LOUIS BOULEVARD STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a Public Hearing on the petition to vacate the following property: A 14 FOOT WIDE ALLEY BEING THE FIRST EAST-WEST ALLEY LYING SOUTH OF KALORAMA STREET BETWEEN TURNOCK STREET AND THE FIRST NORTH-SOUTH ALLEY EAST OF NORTH ST. LOUIS BOULEVARD. hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of--way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: LOTS E AND 13 OF TURNOCK'S SUBDIVISION OF A PART OF TURNOCK AND MACK'S ADDITION TO THE CITY OF SOUTH BEND AS RECORDED IN PLAT BOOK 9, PAGE 82 IN THE OFFICE OF RECORDER OF ST. JOSEPH COUNTY, INDIANA. Section IV. The purpose of the vacation of the real property is TO VACATE A 14 FOOT WIDE ALLEY SO THAT THE NORTH 7 FEET CAN BE ADDED TO SAID LOT E TO THE NORTH. THE ADDITIONAL 7 FEET WILL BE COMBINED WITH LOTS D AND E WITHIN SAID TURNOCK'S SUBDIVISION TO THE NORTH AND BE SUBDIVIDED 1NT0 2 NEW LOTS FOR REDEVELOPMENT. SECTION V. Please refer to the attached drawings for the area to be vacated. The reason we are submitting this vacation request is utilize the north 7 feet of the vacated alley in order to develop two homes to the north. The additional 7 feet will give Weiss Homes the needed width for the construction of two homes. Without the additional 7 feet, only one home could be constructed due to the current narrow lot widths. The City Board of Public Works is expected to consider and approve both the vacation request at either their December 22^d meeting dependent upon various city department reviews or at their January 12tH meeting. The following comments and recommendations were submitted: Area Plan stated that the vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would not make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public's access to a church, school or other public building or place. The vacation would not hinder the use of a public right of way by the neighborhood in which it is located or to which it is contiguous. You will need a radius map showing properties within 150' of the proposed vacation for your petition to the Common Council.
