AN ORDINANCE AMENDING ORDINANCE NUMBERS 8808-97 AND 8889-98
ADDRESSING THE ANNUAL PAY AND MONETARY
FRINGE BENEFITS FOR MEMBERS OF THE SOUTH BEND POLICE DEPARTMENT
FOR CALENDAR YEARS 1999, 2000, AND 2001
STATEMENT OF PURPOSE AND INTENT
On July 28, 1997, the South Bend Common Council passed Ordinance 8808-97, fixing the
annual pay and monetary fringe benefits of sworn members and officers of the South Bend Police
Department for the calendar years 1998 through 2001.
Since the passage of the Police Department Salary Ordinance in 1997, the South Bend Police
Department has undertaken a reorganization of the Investigative Division in a continuing effort to
attract qualified individuals and address pay inequalities which have arisen over the years. The
reorganization involved establishing different levels for Corporals, based on experience and expertise.
To this purpose the South Bend Common Council passed Ordinance No. 8889-98 on February 23,
1998.
The purpose of the reorganization was to provide the same compensation for investigators
based upon the level of expertise they held within the bureau, rather than the permanent rank held by
the investigator. To achieve that end, a slight adjustment needs to made for Level III Investigators
holding the rank of Corporal. Ordinance 8889-98 inadvertently omitted a section referencing the Sick
Leave Cost Reduction Program. That section is being restored retroactively here. Finally, certain
Sections of Ordinance 8808-97 are renumbered to prevent duplication.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, as follows:
Section I. Detective Classification Pav.
Ordinance 8808-97 is further amended by substituting the following paragraph (S)(1) of
Section III:
(S)(1) Swom members holding the rank of Corporal and assigned to the Investigative
Division of the Police Department on a full time basis who are qualified shall be entitled to
receive the following additional pay:
Investigative Level 1999 2000 2001
Level III 2363 2313 2063
Level II $900 $900 $900
Section II. Sick Leave Cost Reduction Program.
Ordinance 8808-97 is hereby further amended by adding the following paragraph (T):
(T) The Sick Leave Cost Reduction Program. The Sick Leave Cost Reduction Program shall
continue in effect whereby a police officer may be compensated for relinquishment of earned sick time
through and including December 31.2001. with the Board of Public Safety establishing specific
criteria and conditions of the Working Agreement.
Section III. Technical Changes.
What had been denominated as Sections III, IV, V and VI are renumbered as follows:
Section Bt: IV. Body Armor Vest Ouartermaster S s~m•
A body armor vest quartermaster system shall be established January 1, 1998, for all members
of the Uniform Division. All Uniform Division police officers shall be provided with acity-purchased
body armor vest which shall be replaced pursuant to a quartermaster system. Twelve (12) new body
armor vests shall be purchased by the City each year and made available to non-Uniform Division
police on an on-needed basis, first come first serve.
Section ~: V. Working_Agreement.
The Common Council recommends that the Working Agreement as tentatively agreed to by
the respective Wage Teams be approved by the Board of Public Safety.
Section V. VI. Service Year Defined.
A. The first service year for a member of the South Bend Police Department commences upon
the individual being sworn in before the Board of Public Safety as a member of the department. The
second service year shall begin on the next succeeding first day of January 1st and service years shall
continue to increase until the member attains the maximum salary for the particular rank he or she may
hold.
B. Advancement from the rank of Patrolman First Class to Corporal is dependent upon three
(3) complete calendar years of service plus a determination of satisfactory performance of duty and
promotion by the Board of Public Safety.
Section ~l VII. Effective Date. This Ordinance shall be in full force and effect from and after
its passage by the Common Council and approval by the Mayor.
Section IV. Effective Date. This Ordinance amending Ordinances 8808-97 and 8889-98
shall be in full force and effect from and after its passage by the Common Council and approval by
the Mayor.

Dear Common Council Members:
Since the passage of the Police Department Salary Ordinance in
1997, the South Bend Police Department Investigative Division has
undergone a reorganization to address pay inequalities between the
different ranks in that Division based on experience and expertise.
On February 23, 1998, the South Bend Common Council passed Ordinance
No. 8889-98 to adjust the pay levels for these positions.
The purpose of the reorganization was to compensate officers
based on the level of expertise they held within the bureau, rather
than the permanent rank held by the investigator. In order to
accomplish this, a slight adjustment needs to be made for Level III
Investigators holding the permanent rank of Corporal.
Therefore, I ask the members of the Council to amend Ordinance
No. 8808-97 to include those changes.
