The Common Council recognizes that Indiana Code § 36-8-3-3(d) provides that the "annual compensation of all members of the police department and other appointees shall be fixed by ordinance of the legislative body before August 1st of each year for the ensuring budget year". The City Administration, Common Council and Board of Public Safety appointed a six-member City Negotiating Team and authorized it to negotiate on their behalf all pay, monetary fringe benefits and working conditions for members of the South Bend Police Department. The City Negotiating Team and the F.O.P.Wage Committee of the Fraternal Order of Police, Lodge No. 36 held numerous negotiating sessions for the past several weeks and reached a tentative agreement on wages, fringe benefits and working conditions. On July 28, 1997, the ratification vote of the Fraternal Order of Police, Lodge No. 36 was announced. The rank and file of the South Bend Police Department voted 166 in favor and 83 against the entire wage, benefit and working condition package. The following ordinance incorporates the recommended annual pay and monetary fringe benefits for sworn members of the South Bend Police Department for calendar years 1998, 1999, 2000 and 2001. The City Negotiating Team recommends passage of this Ordinance, and believes that it is in the best interest of the City, the South Bend Police Department, and citizens of South Bend, Indiana. ]P101U, ~j~i`~tOrt, b~ it Or~'~itt~~' by the Common Council of the City of South Bend, Indiana, as follows: Bill No. 64-9'7 Page 2 A. The South Bend Common Council recognizes the F.O.P. Bargaining Committee of the Fraternal Order of Police, Lodge No. 36, as the sole bargaining unit for the negotiation of annual pay and monetary fringe benefits for sworn members of the South Bend Police Department, excluding the Police Chief, Division Chiefs and Captains. B. The Police Chief, Division Chiefs and Captains of the South Bend Police Department are designated in this ordinance as "Officers". Additional Areas of Compensation. $37,500 $36,100 $31,275 A. Maximum Amounts: All monetary areas addressed in this ordinance shall be the maximum amounts permitted in each calendar year. B. S'ourt Time Pay: If an officers or sworn member of the South Bend Police Department is subpoenaed to court or is ordered to appear at any given location to validate a complaint or warrant, and if that officer or sworn member is off-duty, that officer or sworn member shall be paid overtime. Such court time pay shall be paid at the overtime rate of pay. Such officers and sworn members shall receive a minimum of four (4) hours Bill No. 64-97 Page 3 of pay for appearing on their scheduled day off; and a minimum of two (2) hours of pay for appearing when off duty on a regular scheduled work day. C. Overtime Pav: If a sworn member is required to remain on duty in excess of the regularly scheduled work day, he or she shall be entitled to overtime pay. Such sworn member shall be paid at the rate of one and one-half (1 1/2) times his or her regular rate of pay. Overtime shall be calculated by quarter- hour increments. D. Critical Dutv D~,y Stipend: A critical duty day pay stipend is established in the amount of one hundred fifty dollars ($ 150.00). There shall be six (6) critical duty days established by the Board of Public Safety by resolution for each calendar year. E. Annual Cash Allowance: Officers and sworn members shall receive the following annual cash allowance. One-fourth (1/4) of the annual sums listed shall be paid each calendar quarter. Said total annual amounts shall be as follows unless reduced as set forth in the Section 19 of the 1998-2001 Working Agreement to be approved by the Board of Public Safety: 1998 1999 2000 2001 $ 2,200 $ 2,200 $ 2,200 $ 2,200 Said annual cash allowance shall be prorated in the first year of employment from the sworn member's hiring date until the end of the calendar year. Said allowance shall be prorated in any year a sworn member or officer retires, resigns, otherwise leaves employment. I. Longevi , Pav: Officers and sworn members holding the rank of corporal and above, shall receive additional compensation in recognition of cumulative service on the South Bend Police Department. Such longevity shall be paid in 1998, 1999, 2000 and 2001, and shall not be attributed to the annual salary base for pension purposes. Tuition Reimbursement: Qualifying officers and sworn members of the South Bend Police Department participating in the tuition reimbursement program shall be entitled to the following maximum dollar amounts for any academic year for course tuition only: ('nurse Grade Maximum Amount Reimbursed b itv: A 50 % of tuition costs only up to maximum of $1,000 B 35 % of tuition costs only up to maximum of $ 750 C 25 % of tuition costs only up to maximum of $ 500 All governing regulations must be complied with in order to qualify for said tuition reimbursement. K. QReration Safe Neighborhood Reimbursement: Qualifying officers and sworn members of the South Bend Police Department who establish legal residence within designated areas of the City of South Bend limits and reside on a continuous permanent basis within such designated areas with the city for the period of time he or she is seeking reimbursement shall be entitled to $ 1,500.00 of his or her annual mortgage or rental amount. Qualifying officers and sworn members shall be entitled tobe reimbursed by the City on a quarterly basis. All governing regulations must be complied with in order to qualify for said reimbursement. L. Life Insurance: Effective January 1, 2000, the City of South Bend shall increase the term life insurance coverage on all sworn members and officers from $ 15,000 to $ 20,000. M. Health Insurance: The City shall maintain a comprehensive major medical insurance program which includes a $ 750.00 annual deductible and which shall be subject to a 70/30 co-insurance payment up to a limit of $ 1,5000.00 per year. The Preferred Provider Organization (PPO) shall be subject to a 90/10 co-insurance payment per year up to a limit of $ 1,500.00 per year. The contribution by sworn members and officers of the Bill No. 64-9'1 Page 6 South Bend Police Department who desire single health insurance coverage for the self- funded insurance program of the City of South Bend shall be twenty dollars ($ 20.00) per month in plan years 1998, 1999, 2000 and 2001. The contribution by sworn members and officers of the South Bend Police Department who desire dependent health insurance coverage for the self-funded insurance program of the City of South Bend shall be fifty dollars ($ 50.00) per month in plan years 1998, 1999, 2000 and 2001. The City shall continue to contribute five hundred dollars ($ 500.00) to each qualifying sworn member's and officer's individual flexible spending account, each plan year. N. Wellness and Fitness Prog~m: In the event the City of South Bend establishes a Wellness and Fitness Program by September 15, 2000, a qualifying sworn member or officer electing to participate and successfully participating shall be entitled to a reduction of ten percent (10 %) of his or her monthly premium if participating in the City's comprehensive major medical insurance program. A sworn member or officer who is not participating in the City's comprehensive major medical insurance program who successfully participates in said Wellness and Fitness shall be added to the payment for election to leave the City's Insurance Program of fifty dollars ($ 50.00) per month. All sworn members and officers hired after September 15, 2000, shall be required to participate in the City's Wellness and Fitness Program, if established, as a condition of employment. O. Personal Davs. Each sworn member and officer with more than one (1) full year of service shall receive on January 1st of each year, seven ('~ days of personal time for use in that year. No sworn member shall receive personal time during his or her first full year of service. Upon the first anniversary date of swearing in, each sworn member shall receive personal time to use in the remainder of that calendar year in an amount equal to one (1) day for every fifty (50) calendar days remaining in the year plus one (1) additional day for any fraction remaining, not to exceed a maximum of seven ('n days. Personal days are designed to be used on a "use it or lose it basis" subject to further conditions which maybe established by the Board of Public Safety. Each sworn member shall have the opportunity to earn three (3) additional days of personal time through shooting subject to conditions as may be established by the Board of Public Safety. Bill No. 64-97 Page 7 P. Accumulated Time Buy-Back. The Police Department Accumulated Time Account shall be continued and shall be subject to conditions established by the Board of Public Safety. Q. Flexible Time Account. The Flexible Time Account shall be continued and shall be subject to conditions established by the Board of Public Safety. The maximum number of hours permitted in any officer's or sworn member's line item within the Flexible Time Account shall be eighty (80) hours. R. Retirement Sick Leave Buy Back. The Retirement Sick Leave Buy-Back program shall continue with the number of sick days which have been accumulated in a sworn member's or officer's sick bank being increased from forty-five (45) days to sixty (60) days with the rate of reimbursement being one-half (1/2) the hourly rate of the base pay for the rank of corporal. S. Sick Leave Cost Reduction Prog~. The Sick Leave Cost Reduction Program shall continue in effect whereby a police officer may be compensated for relinquishment of earned sick time through and including December 1, 2001, with the Board of Public Safety establishing specific criteria and conditions in the Working Agreement. Section III. Bodv Armor Vest Quartermaster Svstem. A body armor vest quartermaster system shall be established January 1, 1998, for all members of the Uniform Division. All Uniform Division police officers shall be provided with acity-purchased body armor vest which shall be replaced pursuant to a quartermaster system. Twelve (12) new body armor vests shall be purchased by the City each year and made available to non-Uniform Division police on an on-needed basis, first come first serve. The Common Council recommends that the Working Agreement as tentatively agreed to by the respective Wage Teams be approved by the Board of Public Safety. Bill No. 64-9~ Page 8 A. The first service year for a member of the South Bend Police Department commences upon the individual being sworn in before the Board of Public Safety as a member of the department. The second service year shall begin on the next succeeding first day of January 1st and service years shall continue to increase until the member attains the maximum salary for the particular rank he or she may hold. B. Advancement from the rank of Patrolman First Class to Corporal is dependent upon three (3) complete calendar years of service plus a determination of satisfactory performance of duty and promotion by the Board of Public Safety. Roland Kelly Third District This package was overwhelming approved by a vote of 166 in favor and 83 against by the membership of the Fraternal Order of Police, South Bend John Broden Lodge No. 36. It is the first four-year wage and benefit package to Fourth District be ratified by our police officers in the history of our police department. David Varner Fifth District Some of the new concepts which are recommended include: Andrew Ujdak * A NEW "5th Shift" which will work from 7 p.m. to 3 a.m. to sixth District provide better officer coverage of the City and will enhance Individual officer safety. This shift will be added to the afternoon, midnight and detective bureau (nights) as the type of detail receiving shift premiums. Sean Coleman At Large * NEW Seniority-Shift Incentive Premium Pays for afternoon, John Hosinski midnights, and the 5th shifts which will pay additional dollars to police officers At Large who have eight (8) years of seniority or more or are above the rank of corporal. It is the City s belief that this type of Incentive may foster a better mix of sensor Rod Sniadecki officers with the younger men and women working those shifts. At Large * NEW Critical Duty Day Stipends are recommended for six (6) Kathleen Cekanski-Farrand days selected in each calendar year where due to the type of activities scheduled council Attorney in the City require the Uniform Division to be working. There will no longer be holiday nay for every member of the department. Police officers who are scheduled to work a designated critical duty day and be available in uniform will receive a stipend of $150.00. * ANEW Wellness and Fitness Program is recommended to be established by September 15, 2000. Qualifying police officers would be entitled to a ten percent (10%) reduction of his or her monthly insurance premium for meeting overall health and life fitness standards with such South Bend Common Council July 28, 1997 Page 2 standards becoming a condition of employment for all police officers hired after September 15, 2000. * A NEW Zero-Tolerance Drug Policy will be effective January 1,1998. This is the first City Department to commit to such strict restrictions. * A NEW Body Armor Quartermaster System whereby the City will purchase new body armor vests for each member of the Uniform Division and will also purchase twelve (12) body armor vest each year and make them available on a first come first serve basis to non-Uniform Division police on a needed basis. This ordinance would also establish competitive base salaries for all ranks in the South Bend Police Department. The attached chart shows the base The ordinance would maintain special duty pays for special hazazdous duties performed by the SOS Undercover, SOS, K-9 Units, SWAT, Bomb Technicians and the hostage negotiators. The annual cash allowance is recommended to be set at $ 2,200 each year of the package. This allowance incorporates the former gun/radio allowance which is currently paid separately. Compliance with uniform upkeep and maintenance standards is required of all police officers receiving such allowance with deductions possible for non-compliance. Longevity pay has been maintained at its current levels, as have court time pay and overtime pay. The "Tuition Reimbursement" program has been revamped to provide a greater amount of reimbursement based on the higher the course grade earned. "Operation Safe Neighborhood" will be continued at its current reimbursement rate of $ 1,500 to officers who live in designated areas of the City. Life insurance will increase from $ 15,000 to $ 20,000 in the year 2000. Health premiums for single and dependent coverage will remain capped at current premium rates.
