Bill 04 -16 — Amending the zoning ordinance 3101 and 3113 Lincoln Way West (Kuert Concrete) Bill 16 -09 — Approving a special exception for 2610 Prairie Ave. (Brunos Pizza) Inactive & Dormant Bills Councilmember John Voorde, Vice Chairperson of the Zoning and Annexation Committee, called the meeting to order with three bills for consideration. Bill 03 -16 — Amending the zoning ordinance 3620 Deahl Court ( Corvilla Inc.) Angela Smith, Area Plan Commission with offices on the 116' Floor of the County City Building, served as the presenter for this bill. The petitioner is seeking to rezone from Light Industrial to ,Mixed Use for the proposed use of an adult daycare center. This used to be a girl scouts building and the majority of the property around the site is Light Industrial. The building is currently heavily screened by the existing vegetation. Angela Smith provided pictures of the site which are on file with the City Clerk's Office. This comes with a favorable recommendation from the Area Plan Commission. Councilmember Oliver Davis entered the meeting. Councilmember Jo M. Broden asked about the potential number of adults being served at the center and their conditions. Rick Thompson, 3231 Sugar Maple Business Ct South Bend, is the CEO of Corvilla and the petitioner for this bill. The individuals who will be using this site have intellectual or developmental disabilities. This will be a day service and around twenty -five (25) to forty (40) individuals will be there and staffed by no more than four (4) or five (5) individuals per staff member. Corvilla anticipates using the outside for some services but we are also looking into installing a fence around the wetlands even though it is a ways from the building. Their number one priority is the safety of their individuals. Councilmember Jo M. Broden commended Corvilla for filling this need for day time care as it is needed by these families but wanted to raise the concern about the wetlands being so close. There was no one from the public speaking for or against the bill. Councilmember Regina Williams- Preston entered the meeting. Councilmember Gavin Ferlic made a motion to send Bill 03 -16 to the full Council with a favorable recommendation. Councilmember Jo M. Broden seconded the motion which carried by a voice vote of four (4) ayes. Bill 04 -16 — Amending the zoning ordinance 3101 and 3113 Lincoln Way West (Kuert Concrete) Angela Smith, Area Plan Commission with offices on the 1 Ith Floor of the County City Building, served as the presenter for this bill. The petitioner is looking to rezone from Community Business to General Industrial. This is an extension of Kuert Concrete's property and will use it for outdoor storage which is currently not allowed under the Community Business zoning. Angela Smith provided pictures of the site and potential upgrades which are on file with the City Clerk's Office. The petitioner is proposing to install a six (6) to four (4) foot fence along the site and installing some landscaping to beautify the corner. This comes with a favorable recommendation from the Area Plan Commission. Councilmember John Voorde asked if anyone from the public came to the Area Plan Commission meeting. Angela Smith responded no one from the public came. Bradd Webb, Kuert Concrete 3402 Lincolnway West, reported they received note from a neighbor who did feel the proposed fencing and landscape work were an improvement to the site. Councilmember Gavin Ferlic reported the neighbor did talk to him and he was satisfied with the site plan once he learned that the same standards regarding this site would be applied if anyone else bought the site and wanted to use it. Councilmember Karen White asked that since this site does not align with the Lincolnway West master plan what do we do for exceptions going forward in the future. Angela Smith responded the master plan did call for this lot to be used for a commercial node, while General Industrial is not technically commercial since it is being used for displaying their products it is in a way functioning as a commercial lot. Council President Tim Scott expressed his concern to make sure we are in consistent with the improvements on Lincolnway which it looks like this is even though it is General Industrial. He complimented Kuert Concrete for their work in the area but was concerned about the residential units being so close. Mr. Webb responded there is a plan to put in vegetation and other landscaping to soften that streetscape. Mr. Webb displayed some renderings of what the site will look like once it is finished which are on file with the City Clerk's Office. No one from the public spoke in favor or in opposition to the bill. Councilmember Gavin Ferlic made a motion to send Bill 04 -16 to the full Council with a favorable recommendation. Councilmember Jo M. Broden seconded the motion which carried by a voice vote of four (4) ayes. Bill 16 -09 — Approving a special exception for 2610 Prairie Ave. ( Brunos Pizza) Aoka Peek, 125 Lafayette, served as the presenter of this bill. This is an application for a special exception for a drive through in addition to a fast casual restaurant which his allowed under the current zoning on the site. This comes with a favorable recommendation from the Area Board of Zoning Appeals. Brian McMorrow served as the petitioner for this bill. The 2.75 acres is immediately south of the Bruno's Pizzeria which is in place today. The intentions were to allow a fast casual, meaning there would be sufficient seating, but also to provide for the drive through or pickup service. This is either to attract a similar restaurant next door or to build upon it themselves. Councilmember Oliver Davis asked if they do plan on building on the site what would they do with the old property. Mr. McMorrow responded there are no plans as of now. Councilmember Jo M. Broden asked about the residential and apartments advancement to the lot. Mr. McMorrow said they have plans to add landscaping to provide a buffer if that is needed later down the line. There was no one from the public speaking in favor or against the bill. Councilmember Gavin Ferlic made a motion to send Bill 06 -09 to the full Council with a favorable recommendation. Councilmember Jo M. Broden seconded the motion which carried by a voice vote of four (4) ayes. Council Attorney Kathleen Cekasnki - Farrand explained the seven bills listed under Unfinished Business this evening and these are bills that can be stricken from the agenda as they are dormant and Area Plan Commission has withdrawn these bills. h Councilmember Gavin Ferlic made a motion to recommend to the full Council to strike those bills listed under Unfinished Business. Councilmember Jo M. Broden seconded the motion which carried by a voice vote of four (4) ayes.
