The adaptive reuse of the property will allow the existing building to continue to be an integral part of this block. The proximity of the Center for the Homeless and Hope Ministries will provide a supportive network. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Land Uses and Zoning: On site: On site is a facility that provides meals, laundry facilities, and other social services to the homeless. North: To the north is an electrical sub-station owned by Indiana and Michigan Power zoned LI Light Industrial District. East: To the east is LC Typesetting zoned MU Mixed Use District. South: To the south is Rink Printing zoned LI Light Industrial District. West: To the west is an electrical sub-station owned by Indiana and Michigan Power zoned LI Light Industrial District. District uses and development standards: The MU Mixed Use District is established to promote the development of a dense urban village environment. The regulations are intended to encourage all the elements of a traditional urban village, including: storefront retail; professional offices; and, dwelling units located either in townhouse developments or in the upper stories of mixed-use buildings. The development standards in this district are designed to: encourage a pedestrian oriented design throughout the district; and, maintain an appropriate pedestrian scale, massing and relationship between buildings and structures within the district. Site plan description: The total area of the site is 31,515 square feet. The building is 10,772 square feet or 34% of the site. A total of 22 parking spaces are provided with access from Main Street. The total paved area is 12,176 square feet or 38% of the site. The open space is 8,567 square feet or 28% of the site. There is one access from Main Street. Traffic and transportation considerations: Main Street is a four lane one-way road. Additional information: (Agency comments) The existing facility is allowed under the current zoning. In order to allow for overnight stays, the property must be rezoned to Mixed Use and a Special Exception must be obtained. Both the staff and the Board of Zoning Appeals have recommended in favor of the Special Exception. 744 South Main, LLC #2497-09 Page 1 of 1 5 Criteria (per IC 36-7-4-603): 1. Comprehensive Plan: Policy Plan: City Plan, South Send Comprehensive Plan, November 2006 H 1.5 Support existing transitional housing providers and shelters that offer a continuum of care to move people toward self-sufficiency. ED 1: Stimulate the rehabilitation and adaptive reuse of property in the city. 2. Current conditions and character: The building is currently being used during the day for outreach activities. The are a variety of high intensity uses along the Michigan/Main corridor. Main Street is mostly LI Light Industrial, and Michigan Street is mostly MU Mixed Use. There is a gas station zoned C Commercial at the northwest corner of Main Street and Sample Street, 'and the Center for the Homeless is located immediately southeast of the site, across the alley. 3. Most desirable use: The most desirable use is to maintain the current zoning or a less intense zoning. 4. Conservation of property values: Surrounding property values should not be affected. This rezoning would not compromise the operation of the industrial businesses. 5. Responsible development and growth: It is responsible development and growth to allow the expansion of services to accommodate for the loss of services in another area. Recommendation: Based on information available prior to the public hearing, the staff recommends that the petition be sent to the Common Counci] with a favorable recommendation. Analysis: The adaptive reuse of the property will allow the existing building to continue to be an integral part of this block. "Babe" Voorde on September 29, 1956 with this ordinance creating a "Department of Redevelopment" as well as a Redevelopment Commission; and `ice, currently the Redevelopment Commission meets on the 1~` & 3`d Fridays of each month at 10 a.m. in the Board of Public Works Conference Room, 13t1i Floor County-City Building and its membership includes Marcia I. The South Bend Common Council believes that the new tech teaching and learning concept is very exciting and may be a significant benefit to our youth, as well as to our entire community. However, the Common Council strongly believes that since the Redevelopment Commission has never had the proposed new tech high school on their agenda, that before the Redevelopment Commission can move forward on any funding requests for such a project, that much more information should be shared with the Common Council and the entire community. New projects of this magnitude should be successful and cost-efficient, especially in the post HEA 1001 era which has created additional fiscal challenges on all public entities. Before individuals can enthusiastically embrace the overall goal, communication and information sharing is not only mandatory, but it is vital to the very success of the proposed project. At a minimum the following critical areas should be addressed and discussed openly before moving forwazd: • What is the complete plan for the proposed new tech high school project in the short and long term? • Why is private property being considered for its possible location, and were school properties considered? • Why is the timing of the proposed project so rushed, especially in light of the estimated cost for the first year of operation being $2.75 million? • Have inter-local agreements been drafted spelling out the role and responsibilities of each entity? Section II. The South Bend Common Council notes that under the current Indiana state law that approval of TIF monies is given to the Redevelopment Commission, an appointed board, rather than an elected body. In light of that, the Common Council urges the Redevelopment Commission to meet with the Common Council and the South Bend Community School Corporation Board of Trustees to discuss this proposed project in public. Such a meeting would provide the opportunity for transparency, and perhaps even better ideas to make a new tech high school in South Bend, Indiana, an example of education excellence which other communities would want to .emulate. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING OF AND PROCLAINIING SUPPORT AND PARTICIPATION IN THE DECENNIAL CENSUS 2010 WHEREAS, the 2010 CENSUS, the decennial census of population and housing, will enumerate the United States according to the Constitution on Census Day, April 1, 2010, and WHEREAS, Information from the 2010 CENSUS will form the basis for decisions on issues important to the City of South Bend, Indiana such as reapportionment and redistricting, distribution of public funds, and decision making and planning, both public and private, and will have far-reaching implications for all of us, well into the next millennium, and WHEREAS, the City of South Bend, Indiana agrees to be one of the government entities in partnership with the U. S. Bureau of the Census by jointly formulating, participating and cooperating in a COMPLETE COUNT COMMITTEE, along with St. Joseph County,lN, the City of Mishawaka, the Towns of Lakeville, New Carlisle, North Liberty, Osceola, Roseland, and Walkerton, and the Village of Indian Village, to ensure the 2010 CENSUS is an accurate and complete count of the Nation's population and housing, and WHEREAS, the City of South Bend, Indiana understands it's primary role in this partnership is to formulate and participate in a COMPLETE COUNT C011~11ITTEE to recognize the equal importance of each resident in the 2010 CENSUS, and which COM1l1ITTEE is composed of, but is not limited to the following Sub-Committees: An Educational Sub-Committee to create Census awareness programs for pre- kindergarten to college age students, coalesce with educational institutions, develop and distribute Census Bureau Education Programs, and to encourage parents and college students to apply for Census jobs. As a part of the Census Bureau's effort to ensure as complete count as possible, Complete Count Committees are encourage to be formed. The Committees are a group of citizens charged with assisting the Census Bureau with community-specific strategies that would educate, motivate and inspire alt residents to fill out their Census forms. A Complete Count Committee has been formed, and has been diligently working on developing strategies since December of 2008. The Committee consists of citizens from throughout the County. This ensures that all jurisdictions understand the importance of having their residents counted, and participate in the strategies to make that happen to the fullest extent possible. The Census Bureau also encourages that jurisdictions pass either a resolution or an agreement showing support for the Census 2010 effort. The attached resolution proclaims support and participation in the Decennial Census 2010 by the South Bend Common Council. I have attached a Complete Count Committee Member List, a Complete Count Committee structure chart, acid a list of the Response Rates from the 2000 Census. The response rates show more than anything else that a successful Census 2010 is important to everyone in St. Joseph County. I will be available at the Common Council meeting, but ifyou would like a more detailed report on the status of the Complete Count Committee and the strategies being developed, please don't hesitate to call me. Walnut (Recommended) Met with Blair Melvin. US Scrap was in full compliance with all required items. They have a very good video surveillance system, and had their binders of all purchase transactions, and forms for transactions less than $100. A-1 Auto Parts, 2014 S. Lafayette (Recommend with Reservations) Met with Thomas Brogdon. He does not have a surveillance system set up. He has been closed for business since 2006. He has kept his records from then, but has no current records. He is currently looking for an investor, or he will be selling the business. He is applying for a license to keep his business grandfathered in for zoning purposes. It is very obvious that he is not currently in business, and is not buying junk cars. I would recommend him for the permit, as for the past year he has been compliant, and not been open for business. Alternative Two LLC, 700 W. Chippewa (Recommended) Met with Mashelle Sager. Alternative Two is a tire recycler, and only deal in large quantity (semi loads) with contactors. They do not have video surveillance because they only deal with contractors, and do not purchase from non- contactors. They do not do small transactions. If someone wants to drop off a couple of tires they can, but they do not get paid. They do not keep records of transactions of less than $100, because they do not deal with any small transactions. They do keep records of all purchases from their contactors. Treadstone, LLC; 445 N. Sheridan (Recommended) I met with Ken Andrews. Again, I am not sure why this business has to have a scrap license. They are paid by contactors to take in forklift tires. They then strip the rubber from the tires and make various rubber products from them. They take the metal left over from tires, and throw it in a bin which is collected by Acme recycling. They are then paid by Acme for the scrap. At no point do they do any purchasing for any scrap, tires, or anything else. They are paid both for taking in the tires, and the scrap metal their business produces. They do not have any of the required items, because they do not do any purchasing. If they are required to have the license for whatever reason then I recommend them for a license under the above listed circumstances. U.S. Scrap & Recycling, 1610 Circle Ave. (Recommended) 1700 W. Washington (Recommended) 2014-2016 W. Washington. (Recommended) I met with Mike Morris. This area is used only for storage. There are no employees that work at these sites. They do have scales, but all business is by contactors only. They only deal in large quantities (huge bins/semi tractor loads). They do not deal in walk up/non contactors. L RESOLUTION NO. WHEREAS, pursuant to Section V of Ordinance #9467-03, it is necessary to establish the effective date of the vacation of that public real property described more fully in Ordinance #9467-03;and WHEREAS, the City Administration has advised the Common Council that construction of the subject redevelopment project in the general vicinity of Bartlett Street near the intersection with Main Street near Memorial Hospital of South Bend is substantially complete; and WHEREAS, the Common Council has been advised further than an effective date no later than March 20, 2009 for vacation of the public real property described in Ordinance #9467- 03 is necessary in order for the project to be fully complete per design plans. The budget submitted as required with the initial designation application was recently approved by the DOJ in January. These funds are being used for programming related to the Weed & Seed required areas of Law Enforcement, Community Policing and, Prevention, Intervention and Treatment activities. Included in this year's funding are police patrols, the time of a targeted prosecuting attorney, graffiti paint over supplies, Bridges Out of Poverty classes, a billboard art contest for youth, and items related to an after school program. The existing East half of the site will remain GI (General Industrial District). A special exception (for exterior car sales) and variances are being sought from the BZA, concurrent with this split rezoning. The BZA hearing is set for Thursday, April 16~', 2009. The present zoning, which is "GI" general industrial zoning does not permit some of the types of retail uses that a CB zoned parcel would allow. The project and site plan has been reviewed with the City Building Commissioner, Chuck Bulot, the BZA Zoning Administrator, Mark Lyons and John Byorni of the APC. The existing multi-use building was the former Romy Hammes Auto Dealership and was purchased by AI VanOverberghe in 2002. The present zoning is GI (General Industrial). In order to accommodate exterior auto sales, a rezoning of the west portion of the parcel and a special exception for exterior auto sales (and variances) are requested. The Owner's intent is to maximize the marketability of the multi-use building and to bring it into compliance with the present ordinance. The existing structure on the west side of the development was built in the 1960's and the setbacks, curb cuts, parking and drive layout are essentially as is. Improvements are planned to address the landscape ordinance in part, as per the proposed site plan. Split zoning of the parcel is proposed to allow for maximizing the retail potential of the building and parcel. The east half will retain the GI zoning. This half of the building houses, or has housed, auto towing, wholesale plumbing supply, small, motor repair, warehousing, etc. The west half of the building will be rezoned to CB (Community Business) zoning.. This half of the building houses or has housed office, retail sales, wholesale sales, clothing retail and other similar uses. The auto sales office would be located in this area (tenant space "F") and there would be 12 spaces for auto sales dedicated along Olive Street, at the south west portion of the parking lot (see site plan).
