AN ORDINANCE FIXING THE MAXIMUM SALARIES AND WAGES OF
TEAMSTER EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA,
FOR THE CALENDAR YEARS 1999, 2000, 2001, AND 2002.
Statement of Purpose and Intent
This Ordinance sets forth the monetary aspects of the tentative agreement reached
between the City Negotiating Team and the Teamster's Negotiating Team on Friday, July 24,
1998 which was later ratified on Monday, July 27, 1998, by the members of the Teamster
Local Union No. 364.
This Ordinance would approve the monetary amounts of the ratified wage and benefit
package, which was believed to be in the best interest of the City. Accordingly, the intent of
this Ordinance is to fix the maximum salaries and wages for all City employees represented
by the International Brotherhood of Teamsters of America, Local Union No. 364, for calendar
years 1999, 2000, 2001, and 2002.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. Scope of Coverage
This Ordinance shall determine all issues of compensation for all employees for the City of
South Bend, Indiana, represented by Teamsters Local Union No. 364 affiliated with the
International Brotherhood of Teamsters of America, hereinafter referred to as the "Teamster
Local Union No. 364", in the following operational units:
Century Center/Hall of Fame
Division of Equipment Services
Department of Parks & Recreation
Police Department
Sewer Division
Solid Waste Division
Street Division
Traffic and Lighting Division
Wastewater/Organic Resources Division
Water Works Division
Section II. Maximum Compensation
A. The calendar years 1999, 2000, 2001, and 2002, the maximum base salaries and wages
for the following employees represented by Teamster Local Union No. 364 of the City of
South Bend, Indiana, shall be no more than as listed in this Section; provided, however, that
nothing herein shall exclude the applicability of Section III of this Ordinance should the
qualifications therein be met.
B. Pay periods for all such employees shall be made in accordance with Section 2-118 of
the Municipal Code of the City of South Bend.

Section III. Holidays
A. Each such employee shall have ten (10) holidays per calendar year. The following
nine (9) holidays are recognized by the Employer:
New Year's Day Veteran's Day
Good Friday Thanksgiving Day
Memorial Day Day after Thanksgiving
Fourth of July Christmas Day
Labor Day
The remaining one (1) holiday shall be as selected by the individual employee, with the
consent of the City, from the following:
Christmas Eve
New Year's Eve
Easter Monday
Martin Luther King's Birthday
Columbus Day
Employee's Birthday
Election Day (Indiana Primary of General Election Day)
B. Employees represented by Teamster Local Union No. 364 shall receive their regular
hourly rate of pay including any premiums for each of the ten (10) holidays. An employee
working a five 8-hour day workweek shall receive 8 hours pay for each of the ten (10)
holidays, providing he or she has worked the regularly scheduled day before and after the
holiday unless officially excused. An employee working a four 10-hour day workweek shall
receive 10 hours pay for each of the ten (10) holidays, providing he or she has worked the
regularly scheduled day before and after the holiday unless officially excused. Should the
employee use a sick day either the day before or the day after the holiday, he or she must
have a doctor's slip for that day.
C. If an employee is required to work any of the ten (10) holidays, he or she will receive
time and one-half (1 1/2) of his or her regular hourly rate of pay for such work in addition to
the holiday grant.
D. Holidays will be considered as time worked for the purpose of computing overtime.
E. Regular employees will be entitled to holiday pay if the holiday falls within the first
thirty (30) days of absence due to illness or non-occupational injury or within the first six (6)
months of absence due to occupational injury.
F. Probationary employees and temporary employees shall not be entitled to holiday pay.
Section IV. Vacations.
A. All employees represented by Teamster Local Union No. 364 who were employed by
the City on or before December 31, 1986, and have been employed continuously since, shall
have the following schedule for 1999, 2000, 2001, and 2002:

B. All other employees represented by Teamster Local Union No. 364 shall have the
following vacation schedule for 1999, 2000, 2001, and 2002:

C. All other requirements related to vacations shall be addressed in the Agreement
entered into between the City of South Bend and Teamster Local Union No. 364 as further
addressed in Section V herein.
D. Vacations will be paid in accordance with Section 1-20 of the Municipal Code of the
City of South Bend.
Section V. Other Monetary and Fringe Benefits Incorporated by Reference
All provisions of the Agreement between the City of South Bend, Indiana, and the Teamster
Local Union No. 364, effective January 1, 1999 through December 31, 2002, concerning any
issue of wages and/or compensation, including but not limited to provisions concerning
performance based bonuses where applicable, overtime, standby, call-back, shift differential,
vacations, insurance, and other related monetary items are incorporated herein and made a
part hereof as if set forth herein in their entirety. Two copies shall be kept on file and made
available for public inspection during regular business hours in the Office of the City Clerk,
4th Floor, County-City Building, South Bend, Indiana.
Section VI. Effective Date
This Ordinance shall be in full force and effect from and after its passage by the Common
Council and approval by the Mayor.
