Define Board of Zoning Appeals
Chairman Kirsits introduced Christa Nayder from the APC who along with John
Byorni, Director, of the Area Plan Commission, explained to the Council the
purpose of the bill. Bill No. 15-09 is an ordinance initiated by the APC to define
the South Bend BZA as the Area BZA, in effect consolidating the city and county
BZA. This would reduce the filing dates, meting dates, and advertising
deadlines. It would allow more efficient use of staff time and that of appointees
to the Board. To that end, the staff along with the Mayor and the Legal
Department recommended passage by the Council. Following the explanation a
Q & A session by Karen White, Derek Dieter, Dr. Varner, Henry Davis, and Oliver
Davis brought up issues ranging from whether consolidation saved any
appreciable money to whether neighborhood interest would be compromised in
that city residents as dictated by state law would not comprise a majority of
appointees on the BZA. John Byorni, Ann Puzzello, and Jeff Jankowski all
supported advantages of consolidation.
Turning to the public portion David Sassano, BZA Board Member spoke opposed
to the bill rather advocating overhaul of the whole appeal process. No members
of the public spoke in favor. Calling upon the Committee to recommend to full
Council one way or the other, Mr. Kirsits accepted a motion from Councilmember
LaFountain followed by a second from Councilmember Oliver Davis the bill go
favorably. All supported save Councilmember Varner.
Bill No. 09-33 -Special Exception for 445 S. Meade Street
Chairman Kirsits called upon Mark Lyons of the Building Department to explain
the purpose of the petition filed by Maria Galvez owner of 445 S. Meade. This
property, a duplex, was properly zoned as such before suffering extensive
damage by fire. Before the rehab was completed the zoning reverted to single
family. Mrs. Galvez asked the mufti-family designation be allowed. Mr. Lyons
explained all criteria of the petition were successfully completed and the BZA had
forwarded it to the council with a favorable recommendation. Councilmember
Oliver Davis motion favorably. Councilmember LaFountain seconded in kind and
upon a Committee vote all concurred.
There being no further business to come before the Committee at this time,
Chairperson Kirsits adjourned the meeting at 4:06 p.m.
