AN ORDINANCE RE-DESIGNATING AND RE-ESTABLISHING AN HISTORIC
LANDMARK FOR REAL ESTATE AT 701 E. PENNSYLVANIA AVENUE AND
RESCINDING ORDINANCE NO. 6608-79.
STATEMENT OF PURPOSE AND INTENT
On July 23, 1979 the City of South Bend approved Ordinance No. 6608-79 establishing a
historic landmark for real estate commonly known as the Martin and Christina Wegner House
located at 701 East Pennsylvania Avenue in the City of South Bend. At the time of landmark
enactment, this real estate was described legally at lot 226 Wegner Homestead.
Thereafter the landmark real estate at 701 East Pennsylvania Avenue, South Bend, was
replated by the Area Plan Commission and the legal description used in Ordinance No. 6608-79
no longer applies.
This Ordinance is to correct the legal description of the originally designated landmark so
that all land encompassed in Ordinance No. 6608-79 is correctly described under the terms of the
replat. This Ordinance also rescinds and supersedes original Ordinance No. 6608-79.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA:
Section I. The real estate commonly known as 701 East Pennsylvania Avenue, South
Bend, Indiana, and also referred to as the Martin and Christine Wegner House, be and hereby is
re-designated and re-established as an Historic Landmark by the authority of Ordinance No.
5565-73, as amended, which historic landmark has the following replat legal description: Apart
of the West half of the Northeast Quarter of Section 13, Township 37 North, Range 2 East, in the
city of South Bend, St. Joseph County, Indiana, more particularly described as follows:
Commencing at the intersection of the North Right-of--Way of Pennsylvania Avenue with the
East right-of--way of Marietta Street and the Point of Beginning; Thence North 0 Degrees 49
Minutes 50 Seconds West along the East line of the said Marietta Street, a Distance of 135.73
Feet; Thence North 89 Degrees 18 Minutes 07 Seconds East, a Distance of 58.00 Feet; Thence
South 0 Degrees 27 Minutes 27 Seconds East, a Distance of 135.63 Feet; Thence South 89
Degrees 11 Minutes 28 Seconds West along the North Right-of--Way line of Pennsylvania
Avenue, a Distance of 54.12 Feet to the Point of Beginning.
Section II. Upon Passage of this Ordinance, the previous Ordinance No. 6608-79
establishing this real estate as a historic landmark shall be rescinded.
Section III. This Ordinance shall be in full force and effect from and after its passage by
the Common Council, approval by the Mayor, and appropriate publication.

Please fine the attached ordinance which has been prepared for introduction at the Common
Council. The purpose of this ordinance is to re-designate and re-establish an Historic
Landmark at 701 E. Pennsylvania Avenue in accordance with the Area Plan Commission's
replatting of the area.
The Historic Preservation Commission has recommended re-designation this property under a
new legal description, in accordance with the replat of the property, to the Common Council at
the Commissions public hearing on July 19, 1999. A Copy of the map showing the replating of
the area is also enclosed.
