ORDINANCE NO. ~ i ~ ~_, AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 17, ARTICLE 1, SECTION 17-4 OF THE SOUTH BEND MUNICIPAL CODE CONCERNING INFLOW TO THE CITY'S SANITARY SEWER SYSTEM STATEMENT OF PURPOSE AND INTENT The City of South Bend's National Pollution Discharge Elimination System (NPDES) permit requires South Bend to restrict flow of clear liquids into its sanitary sewer system. To clarify and emphasize the restriction of flow into the City sanitary sewer system, it is necessary to amend Chapter 17, Article 1, Section 17-4 of the South Bend Municipal Code. --~- NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA that Chapter 17, Article 1, Section 17-4 shall be amended to read in its entirety as follows: SECTION I. Chapter 17, Articlel, Section 17-4 of the South Bend Municipal Code shall be amended to read in its entirety as follows: Sec. 17-4. Downspouts and drains to be connected with storm sewers; exception. (a) After the effective date of this article, no newly constructed gutter, dovrnspout, roof drain, foundation drain or off-street-parking-area drain, or other source of inflow shall be connected with or permitted to drain into the sanitary sewer system of the City. After such date, whenever it becomes necessary to rebuild, repair or replace any such drain existing prior to the enactment of this section, the same shall be rebuilt, repaired or replaced in such a manner that it will no longer be connected with or flow into the sanitary sewer system of the City. (b) Whenever it is reasonably feasible to do so, all such gutters, downspouts, roof drains, foundation drains and off-street-parking-area drains shall be connected to or designed to flow into the storm sewer system of the City, and within the boundary limits of the downtown urban renewal area shall be so connected, whether newly constructed or previously existing, as soon as the storm sewer system in the area is completed. (c) The provisions of this section shall not apply where a different method of disposing of rainwater is ordered by the City Engineer or the Building Commissioner. (d) Construction of new combined sewers outside of the existing combined sewer area is prohibited. New construction tributary to the combined sewer shall be designed to minimize or delay the admission of unpolluted water into the existing combined sewer. SECTION II. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. ember of the Common Council A s.
