Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South~Bend, St. Joseph County, State of Indiana: Key Number: 18-2167-6144 Description: Lot 1S2 3RD Plat of NW Add Lot 150 & 151, South Bend, Indiana be and the same is hereby established as ("A" Residential, "A" Height and Area. . The Area Plan Commission at its public hearing on July 20, 1999, took the following action: Upon a motion by Willie Morgan, being seconded bey David McKee and unanimously carried, the ~ro~osed ordinance of Debra Turner to zone from ' D" Light Industrial, "D" Height and Area to 'A' Residential, "A" Height and Area, property located at 1005 Queen Street, City of South Bend is sent to the Common Council with a favorable recommendation. This site is adjacent to many other residential uses. Ideally, the remaining residential sized lots on the north s><de of Queen Street will also be rezoned and developed as homes to provide a distinct boundary from the industrial use to the south. However, the petitioner should be aware that those lots are currently zoned "D" Light Industrial and could be developed for industrial purposes at any time in the future. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Serving South Bend, Lakeville, New Carlisle, North Liberty, Osceola, Roseland and St. Joseph County, Indiana Debra Turner 1939-99 Location: 1005 Queen Street City of South Bend STAFF REPORT July 12, 1999 REQUESTED ACTION: The petitioners are requesting a zone change from "D" Light Industrial, "D" Height and Area to "A" Residential, "A" Height and Area to allow a single-family house. EXISTING LAND USE: The property is currently vacant. SURROUNDING LAND USE AND ZONING: Located to the north are single family homes . zoned "B" Residential, "D" Height & Area; to the east are apartments zoned "B" Residential, "B" Height & Area; to the south is an industrial use zoned "D" Light Industrial, "D" Height & Area; and to the west is vacant land zoned "D" Light Industrial, "D" Height & Area. ACCESS: Access to the site is from Queen and Sherman Streets WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 14,208 square feet. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, flood hazards, wetlands, or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings to "A" Residential. AGENCY COMMENTS: PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. This site is adjacent to many other residential uses. Ideally, the remaining residential sized lots on the north side of Queen Street will also be rezoned and developed as homes to provide a distinct boundary from the industrial use to the south.
