exhibit "A"; (b) a list of names and addresses of all property owners within 300 feet of the petitioned Property (c) six (6) site plans; and addressed, stamped envelopes for all property owners within 300 feet of the subject property. 7) By signing this Petition, I and any contingent purchaser understand that if the Council approves this petition to rezone, it maybe approved subject to the submittal of a final site plan. A final site plan must be submitted to and approved by the Area Plan Commission within one (1) year of the Council's action. In addition, a building permit must be issued for the use indicated on the petition within one year following the approval of the final site plan. Failure to submit a final site plan or obtain a building permit within the specified time period, causes the zoning of the petitioned property to revert to the initial oning classification. The Area Plan Commission at its public hearing on August 19, 1997, took the following action: Upon a motion by Joseph Serge, being seconded by Randall Matthys and unanimously carried, the proposed ordinance and site development plan of Memorial Hospital of South Bend, Inc. to zone from "A" Residential "C" Height and Area to "PHC" Professional/Health Care, property located at 130 Park Lane City of South Bend is sent to the Common Council with a favorable recommendation, subject to a final site plan. While the petition area is bordered by "A" Residential zoning, there is commercial zoning and parking lots a short distance to the east and south. In addition, the existing structure had previously been used as an office. It is the Commission's opinion that "PHC" zoning, for this property, is not out of character for the area. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Inc. 1782-97 Location: 130 Park Lane City of South Bend REQUESTED ACTION: The petitioner is requesting a zone change from "A" Residential "C" Height and Area to "PHC" Professional/Health Care to allow an office. EXISTING LAND USE: The property contains a vacant office. SURROUNDING LAND USE AND ZONING: Located to the north is Leeper Park zoned "A" Residential, "A" Height and Area; to the east is vacant land zoned "A" Residential, "A" Height and Area and parking lots zoned "C" Commercial, "F" Height and Area; to the south is a multi-family home zoned "A" Residential,. "C" Height and Area and parking lots zoned "C" Commercial, "F" Height and Area; and to the west is Madison School zoned "A" Residential, °A" Height and Area. ACCESS: Access to the site is from Park Lane. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA:. The total site to be rezoned is 5,459 square feet. Of that, the buildings will occupy 1,529 square feet, or 28 percent of the site; the parking and drives will occupy 600 square feet, or it percent of the site; and 3,330 square feet or 61 percent of the site will remain as open space. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no wetlands are present. This site is near the • Leeper Park public well. FEMA maps show this site as a flood hazard area. The site is located near the St. Joseph River. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the Staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to a final site plan.
