AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 1122 AND 1205 SOUTH
IRONWOOD DRIVE, CITY OF SOUTH BEND, INDIANA
INDIANA:
BE IT ORDAINED By the Common Council of the City of South Bend,
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
Lot A of River Park's 2nd Replat and Lots 50 and 51
of the Original Plat of River Park, City of South
Bend, St. Joseph County
be and the same is hereby established as "PHC" Profession/Health Care
District.
SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the mayor,
and legal publication.

RE: A proposed ordinance initiated by the Area Plan Commission to zone from "B"
Residential, "B" and "A" Height and Area to "PHC" Professional/Health Care,
property located at 1122 and 1205 South Ironwood Drive, City of South Bend - APC
#1886-98
Dear Council Members:
The above referenced ordinance initiated by the Area Plan Commission was legally
advertised on November 5, 1998. The Area Plan Commission at its public hearing
on November 17, 1998, took the following action:
Upon a motion by John McNamara, being seconded by Lee Slavinskas and unanimously
carried, the proposed ordinance initiated by the Area Plan Commission to zone
from "B" Residential, °B" and "A" Height and Area to "PHC" Professional/Health
Care, property located at 1122 and 1205 South Ironwood Drive, City of South Bend
is sent to the Common Council with a favorable recommendation, subject to the
existing approved final site plan. This petition would rezone office properties
which are in the "B" Residential District, to the "PHC" Professional/Health Care
District. "PHC" zoning will allow the offices in the petition area to remain as
permitted uses when the "B" Residential zoning is updated, which allows them to
expand or rebuild if destroyed.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

Location: 1122 and 1205 South Ironwood

REQUESTED ACTION: This is an Area Plan Commission initiated
petition to rezone from "B" Residential, "B"
and "A" Height and Area to "PHC"
Professional/Health Care to allow permitted
uses in the "PHC" Professional/Health Care
District.
EXISTING LAND USE:
The property currently contians offices.
SURROUNDING LAND USE AND ZONING: Surrounding the sites are single family homes
zoned "A" Residential, "A" Height & Area and a
business zoned "C" Commercial and "B"
Residential, "A" Height & Area.
ACCESS: Access to the sites is from Ironwood Drive and
Pleasant Boulevard.
WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site.
DRAINAGE:
SITE DATA: The total area to be rezoned is approximately
1.1 acres.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no
public wells, flood hazards, wetlands, or
environmental hazard areas are present.
SITE PLAN: A site plan is not required for rezonings
initiated by the Area Plan Commission.
AGENCY COMMENTS: The site at 1122 South Ironwood drive was
rezoned to "B" Residential in 1994 for a
medical office. APC #1599-94
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the staff recommends that this
petition be sent to the Common Council with a
favorable recommendation, subject to the
existing approved Final Site Plan. This
petition would rezone office properties which
are in the "B" Residential District, to the
"PHC" Professional/Health Care District.
"PHC" zoning will make offices in the petition
area permitted uses, which allow them to
expand or rebuild if destroyed.
