Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lot 1 of Inwood/Ironwood Minor Subdivision, Penn Township, City of South Bend, St. Joseph County, Indiana; be and the same is hereby established as "PHC" Profession/Health Care District. SECTION II. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the mayor, and legal publication. The Area Plan Commission at its public hearing on November 17, 1998, took the following action: Upon a motion by Lee Slavinskas, being seconded by Randy Matthys and unanimously carried, the proposed ordinance initiated by the Area Plan Coaunission to zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care, property located at 2102 East Inwood Road, City of South Bend is sent to the Common Council with a favorable recommendation, subject to the existing approved final site plan. This petition would rezone an office in the "B" Residential District to the "PHC" Professional/Health Care District. "PHC" zoning will allow the office to remain as a permitted use when the "B" Residential zoning is updated, which will allow the building to be expanded or rebuilt if destroyed. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. F3'~!d'D, G°a, Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana .. ~, STAFF REPORT November 9, 1998 Initiated by the Area Plan Commission 1887-98_ Location: 2102 East Inwood Road City of South Bend REQUESTED ACTION: This is an Area Plan Commission initiated petition to rezone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care to allow permitted uses in the "PHC" Professional/Health Care District. EXISTING LAND USE: The property currently contains a medical office building. SURROUNDING LAND USE AND ZONING: Located to the north is a retirement facility zoned "B" Residential, "B" Height & Area; to the east and south is vacant land pending "B" Residential, "B" Height & Area; and to the west are single family homes zoned "A" Residential, "A" Height & Area. ACCESS: Access to the site is from Inwood Road. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: SITE DATA: The total site to be rezoned is approximately 3.1 acres. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, flood hazards, wetlands, or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings initiated by the Area Plan Commission. AGENCY COMMENTS: This site was rezoned in 1991 to "B" Residential for a medical clinic. APC #1432-91 PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to the existing approved Final Site Plan. This petition would rezone an office in the "B" Residential District to the "PHC" Professional/Health Care District.
