Ordinance No 4990-68, is amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph county, State of Indiana: A. Phillippa Street, City of South Bend - APC #1950-99 Dear Council Members: The above referenced ordinance of Joan Godmilow was legally advertised on September 9, 1999. The Area Plan Commission at its public hearing on September 21, 1999, took the following action: Upon a motion by Gerry Phipps, being seconded by xoperc r~awiey ana unanuuuwiy caniCU, ~u~ ~roposed ordinance of Joan Godmilow to zone from "C" Commercial, "D" Height & Area to 'A-1" Residential, "D" Height & Area, property located at 614, 618, 702, 706 S. Phillippa Street, City of South Bend ><s sent to the Common Council with a favorable recommendation. Although the Commission would not normally recommend zoning single family homes to "A-1", the surrounding area is zoned for multi-family use and the commercial building will be used as a duplex. The proposed zoning is less intensive than the existing zoning. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Phillippa Street City of South Bend STAFF REPORT September 13, 1999 REQUESTED ACTION: The petitioners are requesting a zone change from "C" Commercial, "D" Height & Area to "A-1" Residential, "D" Height & Area to allow one and two family homes. EXISTING LAND USE: The property currently contains single family homes and a commercial building converted for residential use. SURROUNDING LAND USE AND ZONING: Located to the north, south and west are single family homes zoned "B" Residential, "A" Height & Area; and to the east are single family homes zoned "C" Commercial, "D" Height & Area. ACCESS: Access to the sites is from Phillippa Street. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 20,400 square feet. ENVIRONMENTAL DATA; A check of the Agency's maps indicates that no public wells, flood zones, wetlands, or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings to "A-1" Residential. AGENCY COMMENTS: PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. Although the staff would not normally recommend zoning single family homes to "A-1", the surrounding area is zoned for multi-family use and the commercial building will be used as a duplex.
