The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday, April 8,
2009 with President Juanita Dem. psey, and Board Members Bruce BonDurant and Jack Reed present.
Board Member Patrick Cottrell was absent. Also present were Police Chief Darryl Boykins, Fire
Chief Howard Buchanon and Board Attorney Thomas Bodnar.
The meeting was held in the Board of Public Works Meeting Room, 131h Floor County City
Building, South Bend, Indiana.

Mr. Bodnar noted the addition of Police Department Monthly Statistics for the month of
March 2009.

REGULAR MEETING APRIL 8, 2009
The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, April 8, 2009,
with President Juanita Dempsey, and Board Members Bruce BonDurant and E. Jack Reed present.
Board Member Patrick Cottrell was absent. Also present were Police Chief Darryl Boykins, Fire
Chief Howard Buchanon, and Board Attorney Thomas Bodnar.
The meeting was held in the Board of Public Works Meeting Room, 13"' Floor, County City
Building, South Bend, Indiana.
ACCEPT MINUTES OF PREVIOUS MEETINGS
President Dempsey advised that if there were no objections by members of the Board, the minutes of
the Public Agenda Session, Executive Session, and Regular meetings of the Board held on March 18,
2009, would be accepted as presented.

unnecessary. Later on February 14, 2009, Cpl. King completed a report concerning the arrest. In that
report King stated that Katlum, after exiting his vehicle, stopped and took a bladed stance and
reached for his right side.

On February 14, 2009 Cpl. Jason King used unnecessary force towards Skee Katlum, which conduct
violated Rules 301.03 and 302.00(1), (27) and (37) of the South Bend Police Duty Manual and the
"Response to Resistance" Order issued on April 28, 2008 and was conduct unbecoming a South
Bend police officer, thereby violating I.C. 36-8-3-4(b)(2)(B)(C)(G) d(H).

Boykins noted this was in accordance with past practice. I
President Dempsey stated the Board would accept the charges for filing and instructed the Clerk to
prepare a letter to serve the Charges on Corporal Jason King,
En a letter to the Board, Chief Boykins requested the Board honor the request for demotion to
Corporal in the Uniform Division for Sergeant Ronald Kaszas. Chief Boykins explained. that
Sergeant ,..s as has requested the demotion for personal reasons and has waived any rights to a
hearing on this matter under IC 36-8-3 before the Board of Public Safety. Upon a motion by Mr.
-6onDurant, seconded by Mr. Reed and carried, the demotion was approved.

ACCEPT AND FILE DONATION TO SOUTH BEND POLICE DEPARTMENT
In a letter to the Board, Chief Boykins advised the Board of a generous donation of five-hundr
dollars ($500.00) made to the South Bend Police Department Summer Tennis Program by A
General, LLC. There being no further discussion, the President Demp t. the donation wou III
be accepted and
of four-hundred dollars ($400.00) made to the South Police Department
Program by Steel Warehouse Company, LLC. There being no ftu-ther discussion, President Dempsey
stated the donation would be accepted

Department, would be accepted for filing. There being no objections, the following report was
accepted for filing:
