Agenda: Bill 08 -16 — Vacate the first north/south alley west of 29th Street
From Mishawaka Ave.
Councilmember Jo M. Broden, Chairperson of the Public Works and Property Vacation
Committee, called the meeting to order with one bill up for consideration.
Bill 08 -16 — Vacate the first north/south alley west of 29th Street from Mishawaka Ave.
Jitin Kain, Dept. of Public Works with offices on the 13th Floor of the County -City Building,
served as the presenter for this bill. The Board of Public Works has given this a favorable
recommendation. The Board asked the petitioner to look at the turning radiuses at the site and the
petitioner did to the satisfaction of the City Engineer.
Council Attorney Kathleen Cekanski - Farrand asked if Mr. Kain could talk to the Committee
about the cross access agreement.
Mr. Kain responded that the issue had been resolved. Unfortunately the engineer who worked on
this case is tied up in another meeting.
Steve Debold, 555 Eastport Centre Drive Valparaiso, IN 46383, are the petitioners for this bill.
This is the old River Park Furniture Store. They have met every requirement and satisfaction that.
the Board of Public Works requested. The Cross Access Agreement that was asked for was not
really needed for this project because of the layout of the road. The vacated alley will be for
additional parking on the site. .
Council Attorney Kathleen Cekanski - Farrand stated the Committee would need something
written from the Public Works office to certify that claim that no Cross Access Agreement is
needed.
Mr. Kain responded that from his standpoint the agreement is not needed and the conversations
he has had confirmed that view. Mr. Kain stated if the Committee required it he can have a letter
by the Council meeting.
There was no one from the public in support or opposition to the bill.
Councilmember Karen White asked if the alley vacation would hinder any type of movement by
the residents.
Mr. Kain responded the vacation does not hinder any access, only for Solid Waste and not for
residents.
Councilmember Karen White asked if anyone from the public spoke against this at the Board of
Public Works meetings.
Mr. Kain said there is no record of that at the meeting.
Council President Tim Scott stated he is the one who asked for the letter stating the Cross Access
Agreement is not needed. This is to make sure there is no ambiguity down the line when
everyone here is gone that there is nothing to question about this.
Councilmember Gavin Ferlic made a motion to send Bill 08 -16 to the full Council favorably
upon the condition that a letter is provided by the Dept. of Public Works addressing the issues
brought forward by the Committee. John Voorde seconded the motion which carried by a voice
vote of four (4) ayes.
There being nothing left before the Committee, Jo M. Broden adjourned the meeting at 4:09 p.m.
Respectfully Submitted,
roden, Chairperson
