S -~ AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The first east/west alley north of Lincolnway West from the west right-of--way of Cushing Street to the east right-of--way of the first north/south alley west of Cushing Street for a distance of 128 feet and a width of 10 feet. Part located in Cushing and Lindsey's Sub., City of South Bend, St. Joseph County, Indiana. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12 ,the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. THE COMMON COUNCIL OF THE CITY OF SOUTH BEND HAVING HELD A PUBLIC HEARING ON THE PETITION TO VACATE THE FOLLOWING PROPERTY: The first east/west alley north of Lincolnway West from the west right-of--way of Cushing Street to the east right-of--way of the first north/south alley west of Cushing Street for a distance of 128 feet and a width of 10 feet. Part located in Cushing and Lindsey's Sub., City of South Bend, St. Joseph County, Indiana. HEREBY DETERMINES THAT IT IS DESIRABLE TO VACATE SAID PROPERTY. SECTION II. THE CITY OF SOUTH BEND HEREBY RESERVES THE RIGHTS AND EASEMENTS OF ALL UTILITIES AND THE MUNICIPAL CITY OF SOUTH BEND, INDIANA TO CONSTRUCT AND MAINTAIN ANY FACILITIES, GAS, WATER, SEWER, SURFACE WATER, CONTROL STRUCTURES AND DITCHES, WITHIN THE VACATED RIGHT-OF-WAY, UNLESS SUCH RIGHTS ARE RELEASED BY THE INDIVIDUAL UTILITIES. THE PURPOSE OF THE VACATION OF REAL PROPERTY IS TO Allow South Bend Heritage Foundation (SBHF) to develop parking behind the future location of it's offices. The vacation will allow SBHF to incorporate two parcels of land it owns into one site plan. Traffic will still be able to traverse through the lot. SECTION V. THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER TI'S PASSAGE BY THE COMMON COUNCIL AND APPROVAL BY THE MAYOR. Directly behind the buildings there is a 10 feet FJW alley and adjacent to that is a residential lot owned by SBHF (the former location of WNDU's Our House"). This vacated lot has been incorporated into the site plan to allow for parking and landscaping. Consequently, the alley would run directly through the parking lot. As the attached site plan shows traffic will be able to go through the parking lot between N. Cushing and the N/S alley lying west of the site. However, for the purposes of developing and maintaining the property and locating elements of landscaping SBHF requests that the alley be vacated. We look forward to a favorable recommendation to vacate this alley.
