U U ~l' ~~ AN ORDINANCE OF THE COMMON COUNCII, OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 7, SECTION 21-128 OF THE SOUTH BEND MUNICIPAL CODE ADDRESSING THE ZONING OF ANNEXED AREAS. The Indiana State Legislature has given to cities and towns the ability to enact legislation which enhances the orderly growth and development of the communities. The City of South Bend believes that the annexation and subsequent rezoning of properties can be handled more expeditiously than the existing process. The proposed process will be beneficial to both the City of South Bend as well as to individual property owners in that it will reduce the amount of time that it currently takes to annex real property into the City of South Bend and then rezone the subject real property. 1Pt0~tl, ~~j~r~tor~, ~ld~ ~(~ ~r~a~itt~~' by the Common Council of the City of South Bend, Indiana, as follows: i n I Chapter 21, Article 7, Section 21-128 of the South Bend Municipal Code is repealed in its entirety and replaced with the following, which shall read in its entirety as follows: i n II. This ordinance would amend § 21-128 of the South Bend Municipal Code by streamlining the process for newly annexed real property into the City of South Bend. Roland Kelly This ordinance has had the input from the staff of the Area Plan Third District Commission, the Department of Community and Economic Development, the Legal Department, as well as the Zoning and Annexation Committee. John Broden The Zoning and Annexation Committee reviewed the proposed Fourth District ordinance at its meeting today and recommends on behalf of the Common David Vamer Council, that it be filed for proper readings and public hearings before the Area Fifth District Plan Commission and the Common Council. The Area Plan Commission at its public hearing on December 16, 1997, took the following action: Upon a motion by John McNamara, being seconded by Carl Littrell and unanimously carried, the proposed ordinance initiated by the Common Council of the City of South Bend amending Chapter 21, Article 7, Section 128 of the South Bend Municipal Code addressing the zoning of annexed areas is sent to the Common Council with a favorable recommendation. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. STAFF REPORT December 8, 1997 Initiated by the Common Council of the Citv of South Bend 1809-97 Location: City of South Bend REQUESTED ACTION: This is a Common Council initiated text amendment which amends Chapter 21, Article 7, Section 128 of the South Bend Municipal Code. The proposed amendment will reduce the time it takes to rezone property annexed into the city of South Bend. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the Staff recommends that this petition be sent to the Common Council with a favorable recommendation.
