The Area Plan Commission at its public hearing on June 16, 1998, took the following action: Upon a motion by Lee Slavinskas, being seconded by Charles Rogers and unanimously carried, the proposed ordinance initiated by the Area Plan Commission to zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care, property located at 2211 East Jefferson Boulevard, City of South Bend is sent to the Common Council with a favorable recommendation. This petition would rezone an office that is a legal nonconforming use in the "B" Residential district to the "PHC" Professional/Health Care district. "PHC" zoning will make the office a permitted use, which would allow it to be rebuilt if destroyed. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana J ~ ~< ~~ STAFF REPORT June 8, 1998 Initiated by the Area Plan Commission 1824-98 Location: 2211 East Jefferson Boulevard City of South Bend REQUESTED ACTION: This is an Area Plan Commission initiated petition to zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care to allow permitted uses in the "PHC" Professional/Health Care District. EXISTING LAND USE: The property contains an office building. SURROUNDING LAND USE AND ZONING: Located to the north is a condominium zoned "A-1" Residential, "C" Height and Area; to the east and west are single family homes zoned "A" Residential, "A" Height and Area; and to the south are a church and school zoned "A" Residential, "A" Height and Area. ACCESS: WATER SOURCE/SEWAGE DISPOSAL: DRAINAGE: SITE DATA: ENVIRONMENTAL DATA: SITE PLAN: Access to the site is from Jefferson Boulevard. Water and sewer are available to the site. The total site to be rezoned is 4.5 acres. A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. AGENCY COMMENTS: In 1986, this site was rezoned from "A" and "B" Residential, "A" Height and Area to "B" Residential, "A" Height and Area to allow an office building. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the Staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to the existing approved Final Site Plan. This petition would rezone an office that is a legal nonconforming use in the "B" Residential district to the "PHC" Professional/Health Care district.
