"Babe" Voorde on September 29, 1956 with this ordinance creating a "Department of Redevelopment" as well as a Redevelopment Commission; and currently the Redevelopment Commission meets on the I" & P Fridays of each month at 10 am. in the Board of Public Works Conference Room, 13 Floor County-City Building and its membership includes Marcia I. Jones, President; Dr. David Varner, Vice - President; Nancy King, Secretary; Gregory Downes, Member; and Don Alford, Member with the Common Council having appointed Marcia Jones and Dr. Varner; and the Common Council has learned from news reports that the Redevelopment Commission may be formally asked to consider using $1.3 million of TIF monies in 2009 and an additional $1.6 million of TIF monies in 2011 for the proposed New Tech High School, a concept which the South Bend Community School Corporation supported to pursue at its February 9, 2009 meeting. tea., 6lL Gs .r awa,, by the Common Council of the City of South Bend, Indiana, as follows: Section I . The South Bend Common Council believes that the new tech teaching and learning concept is very exciting and may be a significant benefit to our youth, as well as to our entire community. However, the Common Council strongly believes that since the Redevelopment Commission has never had the proposed new tech high school on their agenda, that before the Redevelopment Commission can move forward on any funding requests for such a project, that much more information should be shared with the Common Council and the entire community. New projects of this magnitude should be successful and cost - efficient, especially in the post HEA 1001 era which has created additional fiscal challenges on all public entities. Before individuals can enthusiastically embrace the overall goal, communication and information sharing is not only mandatory, but it is vital to the very success of the proposed project. At a minim the following critical areas should be addressed and discussed openly before moving forward: • What is the complete plan for the proposed new tech high school project in the short and long term? • Why is private property being considered for its possible location, and were school properties considered? • Why is the timing of the proposed project so rushed, especially in light of the estimated cost for the fast year of operation being $2.75 million? • Have inter -local agreements been drafted spelling out the role and responsibilities of each entity? Section II . The South Bend Common Council notes that under the current Indiana state law that approval of TIF monies is given to the Redevelopment Commission, an appointed board, rather than an elected body. In light of that, the Common Council urges the Redevelopment Commission to meet with the Common Council and the South Bend Community School Corporation Board of Trustees to discuss this proposed project in public. Such a meeting would provide the opportunity for transparency, and perhaps even better ideas to make a new tech high school in South Bend, Indiana, an example of education excellence which other communities would want to emulate. The Common Council hereby determines and finds that the petition for real property tax abatement and the Statement of Benefits form meet the requirements of Indiana Code 6 -1.1 -12.1 et se ., for tax abatement. SECTION II. The Common Council hereby determines and finds that the area meets one of the following conditions as formally established in Ordinance No. 9394 -03, which was passed on February 10, 2003: A. The area is comprised of parcels that are either unimproved or contain only one (1) or two (2) family dwellings designed for up to four (4) families, including accessory buildings for those dwellings; or B. Any dwellings in the area are not permanently occupied and are: i. the subject of an order issued under IC 36 -7 -9; or ii. evidencing significant building deficiencies; or C. Parcels of property in the area: i. have been sold and not redeemed under IC 6- 1.1 -24 and IC 6- 1.1 -25; or ii. are owned by a unit of local government; or D. A significant number of dwelling units within the area are not permanently occupied or a significant number of parcels in the area are vacant land; or E. A significant number of dwelling units within the area are: i. the subject of an order issued under IC 36 -7 -9; or ii. evidencing significant building deficiencies; or F. The area has experienced a net loss in the number of dwelling units, as documented by census information, local building and demolition permits, or certificates of occupancy, or the areas are owned by Indiana or the United States; or, G. The area (plus any areas previously designated under this subsection) will not exceed ten percent (10 %) of the total area within the Council's jurisdiction. SECTION M. The Common Council also hereby determines and finds the following: A. That the description of the proposed redevelopment meets the applicable standards for such development. B. That the estimate of the value of the redevelopment is reasonable for projects of this nature; C. That the other benefits about which information was requested are benefits that can be reasonably expected to result from the proposed described redevelopment; and D. That the totality of benefits is sufficient to justify the requested deduction, all of which satisfy the requirements of Indiana Code 6 -1.1- 12.1 -3. E. The deduction will not be allowed unless the dwelling is rehabilitated to meet local code standards for habitability. F. The deduction will not be allowed unless the dwelling rehabilitation is completed within five (5) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION 'IV. The Common Council hereby determines and finds that the proposed described redevelopment can be reasonably expected to yield benefits identified in the Statement of Benefits and the petition for real property tax abatement consideration and that the Statement of Benefits form prescribed by the State Board of Accounts are sufficient to justify the deduction granted under Indiana Code 6 -1.1- 12.1 -3. SECTION V. The Common Council hereby accepts the report and recommendation of the Community and Economic Development Committee that the area herein described be designated as a Residentially Distressed Area and hereby adopts a Resolution designating this area as a Residentially Distressed Area for purposes of real property tax abatement. SECTION VI. The designation as a Residentially Distressed Area shall be limited to five (5) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION VII. The Common Council hereby determines that the property owner is qualified for and is granted property tax deduction for a period of five (5) years. SECTION VIII. The Common Council directs the City Clerk to cause notice of the adoption of this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana Code 5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing notice of the public hearing before the Common Council on the proposed confirming of said declaration. SECTION IX. Pursuant to Chapter 2, Article 6, Section 2 -84.2 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6 -1.1 -12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Treadstone, LLC recycles solid rubber tires into rubber mulch of various sizes and weights depending on use. Ninety percent of their production is a large premium size that is used primarily for children's playgrounds and for landscaping. The equipment to be purchased is a tire shredding machine. The new machine will double the company's production capacity to recycle solid rubber tires into mulch. The company is relatively new. For the past two years it has been using three prototype machines to manufacture its product. These machines are not built to withstand the rigors of the company's current production schedule. The new machine is stronger and will ease the burden on the three prototypes. In fact, the new machine is being built following a design that Treadstone developed and provided to the machine manufacturer. The design is based on Treadstone's experience with their prototypes. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby determines and finds pursuant to Indiana Code 6- 1.1- 12.1 -4.5 et seq., that: a. The estimate of the cost of the new manufacturing equipment is reasonable for equipment of that type; b. That the estimate of the number of individuals that will be employed or whose employment will be retained by the Petitioner can reasonably be expected to result from the proposed installation of new manufacturing equipment; C. That the estimate of the annual salaries of those individuals that will be employed or whose employment will be retained by the Petitioner can be reasonably expected to result from the proposed installation of new manufacturing equipment; d. Any other benefits about which information was requested are benefits that can be reasonably expected to result from the proposed new manufacturing equipment; and e. The totality of benefits is sufficient to justify the deduction requested. SECTION II. The Common Council hereby determines and finds that the proposed new manufacturing equipment can be reasonably- expected to yield the benefits identified in the Statement of Benefits as set forth in Sections 1 through 3 of the Petition for Personal Property Tax Abatement Consideration and that Statement of Benefits form completed by the petitioner, said form being prescribed by the State Board of Accounts, are sufficient to justify the deduction granted under Indiana Code 6 -1.1- 12.1 -4.5. SECTION III. The Common Council hereby accepts the report and recommendation of the Department of Community and Economic Development, and the Community and. Economic Development Committee's favorable recommendation, that the area herein described be designated as an Economic Revitalization Area for purposes of personal property tax abatement and hereby makes such a designation. At no point do they do any purchasing for any scrap, tires, or anything else. They are paid both for taking in the tires, and the scrap metal their business produces. They do not have any of the required items, because they do not do any purchasing. If they are required to have the license for whatever reason then I recommend them for a license under the above listed circumstances.
