ACCEPTING THE TRANSFER OF PROPERTY FROM
THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS
WHEREAS, pursuant to Indiana Code §36-9-6-3, the City of South Bend ("City") is the owner of
property located within the City of South Bend, St. Joseph County, Indiana, which property is more particularly
described at Exhibit "A" attached hereto and incorporated herein ("Property"); and
WHEREAS, in accordance with Indiana Code 36-7-14, et seq., the South Bend Redevelopment
Commission ("Commission") is the governing body of the City's Department of Redevelopment and is
empowered to acquire and dispose of interests in property; and
WHEREAS, the Board desires to transfer the Property to the Commission for use in a redevelopment
project located within the City and the Commission desires to accept transfer of the Property from the Board; and
WHEREAS, pursuant to Indiana Code §36-1-11-8, the City, acting by and through the Board, may
transfer the property to the Commission through the adoption of substantially identical resolutions by each entity.
THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment Commission as follows:
Section 1. The transfer of Property more particularly described at Exhibit "A" by the Board to the
Commission is hereby accepted and approved.
• Section 2. The Director of Redevelopment of the City of South Bend is hereby authorized to cause
the recording of the quit claim deed conveying all right, title and interest in the Property from the City to
the City of South Bend, for the use and benefit of its Department of Redevelopment.
Section 3. This Resolution shall be in full force and effect upon its adoption by the South Bend
Redevelopment Commission.
