V ~ ~ ~~1~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THEREWITH LOCATED IN GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA AND DESIGNATING A ZONING CLASSIFICATION OTHER THAN RESIDENTIAL (KIDDER II ANNEXATION) STATEMENT OF PURPOSE The Common Council of the City of South Bend, Indiana, has determined that it is in the best interest of the City of South Bend to annex and bring within the corporate limits of the City of South Bend certain territory that is contiguous with the City of South Bend. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. That the following described real estate situated in St. Joseph County, Indiana, having approximately 40.30 of its aggregate external boundaries contiguous with the present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed to and brought within the City of South Bend, Indiana: That part of the west half of the southwest quarter of Section 19, Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana, more particularly described as follows: Beginning at the southwest corner of the intersection of Olive Road and the Indiana east-west toll road, also being the northeast corner of Lot 3 of Kidder's Olive Road Minor subdivision; thence west following the north line of said subdivision to the west line of Section 19, Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana, also being the Warren Township line, St. Joseph County, Indiana; thence south following said Warren Township line to the southwest corner of Lot 3 of said subdivision, thence east along the south line of said Lot 3 to the west right-of-way line of Olive Road; thence north along said line to a point of intersection with the north Line, extended, of Wells Electronics Minor subdivision; thence east to the east right-of-way line of Olive Road, thence t north along said line to the south line of the Olive Road Commerce Park Section One subdivision; thence west along said line to the west right-of-way line of Olive Road; thence north along said line to the point of beginning. Section II. That the above-described real estate is 100% subdivided. Section III. That the boundaries of the City of South Bend, Indiana, shall be and hereby are declared to be extended so as to include all of the above-described real estate as a part of the City of South Bend, Indiana. Section IV. That the zoning classification of the annexation area described previously in Section I, with the exception of all adjacent rights-of-way, be and hereby is designated as ~~IP" Industrial Park, under the authority of the Zoning Ordinance of the City of South Bend, Chapter 21, Article 7, Section 21-128 (a). Section V. That the above-described area shall be and hereby is assigned to the First Councilmanic District of the City of South Bend, Indiana. Section VI. KOLATA EXECUTIVE DIRECTOR DEPUTY EXECUTIVE DIRECTOR August 11, 1998 Mr. Sean Coleman, President South Bend Common Council 4th Floor, County-City Building South Bend, IN 46601 Dear Mr. Coleman: An ordinance proposing to annex to the City of South Bend contiguous territory, has been filed as the Kidder II Annexation Area. This 43.5 acre City-initiated annexation is generally located on the west side of Olive Road, between Cleveland Road and the Indiana Toll Road. The ordinance also proposes to zone the annexed area as "IP" Industrial Park. The ordinance is a combined annexation and a zoning proposal. Although the Council is the initiating body, the owner of record will be requested to be present at the public meetings. Final site plans will be required for the development of the site. I am requesting that the public hearing (Second Reading) on the ordinance be scheduled for September 28,1998. The delay in the Second reading is due to the Fiscal Plan having to be scheduled before the Board of Public Works, the Boazd of Public Safety and the Board of Water Commissioners, in addition to the proposed zoning being heazd before the Area Plan Commission. The Area Plan Commission at its public hearing on September 15, 1998, took the following action: Upon a motion by Willie Morgan, being seconded by Lloyd Taylor and unanimously carried, the proposed ordinance initiated by the Common Council of the City of South Bend to zone from "R" Residential to "IP" Industrial Park, property located at the southwest corner of Olive Road and the Indiana Toll Road, City of South Bend is sent to the Common Council with a favorable recommendation, subject to a final site development plan. This site is part of the Blackthorn Development Plan, which designates this area for industrial uses. This site will be a logical extension of the existing industrial development and zoning to the east of Olive Road and has access to the Toll Road, St. Joseph Valley Parkway, and the Airport. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Attached, for your consideration in the review of this matter, is a copy of the Area Plan Commission's Staff Report. Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana w STAFF REPORT September 4, 1998 Common Council Initiated Annexation - Kidder II 1877-98 Location: the southwest corner of Olive Road and the Indiana Toll Road City of South Bend REQUESTED ACTION: This is a Common Council initiated petition to zone from "R" Residential to "IP" Industrial Park. EXISTING LAND USE: The property is currently vacant. SURROUNDING LAND USE AND ZONING: Located to the north and west is farm land zoned "R" Residential; to the south is farm land zoned "A" Residential ("D" Light Industrial zoning pending); and to the east are single family homes zoned "A" Agricultural and businesses zoned "D" Light Industrial. ACCESS: Access to the site is from Olive Road. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available t th i o e s te. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 66.9 acres. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings initiated by the Common Council. AGENCY COMMENTS: PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to a final site plan.
