November 9, 19 98 Attest: Attest: Presented by me to the Mayor of the City of South Bend, Indiana City Clerk President of Common Council November 10, 19 98 City Clerk Approved and signed by me November i i , 19 98 Mayor ,, <, ORDINANCE NO. ~~~ / D ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ESTABLISHING A PURCHA5ING AGENCY FOR THE CITY OF SOUTH BEND, INDIANA Statement of Puroose and Intent WHEREAS, I.C. 5-22 (the "Act") applies to every expenditure of public funds by a governmental body; WHEREAS, the City of South Bend is a governmental body under the Act; and WHEREAS, the Act authorizes the Common Council to establish a purchasing agency for the City; and WHEREAS, the Common Council desires to establish a purchasing agency for the City. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. The Purchasing Agency for the City is hereby established as the Mayor. Section II. The Purchasing Agency shall have all the powers and duties authorized under I.C. 5-22, as may be supplemented from time to time by ordinances adopted by the Council and policies adopted by the Purchasing Agency or .his purchasing agents. Section III. The Purchasing Agency shall act as the purchasing agency for every agency, board, office, branch, bureau, commission, council, department or other establishment of the City. Section N. The Purchasing Agency may designate in writing any employee of the City as a purchasing agent. Section V. NussBAUM,II CrrY ATTORNEY Mr. Sean Coleman, President South Bend Common Council County-City Building, 4th Floor South Bend, IN 46601 Dear Mr. Coleman: In accordance with recent changes in the purchasing laws of the State of Indiana, I am proposing the attached ordinance and resolutions to the South Bend Common Council for approval. ' The Purchasing Ordinance will establish the Mayor as the Purchasing Agent for the City of South Bend in accordance with I.C. 5-22-4-5. The Mayor will then have to designate, in writing, individuals to be purchasing agents. One Resolution promotes the purchase of supplies manufactured in the United States as required by I.C. 6-22-15-21. The other Resolution adopts general rules for purchasing covering the protection of offers, evidence of financial responsibility, modification and termination of contracts, small purchases, purchase of services and small business set-asides.
