' 2009 South Bend Common Council
The June 8, 2009 meeting of the Personnel and Finance Committee of the South Bend
Common Council was called to order by its Chairperson, Council Member Thomas
LaFountain at 3:15 p.m. in the Council's Informal Meeting Room
Persons in attendance included Council Members Varner, Rouse, White, Henry Davis, Jr.,
LaFountain, Puzzello, and Dieter; City Controller M. Catherine Fanello, Rita Kopola,
Martha Lewis, Winona Hays, and Kathleen Cekanski-Farrand, Council Attorney.
Council Member LaFountain noted that the Committee Members include Council Members
White, Varner, Oliver Davis, and himself; and that a quorum was present.
Bill No. 39-09 Bill Amending Ordinance No. 9822-08 Addressing the Proposed
Adjustment of Wages of the Water Works Shut Off Clerk:
Council Member LaFountain called for a presentation on Bill No. 39-09 which is a request
to amend Ordinance No. 9822-08 addressing Teamster Employee Wages for 2009-2010.
City Controller M. Catherine Fanello made the formal presentation. Ms. Fanello noted that
she has checked every single City employee's hourly wages, and as a part of that review
she found that one (1) position was listed higher than the amount set forth in the Teamster
contract. She noted that one (1) employee was entitled to incentive pay which dates back
to 1998 which she termed a "legacy cost". This employee is near retirement and has
worked for the City for 29 years. The ordinance would correct the amount for this
employee only.
In response to a question from Council Member White, Ms. Fanello noted that the
ordinance would be retroactive to 01-01-09.
There was no one from the public to speak in favor or in opposition to the Bill.
Council Member White made a motion, seconded by Dr. Varner that Bill No. 39-09 receive
a favorable recommendation. The motion passed.
Bill No. 09-46 Request for Approval of a Scrap Metal Operation License:
Council Member LaFountain called for a presentation on Bill No. 09-46 which would
approve the license application for Indiana Auto Parts located at 3300 S. Main Street.
Winona Hays, Ordinance Violations Clerk made the formal presentation. Ms. Hays stated
that the renewal of the business license for Indiana Auto Parts doing business at 3300 S.

Works, Department of Code Enforcement and the Building Department. All of these
entities have recommended approval.
At 3:20 p.m. Council Member Oliver Davis joined the Committee meeting.
There was no one from the public to speak in favor or in opposition to the Bill.
Dr. Varner made a motion, seconded by Council Member White, that Bill No. 09-46 be sent
with a favorable recommendation. The motion passed.
Miscellaneous Business:
Council Member White encourage all Council Members to be engaged in the upcoming
budget process in light of the financial challenges facing the city. She hoped that all
Council Members would be at the table during the budget hearings.
City Controller M. Catherine Fanello stated that she has suggested to Council Member
LaFountain that the Committee hold hearings on the draft budget the last week of July and
the first week of August. June 30, 2009 is the last day of meetings with the Department
Heads with the City Administration. July 10th is her target date for information to be sent
to the Common Council on the 2010 budget. September 30th is the deadline for passing a
budget by the Council.
Council President Dieter noted that he will have more information from the county and the
Mishawaka in the next couple of weeks on their plans for moving forward on COIT/LOIT.
Ms. Fanello added that Crowe Chizek looked at the state's numbers last Friday and that
the projected 5% reduction in tax receipts or higher appears to be accurate; with property
tax levy growth projected to be less than 2% in 2011.
Council Member LaFountain stated that he would like all Council Members to send to him
as soon as possible, all dates and times that they would be unavailable to meet.
There being no further business to come. before the Committee, Council Member
LaFountain adjourned the meeting at 3:25 p.m.
