HomeMy WebLinkAboutApproving parking rates for parking garages operated by the Board of Public WorksORDINANCE No. 8805-97 Passed by the Common Council of the City of South Bend, Indiana June 23. 19 97 Attest: Attest: City Clerk President of Common Council Presented by me to the Mayor of the City of South Bend, Indiana June 24, 19 97 City Clerk Approved and signed by me June 24, 19 97 Mayor ;r~ ~ ~, ~ o SUBSTITUTE BILL ORDINANCE NO. ~ ~QJ" AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING PARKING RATES FOR PARKING GARAGES OPERATED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT I.C. 36-9-11-7 authorizes the Boazd of Public Works to fix the rates and charges to be collected for pazking vehicles in pazking facilities owned and operated by the City and for other use of those parking facilities so as to promote the maximum use of the facilities by the public in a safe, orderly, and efficient manner. Such rates fixed by the Boazd of Public Works are subject to the approval of the Common Council. The Council has received Resolution No. 42-1997 of the Boazd of Public Works, a copy of which is attached hereto and made a part hereof, which establishes rates for city-owned parking facilities, both pazking garages and pazking lots. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION I. The following monthly rates shall be charged to vehicles pazked at City operated pazking garages: (a) Per vehicle, on a month-to-month basis (b) Per vehicle, on a three-yeaz contract (c) Per vehicle, on a five-year contract (d) Group rates on a monthly contract (e) Group rates on a monthly contract for rooftop pazking $35.00 per mo. $35.00 per mo. $35.00 per mo. $35.00 per mo. $22.00 per mo. (f) For purposes of Subsection (e), a group shall be defined as ten (10) or more spaces leased pursuant to a single account. (g) Priority for committing pazking spaces within a Ciry operated pazking gazage shall be given to vehicles with the longest term parking contract and the highest monthly rental rate. Commitment of spaces within a pazking gazage within a particular rate structure shall be determined base upon (1) the number of pazking spaces committed per single billing; (2) the length of time the person has committed spaces within that garage; and (3) the payment experience of the account. Persons entering into long term agreements for parking may be granted an option to renew within the discretion of the Boazd of Public Works or its designee. (h) The owner of any vehicle admitted to the garage pursuant to a rooftop group rate contract shall be fined $10.00 in the event the vehicle is pazked in violation of the contract. SECTION II. The following hourly rates shall be chazged for individual vehicles parked at City operated pazking garages from and after the passage and publication of this ordinance until the end of the Leighton Plaza Project construction, at which time rates will be reviewed: Hours 0 to 2 hours Free 2 to 3 hours $1.00 3 to 5 hours $2.00 5 to 24 hours $3.00 Special Events $2.00 SECTION III. This Ordinance rescinds and supersedes all prior ordinances setting rates for municipal pazking facilities. SECTION IV. Nothing herein shall affect rights and liabilities accrued prior to the effective date of this ordinance. SECTION V. If any portion of this Ordinance shall be declazed illegal or unconstitutional, that determination shall not affect the balance thereof. SECTION VI. Due to the high visibility of the Leighton Plaza project, City staff felt it was necessary to inform downtown businesses and the general public of the changes the project will cause, and to provide replacement parking for -the lost spaces on Michigan Street due to increased construction disturbance. The project will not only remove the parking in the current "Shopper's Lot," but will also remove on-street parking along the west side of Michigan Street between Washington and Jefferson. The temporary loss of this section of Michigan Street plus on-going work on the Roberston's Building and future work on the State Theater and CCA Building are addressed by the ordinance through the offer of up to 2 hours free parking in city garages during the construction of the project. After meetings with the City Controller and AMPCO Parking, it was determined that short-term parkers make up a very small percentage of city garage revenues. The idea behind this Ordinance is that by offering and promoting free short-termparking in the garages, people will start to use the garages more for this purpose.
