Huffer to zone from "C" Commercial, "A" Height and Area to "A" Residential, "A" Height and Area, property located at 501 North Olive Street, City of South Bend - APC #1924-99 Dear Council Members: The above referenced ordinance of Owen E. and Shirley A. Huffer was legally advertised June 3, 1999. The Area Plan Commission at its public hearing on June 15, 1999, took the following action: Upon a motion by Lee Slavinskas, being seconded by Rod Sniadecki and unanimously carried, the proposed ordinance of Owen E. and Shirley A. Huffer to zone from "C" CommercialZ "A" Height and Area to "A" Residential, "A" Height and Area, property located at 501 North Ohve Street, City of South Bend is sent to the Common Council with a favorable recommendation. This lot is adjacent to an area that was downzoned to "A" Residential in 1997. Approval of the petition would match the zoning for this lot to its current use. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commtssion. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Huffer 1924-99 Location: 501 North Olive Street City of South Bend REQUESTED ACTION: The petitioners are requesting a zone Change from "C" Commercial, "A" Height and Area to "A" Residential, "A" Height and Area to allow residential use. EXISTING LAND USE: The property currently contains a commercia l building used as a single family home. SURROUNDING LAND USE AND ZONING: Located to the north and west are single family homes zoned "A" Residential, "A" Height & Area; and to the south and east are commercial uses zoned "C" Commercial, "A" & "D" Height and Area. ACCESS: Access to the site is from Olive and Bertrand Streets. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: . SITE DATA: The total site to be rezoned is 5,440 square feet. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, floodzones or environmental hazard areas are present. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation.
