A RESOLUTION CONFIRMING THE ADOPTION OF A
DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY
KNOWN AS
1728 North Ironwood Drive
AS AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A
THREE-YEAR REAL PROPERTY TAX ABATEMENT FOR
Robert R. Lee (C.E. Lee Company, Inc.)
WHEREAS, the Common Council of the City of South Bend, Indiana, has
adopted a Declaratory Resolution designating certain areas within the City as Economic
Revitalization Areas for the parpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as
1728 North Ironwood Drive, South Bend, Indiana, and which is more particularly
described as follows:
Part of the Northeast Quarter (1/4) of the Southeast Quarter (1/4) of
Section 32, Township 38 North, Range 3 East, described as beginning
at a point three hundred five (305) feet North of the South one-eighth
(1/8) corner of the West boundary of said Section; thence East one
hundred ninety-four (194) feet; thence South sixty (60) feet parallel to
the West boundary of said Section; thence West one hundred ninety-
four (194) feet to the West boundary of said Section; thence North
sixty (60) feet to the place of the beginning;
and which has Key Number 024-1001-0410 presently, as an Economic Revitalization
Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public
hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5;
and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrance's and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
South Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution
designating the area described herein as an Economic Revitalization Area for the
purposes of tax abatement. Such designation is for Real property tax abatement only and
is limited to two (2) calendar years from the date of adoption of the Declaratory
Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is
qualified for and is granted Real property tax deduction for a period of three (3) years,
and further determines that the petition, the Memorandum of Agreement between the
Petitioner and the City of South Bend, and the Statement of Benefits comply with
Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code
6-1.1-12 et seq.
SECTION III. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approved by the Mayor.

Dear Council Member Dieter:
Please find attached the Department of Community & Economic Development's report on a commercial
real property tax abatement petition for the above-referenced petitioner for construction of a new facility to
be located at 1728 North Ironwood Drive. Also attached is a copy of the petition, Statement of Benefits
form, and supporting information.
The report contains the Department's findings relative to the above petition. The petitioner, Robert R. Lee
(C. E. Lee Company, Inc.), proposes to construct an approximate 6,800 square foot building to house their
retail decorating center. It will replace their original structure that was destroyed by fire. Please note that
the petitioner is asking for a special exception because the petition does not meet the general
standards for a real property tax abatement as set forth in the City's Ordinance. The petitioner is
seeking athree-year real property tax abatement, and a representative of the petitioner will be available to
meet with the Committee on Monday, January 12, 2008.

On November 10, 2008, a petition for real property tax abatement consideration for vacant property
located at 1728 North Ironwood Drive was filed with the City Clerk by Robert R. Lee (C. E. Lee
Company, Inc.). Please note: The petitioner is asking for a special exception because the
project does not meet the general standards for real property tax abatement set forth in
Chapter 2, Article 6, Sections 2-77 through 2-83.3 of the Municipal Code of the City of South
Bend. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South
Bend, this petition was referred to the Department of Community and Economic Development for
purposes of investigation and preparation of a report determining whether the area qualifies as an
Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have
been met.
The Department of Community and Economic Development has reviewed the petition, investigated
the area, and makes the following report.
PROJECT SUMMARY
Robert R. Lee is proposing to construct a new retail facility to be leased by C.E. Lee Company,
Incorporated. C.E. Lee Company, a retail decorating center, has been established in South Bend since
1872. They sell several different brands of paint, window treatments, and wall coverings. Customers
consist of individual homeowners as well as many paint contractors and maintenance accounts.
On Apri122, 2008, their retail store at 1728 North Ironwood Drive was destroyed by fire. Because
their local insurance agent failed to provide accurate replacement cost estimates, the company found
itself underinsured after the fire. Replacement costs for the building, equipment, and inventory total
$687,000. The company has received $485,000 in insurance proceeds and intends to finance the

remainder of the project with a loan from 15` Source Bank. The new building will be built on the old
site but the size of the building will be doubled to allow for a projected increase in both sales and
staff. The new building will be approximately 6,800 square feet in size and will have two stories; the
old building contained approximately 2,700 square feet all on one level.
The company is requesting a tax abatement with a special exception because the additional cost to
rebuild due to being underinsured is $205,000 and the revenue loss resulting from the fire was over
$100,000. They have discussed moving to another location but they prefer to stay in South Bend at
their present site where they have been a part of the City for 136 years.
Total taxes to be abated during the (3) three-year abatement period are estimated at $25,742. Total
taxes to be paid during the (3) three-year abatement period are estimated at $24,717.
EMPLOYMENT IMPACT
Per the petition, it is estimated that the project will create one new, permanent full-time position and
two permanent, part-time positions with an annual payroll $50,000. The project will also maintain
five existing permanent full-time positions and 2 existing part-time positions and a total annual
payroll of $250,000.
ABATEMENT QUALIFICATION
A review of the tax abatements previously granted finds that the petitioner has not been granted
or associated with any previous tax abatements.
2. The Building Commissioner has reviewed the petition and finds the properly to be properly
zoned for the proposed project.
3. A review of the South Bend Redevelopment designation areas finds that the property is not
located in any Tax Incremental Allocation Areas; therefore, no action is required by the South
Bend Redevelopment Commission.
4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does not meet
the qualifications for a real property tax abatement under the general standards for tax abatement
in the City of South Bend. However, the Ordinance does provide for an exception to the general
standards, at the South Bend Common Council's discretion. A (3) three-year real property tax
abatement is being sought as a special exception.

Dear Mr. Mathia,
I am writing in regards to our request to the Common Council regarding tax abatement. We first
became aware of our lack of proper insurance coverage after our fire. Our local agent failed to provide
us with accurate market pricing and replacement cost to rebuild our building as it stood previously. As
the result of that, we found ourselves $120,000 underinsured in just the rebuilding of the structure
alone. We were also underinsured $50,000 on our contents, $35,000 in IDEM testing and cleanup.
Also, as a result of the destruction, a portion of our computer records were lost and $10,000 from our
accounts receivable were a loss, as well as, revenue losses due to the disruption exceeded $100,000.
We are asking for this special exception not only because of our tragedy but for the fact that we
have been part of The City of South Bend since 1872. In the history of South Bend, we were quite
prominent. Our future building and the goals we have to increase sales, customer service, and
innovative decorating needs will not only benefit C.E. Lee Company but The City of South Bend and its
citizens as well. We look forward to future locations in The City of South Bend and branding ourselves in
this community as "the place" for your decorating needs.
We have discussed moving to another location outside of The City of South Bend, however, we
would prefer to rebuild at our former location, 1728 North Ironwood. Because of the additional cost to
rebuild and the current state of the economy, tax abatement would prove to be crucial while we are
rebuilding and implementing our strategy to grow within this community. As well as, rebuild our
customer base and increase revenue flow.
We currently employ 5 full time employees and 3 part time employees. We have employed
minorities in the past, as well as currently. We brought on an additional 2 full time employees after the
fire to assist in clean up and preparation to raze the damaged building. We will be adding a second
floor for more space and additional storage for stock which will increase sales and a need for additional
positions. We plan to add 2-3 other positions once we are in our new location.
