AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, AMENDING ARTICLE 2, OF CHAPTER 21,
ZONING, OF THE SOUTH BEND MUNICIPAL CODE TO
ALLOW ACCESSORY BUILDINGS IN "O" OFFICE
Statement of Purpose and Intent
The purpose of this ordinance is to allow existing accessory buildings to remain
when property is zoned to "O" Office.
The Common Council of the City of South Bend finds that it is desirable to make
certain amendments to the standards of office zoning in the South Bend Zoning
Ordinance.
NOW THEREFORE, be it ordained by the Common Council of the City of South
Bend, Indiana, as follows:
Section 1. Section 21-12.040 "O" Office District; accessory uses be amended by
adding the following section:
(2) Accessory structures existing at the time the property is zoned to"O"
Office regardless of the sg_uare footage may remain. The total square footage of any new
accessory structure shall not cause the total square foota>;e of all accessory structures t_o
exceed 576 square feet The height of any new accessory structures shall not exceed 14'.
Section 2. This Ordinance shall be in full force and effect from and after its
passage by the Common Council and approval by the Mayor.

Dear Mr. Coleman:
Attached, please find a proposed ordinance initiated by the Area
Plan Commission. The purpose of this ordinance is to allow
existing accessory buildings, such as garages, or new
construction of accessory buildings to be allowed on a property
zoned "O" Office.
Please place the proposed ordinance on your April 12, 1999,
agenda for first reading. The Area Plan Commission will conduct
its public hearing on April 20, 1999.

RE: A proposed ordinance initiated b~ the Area Plan Commission amending Article 2 of Chapter
21 Zoning, of the South Bend Municipal Code to allow accessory buildings m "O" Office - APC
#1914-99
Dear Council Members:
The above referenced ordinance initiated by the Area Plan Commission was legally advertised on
April 8, 1999. The Area Plan Commission at its public hearing on Apri120, 1999, took the
following action:
Upon a motion by Lew Powell, being seconded by Willie Morgan and unanimously carried, the
proposed ordinance initiated by the Area Plan Commission amending Article 2 of Chapter 21
Zo~ung, of the South Bend Mumcipal Code to allow accessory buildings in O Office is sent to
the Common Council with a favorable recommendation.
The deliberations of the Area Plan Commission and points considered in arriving at the above
decision are shown in the minutes of the public hearing, and will be forwarded to you at a later
date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.

Location:

REQUESTED ACTION: This is an Area Plan Commission initiated petition to
allow accessory buildings in the "O" Office zoning
classification. Total accessory structures would be
limited to 576 square feet or the existing structures. A
similar amendment was done in the County.
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the public
hearing, the staff recommends that this petition be sent
to the Common Council with a favorable recommendation.
