AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 1735 CALVERT,
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
SECTION_I. Ordinance No. 4990-68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South
Bend, Indiana, be and the same hereby is amended in order that
the zoning classification of the following described real estate
in the City of South Bend, St. Joseph County, State of Indiana:
Lot 5 & 6 of Denslow Plat
be and the same is hereby established as "A-1" Residential, "A"
Height and Area.
SECTION_II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by
the mayor, and legal publication,

RE: A proposed ordinance of NBD Bank to zone from "C" Commercial, "A" Height and
Area to "A-1" Residential, "A" Height and Area, property located at 1735 E.
Calvert, City of South Bend - APC #1843-98
Dear Council Members:
The above referenced ordinance of NBD Bank was legally advertised May 7, 1998.
The Area Plan Commission at its public hearing on May 19, 1998, took the
following action:
Upon a motion by Joseph Serge, being seconded by John McNamara and unanimously
carried, the proposed ordinance of NBD Bank to zone from "C" Commercial, "A"
Height and Area to "A-1" Residential, "A" Height and Area, property located at
1735 E. Calvert, City of South Bend is sent to the Common Council with a
favorable recommendation. This property contains a commercial structure
converted into a duplex and is surrounded by single family homes. While the
Commission would not normally encourage "A-1" zoning on a single lot in the
middle of a single family area, it is the Commission's opinion that in this
instance, "A-1" Residential zoning is more appropriate for this property than "C"
Commercial.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

Location: 1735 E. Calvert
City of South Bend
REQUESTED ACTION: The petitioner is requesting a zone change
from "C" Commercial, "A" Height and Area to
"A-1" Residential, "A" Height and Area to
allow a duplex.
EXITING LAND USE: The property contains a duplex.
SURROUNDING LAND USE AND ZONING: Located to the north is vacant land zoned "A"
Residential, "A" Height and Area and to the
east, south, and west are single family homes
zoned "A" Residential, "A" Height and Area.
ACCESS: Access to the site is from Calvert and Sampson
streets.
WATE SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site.
DRAINAGE:
SITE DATA: The total site to be rezoned is 11,718 square
feet.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no
public wells, wetlands, or environmental
hazard areas are present. To the north of the
site is a flood hazard area.
SITE PLAN: A site plan is not required for rezonings to
"A-1" Residential.
AGENCY COMMENTS: In 1986, this property was rezoned from "A"
Residential, "A" Height and Area to "C"
Commercial, "A" Height and Area for a
restaurant. (APC 1002-86)
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the Staff recommends that this
petition be sent to the Common Council with a
favorable recommendation. This property
contains a commercial structure converted into
a duplex and is surrounded by single family
homes. While the Staff would not normally
encourage "A-1" zoning on a single lot in the
middle of a single family area, it is the
Staff's opinion that in this instance, "A-1"
Residential zoning is more appropriate for
this property than "C" Commercial.
