Mogul Powertrain, LLC will be investing approximately $11,315,200 in the purchase and

growth and the retention of a highly compensated workforce. The project meets the
qualifications for a (5) five year personal property tax abatement. A representative from
Federal -Mogul Powertrain, LLC will be available to meet with the Committee on Monday,
April 25, 2016.

SUBJECT: PERSONAL PROPERTY TAX ABATEMENT PETITION FOR:
Federal -Mogul Powertrain, LLC

On Tuesday, April 19, 2016, a petition from Federal -Mogul Powertrain, LLC was received
and subsequently filed with the City Clerk for personal property tax abatement
consideration for property to be located at 3605 W. Cleveland Rd, South Bend, IN 46628.
Pursuant to Chapter 2, Article 6, Section 2 -84.2 of the Municipal Code of the City of South
Bend, this petition was referred to the Department of Community Investment for purposes
of investigation and preparation of a report determining whether the area qualifies as an
Economic Revitalization Area pursuant to I.C.6 -1.1 -12.1 and whether all zoning
requirements have been met.
The Department of Community Investment has reviewed the petition (a copy of which is
attached), investigated the area, and makes the following report.
PROJECT SUMMARY
➢ Approximate $11,315,200 purchase of new equipment to facilitate new business
growth and retain the existing workforce.
➢ Total taxes on new equipment over the five year abatement period — $970,694
➢ Estimated taxes abated on new equipment over the five year abatement period —
$447,285
➢ Total taxes to be paid on new equipment over the five year abatement period —
$523,409
EMPLOYMENT IMPACT
Per the petition, it is estimated that the total project will:
➢ This new equipment purchase will not add any new jobs but will retain 544
permanent, full -time jobs representing a new annual payroll of approximately
$23,603,507

ABATEMENT QUALIFICATION
1. A review of the tax abatements previously granted, finds that the petitioner has
been granted or associated with previous abatements.
2. The Building Commissioner has reviewed the petition and finds the property to be
properly zoned for the proposed project.
3. A review of the South Bend Redevelopment designation areas finds that the property
is located in the River West Development Area.
4. A review of the Tax Abatement Ordinance No. 9394 -03 finds that the petitioner
meets the qualifications for a (5) five -year personal property tax abatement under
section 2 -84.2, Tangible Personal Property Tax Abatement.

A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN
THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS
3605 W. Cleveland Rd, South Bend, IN 46628
AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A
(5) FIVE -YEAR PERSONAL PROPERTY TAX ABATEMENT FOR:
Federal -Mogul Powertrain, LLC
WHEREAS, a petition for personal property tax abatement consideration has been filed with
the City Clerk for consideration by the Common Council of the City of South Bend, Indiana,
requesting that the area commonly known as 3605 W. Cleveland Rd, South Bend, IN 46628 and
which is more particularly described as follows:
Business Personal Property
and which has a Key Number to be assigned be designated as an Economic Revitalization Area
under the provisions of Indiana Code 6 -1.1 -12.1 et seq., and South Bend Municipal Code Sections 2-
76 et sec,., and;
WHEREAS, the Department of Community Investment has concluded an investigation and
prepared a report with information sufficient for the Common Council to determine that the area
qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1 -12.1, et sue., and South Bend
Municipal Code Sections 2 -76, et sec,., and has further prepared maps and plats showing the
boundaries and such other information regarding the area in question as required by law; and
WHEREAS, the Community Investment Committee of the Common Council has reviewed
said report and recommended to the Common Council that the area qualifies as an Economic
Revitalization Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby determines and finds pursuant to Indiana Code 6 -1.1-
12.1 -4.5 et sea., that:
a. The estimate of the cost of the new manufacturing equipment is reasonable for
equipment of that type;
b. That the estimate of the number of individuals that will be employed or whose
employment will be retained by the Petitioner can reasonably be expected to result
from the proposed installation of new manufacturing equipment;
C. That the estimate of the annual salaries of those individuals that will be employed or
whose employment will be retained by the Petitioner can be reasonably expected to
result from the proposed installation of new manufacturing equipment;
d. Any other benefits about which information was requested are benefits that can be
reasonably expected to result from the proposed new manufacturing equipment; and
The totality of benefits is sufficient to justify the deduction requested.
SECTION II. The Common Council hereby determines and finds that the proposed new equipment
can be reasonably expected to yield the benefits identified in the Statement of Benefits as set forth in
Sections 1 through 3 of the Petition for Personal Property Tax Abatement Consideration and that
Statement of Benefits form completed by the petitioner, said form being prescribed by the State
Board of Accounts, are sufficient to justify the deduction granted under Indiana Code 6 -1.1- 12.1 -4.5.
SECTION III. The Common Council hereby accepts the report and recommendation of the
Department of Community Investment, and the Community Investment Committee's favorable
recommendation, that the area herein described be designated as an Economic Revitalization Area
for purposes of personal property tax abatement and hereby makes such a designation.
SECTION IV. The Common Council determines that such designation is for personal property tax
abatement only and shall be limited to two (2) calendar years from the date of the adoption of this
Resolution by the Common Council.
SECTION V. The Common Council hereby determines that the property owner is qualified for and
is granted property tax deduction for a period of (5) five years as shown by the attachment pursuant
to Indiana Code 6 -1.1- 12.1 -17.
SECTION VI. The Common Council directs the City Clerk to cause notice of the adoption of this
Declaratory Resolution for Personal Property Tax Abatement to be published pursuant to Indiana
Code 5 -3 -1, said publication providing notice of the public hearing before the Common Council on
the proposed confirming of said declaration.
SECTION VII. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

Federal -Mogul Powertrain LLC is a manufacturer of automotive pistons. Customers include most of the major automotive
company, project, and why the
manufacturers. Operations in South Bend, IN began in 1987. Federal -Mogul has consistently employed over 500
property is necessary for
employees over the past 8 years with total salaries in excess of $21 million. Total sales generated from the South Bend
economic growth
facility currently exceed $119 million. The new projects represent new business growth for sustained business at the South
Bend facility and continued retained highly compensated employment levels.
There are three projects for new business production lines included as part of the Petition: 1) Chrysler CMET4 production
line - total expected investment of $8,128,200, 2) GM Uplift production line - total expected investment of $1,887,000, and
3) GM Duramax Assembly Machine - total expected investment of $1,300,000. The expected cost to be invested in the
three projects totals $11,315,200 and will permit continued high levels of retained existing employment.
Approval of this application will allow continued capital investment in the South Bend facility. Without additional investment,
new business and greater production efficiencies offered by new processes and new product lines, some levels of existing
production would likely be shifted outside of Indiana, most likely to another country, resulting in the facility's employment
levels and associated tax revenues to the County both declining.

INS FRUCTIONS;
1, This statement must be submitted to the body designating the Economic Revilalization'Area prior to the public hearing if the designating body requires
information from the applicant in making its decision about whether to designate an Economic Revitalization Area. Otherwise this statement must be submitted
to the designating body BEFORE a person installs the new manufacturing equipment and /orresearch and development equipment. and /or logistical distribution
equipment and /or information technology equipment for which the person wishes to claim a deduction. `'Projects" planned or committed to after July 1. 1987,
and areas designated after July 1, 1987, require a STATEMENT OF BENEFITS. (IC 6-1.1 -12.1)
2. Approval of the designating body (City Council, Town Board, County Council, etc.) must be obtained prior to installation of the new manufacturing equipment
and /or research and development equipment and /or logistical distribution equipment and /or information technology equipment, BEFORE a deduction may
be approved
3. To obtain a deduction, a person must file a certified deduction schedule with the person's personal property return on a certified deduction schedule (Form
103 -ERA) with the township assessor of the township where the property is situated or with the county assessor if there is no township assessor for the
township. The 103 -ERA must be filed between March f and May 15 of the assessment year in which new manufacturing equipment and /or research and
development equipment and /or logistical distribution equipment and /or Information technology equipment is installed and fully functional, unless a filing
extension has been obtained, A person who obtains a filing extension must file the form between March 1 and the extended due date of that year,
4. Properly owners whose Statement of Benefits was approved after June 30, 1991, must submit Form CF -1 / PP annually to show compliance with the
Statement of Benefits- (IC 6 -1,1- 12.1 -5.6)
5. The schedules established under IC 6- 1.1- 12.1- 4.5(d) and (e) apply to equipment installed after March 1, 2001, unless an alternative deduction schedule is
adopted by the designating body (IC 6 -1.1- 12.1 -17).
