U U 17' l U AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ESTABLISHING A NEW SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE CITY OF SOUTH BEND WATER WORKS AND THE AMENDING OF CHAPTER 17, ARTICLE 4, SECTIONS 17-45 and 17-46 OF THE SOUTH BEND MUNICIPAL CODE. STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana last established a schedule of rates and charges for services rendered by the Water Works by Ordinance No. 8357-93 which was passed on February 22,1993. Municipal Consultants, a financial consultant to the Board of Water Works commissioners, has carefully reviewed the Cit~s rates and charges and has determined that an increase in such rates and charges is necessary to continue to provide quality services. The Common Council has determined that in order to meet the statutory requirements as provided in Section 8-1.5-3-8, it is necessary that the rates and charges be increased for services rendered by the Water Works of the City of South Bend. On June 23,1997, the Common Council enacted Ordinance No. 8798-97 authorizing an increase in the rates and charges assessed for services provided by the South Bend Water Works. The effectuation of Ordinance No. 8798-97, however, was contingent upon those particular rate an charge adjustments being approved by the Indiana Utility Regulatory Commission (Commission) of the State of Indiana. On January 21,1998, the Commission issued its final Order in the South Bend Rate and Financing Proceeding; Cause No. 40885. The Commission approved an increase in the rates and charges assessed by the South Bend Water Works, but the increase in the rates and charges approved in the Commission s Order differed slightly from the increase approved by the Common Council in Ordinance No. 8798-97 and, as a result, Ordinance No. 8798-97 is ineffective as an act of the Common Council. I.C. 8-1.5- 3-8 requires that rates and charges be approved by both the Commission and the Common Council by ordinance. The purpose of this Ordinance is, therefore, to establish a schedule of rates and charges that is identical to the schedule of rates and charges approved by the Commission in its Order of January 21,1998. ~. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. Chapter 17, Article 4, Section 17-45 and Section 17-45.1 of the South Bend Municipal Code shall be, and hereby are, amended to read as follows: Sec. 17-45 Water Works Rates and Char eg_s. There shall be and are hereby established for the use of and the services rendered by the Water Works System of the City of South Bend, the following rates and charges, based upon the use of water and facilities furnished by said Water Works System: Rates (a) Usage per Monthly Billing Period Rate Per 100 Cubic Feet First 500 cubic feet $1.193 Next 1,500 cubic feet 1.036 Next 5,500 cubic feet 0.911 Next 22,500 cubic feet 0.802 Next 90,000 cubic feet 0.629 Over 120,000 cubic feet 0.488 (b) Minimum Charge Meter Size Monthly Minimum 5/8 inch meter $5.39 3/4 inch meter 7.78 1 inch meter 13.84 1 1/2 inch meter 31.10 2 inch meter 55.31 3 inch meter 124.44 4 inch meter 221.23 6 inch meter 497.77 8 inch meter 884.93 10 inch meter 1,382.71 12 inch meter 1,991.09 (c) Metered water charges shall be the larger of the minimum charges of subparagraph (b) and the rate charges of subparagraph (a) of this Section. In the case of multiple meters under a single billing entity, the charges shall be computed for each meter separately not the summation of usage. In such cases as the Utility may deem it impractical to install a meter for temporary service, there shall be a minimum monthly charge of twenty dollars ($20.00). If the water consumption computed at approved rates is known to be in excess of the twenty dollars ($20.00) minimum charge, an authorized agent of the Utility shall have the right to estimate said water usage and the estimated usage shall be billed at the approved meter rates. Section II Chapter 17, Article 4, Section 17-46.3 of the South Bend Municipal Code shall be, and hereby is, amended to read as follows: Sec. 17-46.3 Bulk Sales Charges. Sales tanker trucks or other bulk users shall be metered or estimated where metering is not feasible and the rates and charges of Section 17-45 shall apply except there shall be a minimum charge of twenty dollars ($20.00) per month. Section III. Section II. Sales for Resale Customers such as suburban utilities, reselling water to their customers, shall incur a surcharge of forty-four percent (44%) added to the rates and charges. Section III. Suburban Rates Customers with water service outside the City limits shall incur an added surcharge of twenty percent (20%) of the rates and charges. Section V. Non-Recurring Charges A. Tap Charges: The charge for installation of a 1-inch tap shall be $185.00, which shall include the installed tapping valve and the material for the curb valve and box, but shall not include any service line. Chazges for taps lazger than 1-inch shall be at cost. B.
