STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: A part of Mayflower Court as shown on the plat of Blackthorn Corporate Office Park as recorded as Instrument Number 9438010 in the Office of the Recorder of St. Joseph County, Indiana, also being part of the Southwest Quarter of Section 20 and the Northwest Quarter of Section 29, all in Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana, described as follows: Commencing at the Southeast corner of the Southwest Quarter of said Section 20; thence North 00 degrees 19 minutes 53 seconds West along the East line of the Southwest Quarter of said Section 20 a distance of 53.11 feet (53.15 feet, Inst. No. 9438010) to the Southerly right of way line of Mayflower Court as shown on said plat of Blackthorn Corporate Office Park; thence along said Southerly right of way line Southwesterly 231.82 feet along an arc to the right and having a radius of 250.00 feet and subtended by a long chord having a bearing of South 63 degrees 06 minutes 07 seconds West and a length of 233.61 feet to the Point of Beginning of this description: thence along the South right of way line of Mayflower Court Westerly 3.85 feet along an arc to the right and having a radius of 250.00 feet and subtended by a long chord having a bearing of North 89 degrees 53 minutes 32 seconds West and a length of 3.85 feet; Thence North 89 degrees 27 minutes OS seconds West along said South right of way line a distance of 426.87 feet; thence along the right of way of Mayflower Court Westerly, Northerly and Easterly 345.69 feet along an arc to the right and having a radius of 82.50 feet and subtended by a long chord having a bearing of North 30 degrees 35 minutes 20 seconds East and a length of 142.84 feet (N 30° 32' 47" E, 142.89 feet, Inst. No. 9438010); thence South 79 degrees 03 minutes 47 seconds East along the North right of way line of Mayflower Court a distance of 131.17 feet (131.74 feet, Inst. No. 9438010); thence South 89 degrees 27 minutes OS seconds East along said North right of way line a distance of 225.87 feet; thence along the Northerly right of way line Northeasterly 141.88 feet along an arc to the left and having a radius of 150.00 feet and subtended by a long chord having a bearing of North 63 degrees 38 minutes OS seconds East and a length of 136.65 feet; thence South 36 degrees 32 minutes 21 seconds West a distance of 200.00 feet to the Point of Beginning and containing 1.459 acres. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lots 1, 2 and 3 of Blackthorn Corporate Office Park Minor #6 SECTION IV. The purpose of the vacation of the real property is to: Relocate Mayflower Court SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. For your information, the Board of Public Works received favorable recommendations from the Fire Department, Bureau of Sanitation, Division of Engineering, Department of Community and Economic Development, Area Plan Commission and the Police Department concerning this vacation, subject to any utility easements that maybe required.
