RESOLUTION NO. 2590
RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING AND AUTHORIZING THE EXECUTION OF
AN ADDENDUM TO THE MASTER AGENCY AGREEMENT
(Mayflower Road Trwik Sanitary Se~~~er Project -Design Phase)
WHEREAS, effective .ianuary 1, 2009, the South Bend Department of
Redevelopment, acting by and through its Redevelopment Commission (the
"Commission") and the South Bend Board of Public Works (the "BPW") entered into a
Master Agency Agreement which authorized the BPW to act as agent for and on behalf
of the Commission for certain projects during 2009; and
WHEREAS, pursuant to the Master Agency Agreement, the Commission desires
to add the Mayflower Road Trunk Sanitary Sewer Project -Design Phase to the Master
Agency Agreement by way of this Addendum.
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
Section 1. The Commission hereby approves the Addendum to Master
Agency Agreement (Mayflower Road Trunk Sanitary Sewer Project -Design Phase) and
hereby authorizes its execution in substantially the form attached hereto with such
changes as the Commission may deem necessary or appropriate upon the advice of
counsel, said execution thereof to be conclusive evidence of the Commission's approval
of such changes. The Clerk is hereby directed to file a copy of the Addendum with the
BPW.
Section 2. This Resolution shall be in full force and effect after its adoption
by the CO]I11111SS1o11.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on
July 10, ?009, at 10:00 a.m., in Room 1308, County-City Building, South Bend, Indiana
46601.

ADDENDUM TO
MASTER AGENCY AGREEMENT
(Mavflo~~~er Road Trunk Sanitary Sewer P--oject -Design Phase)
This Addendum to Master Agency A~~reement (this "Addendum'"). made and
entered into as of the 13th day of July, ?009, by and between the South Bend Department
of Redevelopment, acting by and through its Redevelopment Commission (the
"Commission") and the City of South Bend. Indiana. a nnmicipal corporation duly
organized and existing pursuant to the laws of the State of Indiana, acting by and through
its Board of Public Works (the "BPW'") for purposes of the Commission designating the
BPW to act as the Commissions agent to undertake the Mayflower Road Trunk Sanitary
Sewer Project -Design Phase (the "Project')
WHEREAS, effective January 1, ?009, the Commission and the BPW entered
into a Master Agency Agreement which authorized the BPW to act as agent for and on
behalf of the Commission for certain projects during 2009; and
WHEREAS, pursuant to the Master Agency Ag~--eement, the Commission desires
to add the Mayflo~~~er Road Trunk Sanitary Sewer Project -Design Phase to the Master
Agency Agreement by way of this Addendum.
NOW, THEREFORE, in consideration of the mutual covenants and promises
contained herein, and for other good and valuable consideration, the receipt of which is
hereby ackno~~-]edged, the BPW and the Commission ab-ee as follows:
1. The Commission hereby empowers and appoints the BPW, pursuant to the
Master Agency Agreement, to act as the Commission's agent for the limited purpose of
contracting for and managing the completion of the Project, the scope of said Project
being more specificall}~ described in "E~hibit A". attached hereto and made a part hereof.
2. All of the terms and conditions of the Master Agency Agn•eement shall
control this appoinhnent and this Addendum shall be attached to the Master Agency
Agreement.
IN WITNESS WHEREOF, the undersigned execute this Addendum to Master
Agency Agreement to be effective as of the date first written above.

Mayflower Road Trunk Sanitary Sewer Project -Design Phase
Project: Mayflower Road Trunk Sanitary Sewer Project -Design Phase
Description: The overall project will consist of the extension of sanitary sewer service
from the Nimitz Parkway lift station through the Blackthorn Development to the Indiana
Toll Road, crossing the Indiana Toll Road to Mayflower Road, and in the Mayflower
Road right-of--way to the Portage Prairie Development, just south of Adams Road. The
project will likely involve approximately 11,500 linear feet of new sanitary sewer system,
which will include two (2) lift stations, forcemain, gravity main and sewer leads. The
project will be designed in accordance with the "Mayflower Road Trunk Sanitary Sewer
Study' prepared by Abonmarche Consultants of Indiana. LLC. dated March. ?009. The
Design Phase shall consist of the following Tasks:
Task #l : Field Survey
Task #2: Design Development
Task #3: Geotechnical Investigation
Task #4: Final Design
Task #5: Right-ol=Way Engineering
Task #6: Bid Period Services
Task #7: Construction Period Services
Budget: The Design Phase budget shall not exceed Three Hundred Thousand Dollars
($300,000.00). Money for the Design Phase comes fi-om the Airport Economic
Development Area TIF.
