U ~ ` ~' / a A ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 5, OF THE SOUTH BEND MUNICIPAL CODE BY THE INCLUSION OF NEW SECTION 2-59 ~ THE SOUTH BEND COMMISSION ONAFRICAN-AMERICAN MALES. STATEMENT OF PURPOSE AND INTENT The Indiana State Legislature enacted Public Law 143-1993 which established the Commission on the Social Status of Black Males. This 25-member Commission systematically studies the conditions and reasons underlying the problems of black males and proposes measures to alleviate and correct the underlying causes of such conditions. Governor Frank O'Bannon noted in presenting the annual report of the Indiana Commission on the Social Status of Black Males that since the Commission's inception, that it has encouraged "Hoosiers of all colors to work together to fmd new ways to enhance and develop the economic, professional, educational and social status of African-American Hoosier males". Darren L. Washington, Executive Director of the Indiana Commission on the Social Status of Black Males, noted that the Commission works "diligently to create public and legislative remedies in the areas of employment, education, health, and criminal justice to reduce the problems that Black males face". The cities of Indianapolis, Evansville, Fort Wayne, Muncie, Gary and Lake County have each established a local Commission. It has been determined that "local commissions are the key units in Indiana's network to bring together those who are at the forefront of the battle to reduce the factors that contribute to the social decay of the Black male". Local cammissions are instrumental in encouraging the development of programs at the local level that focus on long-range remediation of problems facing Black males. Criminal justice figures for the City of South Bend reveal that 92% of the shooting victims in 1996 were Black males. Statistics also revealed that homicide is the leading cause of death of Black males between the ages of 15 to 24. In February of 1995, the African-American Male National Council was established to focus on social, political, educational, economic, criminal justice, and public health issue which adversely affect African-American males. Lieutenant Governor Joseph E. Kernan has stated that "in order to work toward a solution, we must analyze where we came from, where we are, and where we need to go as a community". With that mission in mind, the City of South Bend believes that the creation of a local commission, which would actively and creatively partner with the state and federal Commissions, would be in our City's best interest. 1Piobo, t~~r~for~, b~ it or~a~itt~~ b~ ~~ ~tommott ~outt~fl of ~~ ~Lit~ of ~O1ttYj ~8ttb, ~itsi'i~it~, as follows: SECTION I. Chapter 2, Article 5, of the South Bend Municipal Code is amended by the inclusion of new section 2-59 entitled The South Bend Commission on African-American Males which shall read in its entirety as follows: Sec. 2-59 The South Bend Commission on African-American Males. A. LEGISLATIVE FINDINGS: a. The Common Council of the City of South Bend, Indiana, acknowledges that if a segment of our residents and community are not doing well, that this affects the overall well-being of our entire community. b Statistical studies detailing the status of African-American Males reveal startling and disturbing conditions and trends which are impeding progress toward full participation in the mainstream of our society. c. Poverty, violence, drug abuse, debilitating health problems, and the undereducation, underemployment and unemployment of Black males promote self-destructive behaviors and create a myriad of community problems. } •• Ordinance on the South Bend Commission on African-American Males Page 2 d. There is a need in the City of South Bend to create practical proposals and workable remedies in the areas of employment, education, health and criminal justice to reduce the problems which Black males face. B. ESBLISHMENT AND MEMBERSHIP OF THE SOUTH BEND COMMISSION ON AFRICAN-AMERICAN MALES. a. The South Bend Commission on African-American Males is established. b. The South Bend Commission on African-American Males shall consist of twenty-five (25) members. Each member shall be selected by the group or organization whom he or she represents unless otherwise specified. The appointments shall be appointed as follows: 1.One (1) member of the South Bend Common Council, 2. One (1) member of the City Administration, 3. One (1) member of the St. Joseph County Council, 4. The Superintendent of South Bend Community Schools or a designee, 5. The Circuit Judge of St. Joseph County with the Magistrate being his official designee, 6. A Superior Court Judge of St. Joseph County, 7. The Probate Judge of St. Joseph County with the Magistrate being his official designee, 8. One (1) Dean, Professor, Assistant or Associate Professor from a public college or university located in St. Joseph County, 9. One (1) Dean, Professor, Assistant or Associate Professor from a private college or university located in St. Joseph County, 10. One (1) representative from a publicly owned and operated hospital, 11. One (1) representative from a privately owned and operated hospital, 12. One (1) representative from the labor organizations, union, or trades, 13. Two (2) neighborhood association representative or grass roots representative who shall be chosen by the South Bend Commission on African-American Males, 14. Siz (6) persons appointed by the South Bend Common Council ,and 15. Five (5) persons appointed by the Mayor. Appointments made for sub-paragraphs 13, 14 and 15 must be bona fide residents of the City of South Bend, Indiana. The appointments referred to in sub-paragraphs 14 and 15 will have each appointing authority include one (1) such appointment to be a youth between the ages of 15 and 24; and these appointing authorities shall confer so that each of the following organizations or their successor organizations aze represented: Family and Children's Services, Inc, NAACP, Urban League, and Workforce Development Services. Each appointing authority shall make two (2) of the four (4) appointments from the organizations referred to herein. C. GOVERNING REGULATIONS OF THE COMMISSION. a. All individuals appointed shall have an active interest in addressing the overall purposes and goals of the Commission. b. All members shall serve without compensation. c. All members shall serve for a term of two (2) yeazs. d. A member of the Commission may be removed by the member's appointing authority for absenteeism or for cause during his or her term. • Y Ordinance on the South Bend Commission on African-American Males Page 3 e. The appointing authority shall fill a vacancy on the Commission by appointing a new member for the unexpired term. f. At the first meeting in January of each yeaz, the members of the Commission shall elect one (1) member to be the Commission's Chairperson, one (1) member to be the Commission's Vice-Chairperson, and one (1) member to be the Recording Secretary. g. The Commission shall meet on a minimum of a quarterly basis and is subject to notice of such meetings pursuant to the Open Door Law of the State of Indiana. h. Minutes of all meetings shall be sent to the City Clerk and the Mayor's Office of the City of South Bend within thirty (30) days following said meeting. i. Thirteen (13) members of the Commission shall constitute a quorum. D. DUTIES AND RESPONSIBILITIES OF THE COMMISSION. a. The South Bend Commission on African-American Males shall: 1. Develop annual and long-range goals. 2. Develop action committees addressing: Neighborhoods Criminal Justice Education Employment Health Social Factors Awareness and Conference Planning which may use resource individuals who aze not members of the Commission. 3. Develop and coordinate information and programs of public institutions, the private sector, associations and individuals which address poverty, violence, drug abuse, racism, debilitating health problems, under-educated, the unemployment and the undereducation, underemployment and unemployment of Black males promote self-destructive behaviors which exasperate a myriad of community problems. 4. Serve as a catalyst and broker to facilitate a common foundation upon which viable courses of action can be initiated, monitored, evaluated, and fine-tuned in order to promote positive public and private remedies to the multifaceted problems confronting Black males in our community and the resulting effects on the entire community. 5. Network with the African-American Male National Council, the Indiana Commission on the Social Status of Black Males and all local commissions operating throughout the state by sharing ideas, information, statistical data, and action plans. 6. Issue an annual written report summarizing the results of each of the above- described duties and responsibilities, and provide recommendations for improvement. The Commission shall submit such report to the South Bend Common Council at its first regular meeting in Mazch of each year under Special Business. The City of South Bend shall, at its expense, provide copies of such reports to each Commission member, all appointing authorities, and make copies of the same available to members of the public through the City Clerk's Office. SECTION II.
