AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY:
The first north/south alley east of South Chapin Street from the northright-of--way of Napier Street to the
south right-of way of West Wayne Street for a distance of approximately 154 feet and a width of 10 feet. All
taken from the east side of Lots 11, 12, and 13 of Huston's Sub. of Bank Outlot 72, South Bend, St. Joseph
County, Indiana.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12 ,the Common Council is charged with the authority to
hear all petitions to vacate public ways or public places within the City.
The following Ordinance vacates the above described public property.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
SECTION I.
THE COMMON COUNCIL OF THE CITY OF SOUTH BEND HAVING HELD A PUBLIC
HEARING ON THE PETITION TO VACATE THE FOLLOWING PROPERTY:
The first north/south alley east of South Chapin Street from the north right-of--way of Napier Street to the
south right-of--way of West Wayne Street for a distance of approximately 154 feet and a width of 10 feet. All
taken from the east side of Lots 1 1, 12, and 13 of Huston's Sub. of Bank Outlot 72, South Bend, St. Joseph
County, Indiana.
HEREBY DETERMINES THAT IT IS DESIRABLE TO VACATE SAID PROPERTY.
SECTION II.
THE CITY OF SOUTH BEND HEREBY RESERVES THE RIGHTS AND EASEMENTS OF ALL
UTILITIES AND THE MUNICIPAL CITY OF SOUTH BEND, INDIANA TO CONSTRUCT AND
MAINTAIN ANY FACILITIES, GAS, WATER, SEWER, SURFACE WATER, CONTROL
STRUCTURES AND DITCHES, WITHIN THE VACATED RIGHT-OF-WAY, UNLESS SUCH
RIGHTS ARE RELEASED BY THE INDIVIDUAL UTILITIES.
SECTION III.
THE FOLLOWING PROPERTY MAY BE INJURIOUSLY OR BENEFICIALLY AFFECTED BY
SUCH VACATING:

SECTION IV.
THE PURPOSE OF THE VACATION OF REAL PROPERTY IS TO
allow for the consolidation of the lots targeted for the development of Phase II of the Chapin Market
Development. The project is an extension from Phase I of the Chapin Market, which now houses a grocery
store {Sav-A-Lot) and the Chapin Street Clinic. Phase II will complement phase one with a planned
Laundromat and other professional service-providers. The goal is to provide services at a site both within
walking distance from the homes of neighborhood residents and also visible enough to attract customers by its
proximity to the grocery store and the heavily traveled Western and Chapin intersection. Continuation of the
Chapin Mazket development will have a decided positive impact on the revitalization of the inner city
neighborhoods on the west side of South Bend.
SECTION V.
THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS
PASSAGE BY THE COMMON COUNCIL AND APPROVAL BY THE MAYOR.

Dear Members of the Council:
In accordance with Municipal Code Section 18-53.8, a favorable recommendation is being
submitted to the Common Council concerning an alley vacation, as follows:
The first north south alley east of South Chapin Street from the north right of way of Napier
Street to the south right of way of West Wayne Street for a distance of approximately 154
feet and a width of 10 feet. All taken from the east side of Lots 11, 12, and 13 of Huston's
Sub. Of Bank Outlot 72, South Bend, St. Joseph County, Indiana.
For your information, the Board of Public Works received favorable recommendations from
the Fire Department, Bureau of Sanitation, Division of Engineering, Department of Community and
Economic Development, Area Plan Commission and the Police Department concerning this vacation,
subject to any utility easements that maybe required.
Therefore, the Board submits to you a favorable recommendation concerning this vacation.
